JOB TITLE: DIRECTOR, BUREAU OF SPECIAL FUNDS

DEFINITION: This is highly responsible managerial work directing the activities of the Workers’ Compensation Security Fund (WCSF), the Catastrophic Loss Benefits Continuation Fund (Auto CAT Fund), the Underground Storage Tank and Indemnification Fund (USTIF), and related programs in the Department of Insurance.

The employee in this job plans, directs, and coordinates the fee assessment, insurance claims, contract management, investment, regulatory, and legislative programs of the Bureau of Special Funds. Supervision is exercised over a staff of professional and clerical employees and contractors engaged in the development and collection of accurate fee assessments and the payment of claims from the WCSF, the Auto CAT Fund, the USTIF, and related programs to eligible claimants and service providers. The employee in this job also serves as the Executive Director of the gubernatorial and legislative appointed Underground Storage Tank Indemnification Board. The position of Executive Director oversees the implementation of board policy; oversees the development and promulgation of regulations; serves as an advocate between legislators, community groups, industry representatives, and other interested parties; and serves as the first level of review for disputed USTIF claims. The employee also serves as a voting member of the bureau’s Investment Committee, which is comprised of representatives from the Departments of Treasury and Insurance, for the purpose of ensuring the strategic allocation of the bureau’s multi-million dollar assets. Work is performed with considerable independence and is reviewed by the Deputy Insurance Commissioner for compliance through reports, conferences, and meetings.

• Directs, develops, plans, coordinates, and oversees all program activities within the Bureau of Special Funds.

• Develops, recommends, and reviews proposed legislation and regulations affecting the programs with the Bureau of Special Funds.

• Manages the fee assessment and claims programs in the Bureau of Special Funds.

• Oversees vendor negotiations and Request for Proposal development for USTIF Fee Billing System.

• Develops and implements USTIF Board policies.

• Serves as a liaison between the USTIF Board and the General Assembly, the Department of Environmental Protection, industry groups, other state agencies, and the public on USTIF related issues.

• Negotiates settlements for the WCSF by overseeing the auditing of claims and reserve documentation and negotiating with liquidators.

• Serves as a voting member of the Investment Committee and directs investment consultants engaged in the management of the Bureau of Special Funds assets.

• Serves in an adjudicatory capacity dealing with claim and collection disputes during administrative appeals concerning the USTIF.

• Directs the activities of outside legal counsel engaged by the department to defend insurance claims and to pursue legal action on behalf of the bureau’s funds.

• Manages the comprehensive contracts management program and directs the activities of third party administrators and vendors engaged by the WCSF and Auto CAT funds.

• Reviews and approves the work of independent actuaries to develop income and expense forecasts for the various funds.

• Develops, recommends, and reviews proposed special fund budgets.

• Prepares a comprehensive annual report for the Auto CAT Fund that is distributed to the legislature each year, as required by statute.

• Prepares comprehensive annual reports for each of the funds.

• Responds to legislative inquiries.

• Performs public speaking and makes presentations.

• Performs the full range of supervisory duties.

• The employee in this job may participate in the performance of subordinates’ work consistent with operational or organizational requirements.

• Performs other related work as required.

ENTRY LEVEL KNOWLEDGES, SKILLS, AND ABILITIES:

• Knowledge of insurance claims principles and practices with particular emphasis in catastrophic medical, workers’ compensation, and environmental claims.

• Knowledge of the principles and practices of financial management.

• Knowledge of regulations pertaining to the payment of insurance claims.

• Knowledge of negotiation principles and practices.

• Knowledge of investments in securities.

• Ability to interpret and apply commonwealth insurance laws and federal regulations related to the operation of special funds.

• Knowledge of the principles and practices of supervision.

• Ability to communicate effectively orally.

• Ability to communicate effectively in writing.

• Ability to establish and maintain effective working relationships.

MINIMUM EXPERIENCE AND TRAINING: (NOTE: Based on the Entry Level Knowledges, Skills, and Abilities):

• Eight years of management related experience in the field of insurance or environmental industry or in the investigation and payment of insurance claims, including four years of supervisory experience, and a bachelor’s degree in public administration, business administration, or engineering with an emphasis in the earth sciences;

or

• An equivalent combination of experience and training.
