JOB TITLE: DIRECTOR, BUREAU OF LICENSING AND ENFORCEMENT, INSURANCE

DEFINITION: This is highly responsible managerial and administrative work in the Pennsylvania Insurance Department’s Bureau of Licensing and Enforcement directing a statewide program to administer licensing, enforce insurance laws and regulations, and educate and evaluate insurers. The employee in this job plans, manages, and coordinates a statewide program to enforce state laws and regulations for insurance producers, companies, and other professionals licensed to conduct the business of insurance in the commonwealth. Work involves developing and implementing policies and procedures for the bureau’s efficient operation and directing staff engaged in insurance licensing, compliance verification, field investigations, registration, and documentation. Work includes analyzing newly enacted and proposed legislation for impacts on operations, participating with trade and regulatory associations in the development of model acts, and recommending revisions to existing federal and state laws and regulations through the National Association of Insurance Commissioners (NAIC). Supervision is exercised over professional, technical, and clerical staff. Work is assigned in the form of broad program goals and objectives and is reviewed by an administrative supervisor through reports, conferences, and projects completed.

• Directs a consumer protection program to test, license, and monitor compliance with continuing education requirements for insurance producers, surplus lines agents, public insurance adjusters, public insurance solicitors, motor vehicle damage appraisers, viatical brokers, professional bondsmen, and other insurance professionals.

• Develops and implements program policies and procedures in compliance with all relevant laws and regulations.

• Directs the investigations of insurance producers, companies, and other licensees where violations of insurance laws are alleged and determines appropriate remedies and penalties for violations.

• Directs the program requiring individuals convicted of certain felonies to obtain written consent from the Insurance Commissioner to engage in any aspect of the business of insurance.

• Works with the NAIC to develop uniform guidelines for licensure of persons to conduct the business of insurance to comply with federal legislation and provide service on the National Insurance Producer Registry, a central repository of information on all insurance producers.

• Directs the review of bureau operations to develop and improve processing systems within a high-volume environment; recommends technological and e-commerce enhancements.

• Coordinates enforcement efforts for laws, regulations, and other licensing activities with department program staff, other state insurance departments, and outside agencies.

• Serves as the point of contact for the Office of the Attorney General in cases where fraud is alleged and directs staff in follow-up investigations involving individual licensee cases.

• Serves as the principal advisor to the Deputy Insurance Commissioner and other executives on insurance licensing and enforcement matters and recommends and advocates for substantive program policy changes.

• Grants user permissions, based on individual and programmatic requirements, for the database system used to store member states’ regulatory information.

• Develops and administers vendor contracts for services. including fingerprinting, testing, continuing education, renewals, and amendments, for license applicants or existing licensees.

• Directs staff responses to individual and agency licensing inquiries.

• Directs the processing of requests for certifications, license histories, and other official documents requested by licensees, insurance companies, law enforcement agencies, and other state insurance departments.

• Manages oversight of annual billing fees to insurance companies for each affiliated producer.

• Directs the processing of producer appointments and terminations for licensed insurance companies transacting business with producers in Pennsylvania.

• Directs the verification and documentation of convictions or regulatory actions against license applicants and current licensees.

• Ensures the protection of insurance consumers by overseeing the review of complaints involving the termination of insurance agency contracts.

• Directs staff reviews of renewal applications on existing licensees to verify that information provided is complete and accurate.

• Directs the completion of preliminary drafts of consent orders.

• Performs the full range of supervisory duties.

• Employees in this job may participate in the performance of subordinates’ work consistent with operational or organizational requirements.

ENTRY LEVEL KNOWLEDGES, SKILLS, AND ABILITIES:

MINIMUM EXPERIENCE AND TRAINING: (NOTE: Based on the Entry Level Knowledges, Skills, and Abilities)

• One year as Chief, Insurance Field Investigations and Enforcement (commonwealth title);

or

• Two years as an Insurance Investigator Supervisor (commonwealth title);

or

• Six years of professional insurance investigation and regulation experience which includes two years of supervisory experience; and a bachelor's degree;

or

• An equivalent combination of experience and training which includes two years of supervisory experience.
