EMPLOYMENT SECURITY AUDIT AND INVESTIGATION DIRECTOR

DEFINITION: This is administrative work directing a statewide program of fraud investigations and the audit and evaluation of all facets of job service, unemployment compensation, and employee tax operations programs and activities in the Department of Labor and Industry in order to develop and improve methods, procedures, and controls and to insure compliance with regulations.

The employee in this class is responsible for planning, implementing, directing, and evaluating a statewide program of investigations into suspected cases of fraud or abuse of agency programs and activities by agency employees, clients, claimants, or employers. Work also involves responsibility for planning and directing a statewide program of audits of records, methods, and procedures of field and central offices for accuracy, completeness, and validity to prevent fraud and collusion, ensure conformance with state and federal laws, rules, regulations, standards, and policies, and develop and improve methods, procedures, and controls relating to employment security programs. Work involves planning, developing, implementing, coordinating, and evaluating technical aspects of this Internal Audits Division and directing technical and clerical staff. Work is performed with latitude for the exercise of independent judgement with the guidelines of federal and state laws and Departmental policies, procedures, rules and regulations. Work is reviewed by the Director, Bureau of Financial Management, through conferences, reports, and overall effectiveness of programs.

EXAMPLES OF WORK: Directs investigative and supportive personnel in the conduct of investigative and related activities pertaining to suspected cases of fraud or abuse of unemployment compensation, employer tax operations, and job service programs and activities involving employees, employers, clients, and claimants of the agency.

Plans and supervises statewide operational aspects of the audit and investigative program, such as assigning cases to investigators and scheduling and directing the flow of work.

Plans, directs, and coordinates auditing activity to assure compliance with federal and state law, rules, and regulations in payment of benefits, collection of employer taxes, and the integrity of job service activities.

Meets with high level management officials to resolve difficult and sensitive issues or problems relating to audit findings, recommendations, and follow-up action, and assure the implementation of recommended methods, procedures, and controls relating to employment security services.

Provides documentation and recommendations for courses of action to be taken in cases involving employers, employees, claimants, applicants, and others.

Supervises the development, implementation, and evaluation of audit programs, procedures, guidelines, and manuals.

Supervises the monitoring and review of agency replies and the performance of follow-up action to audit reports.

Interprets federal and state laws, rules, regulations, policies, and standards for subordinates, management, and other interested parties.

Reviews court cases and decisions issued by quasi-judicial administrative boards and agencies which impact on agency programs and recommends courses of action to be followed.

Initiates corrective disciplinary action for misconduct by employees, and recommends major corrective disciplinary actions or dismissals.

Receives grievances or complaints, conducts initial investigation into cases and conditions, discusses with employee, and resolves or recommends resolution to grievance or complaint.

Prepares and signs employee performance evaluation reports.

Plans, supervises, and participates in training activities.

Reviews complaints received of possible violations and determines the type of investigation to be conducted.

Performs related duties as required.

REQUIRED KNOWLEDGES, SKILLS, AND ABILITIES: Knowledge of the principals, methods, and techniques of fraud investigation and law enforcement.

Knowledge of the basic rules of evidence.

Knowledge of the policies and appropriate statues, court decisions, interpretations and administrative procedures and rulings pertaining to Pennsylvania unemployment compensation, employer tax operations, and job service programs.

Knowledge of basic electronic data processing procedures and internal controls.

Knowledge of the concepts, methods, and techniques involved in modern management practices.

Knowledge of the principles and practices of employee supervision.

Knowledge of principals and techniques of administrative review in examining and evaluating programs in the Department of Labor and Industry.

Knowledge of the functions and objectives of Pennsylvania job service, unemployment compensation, and employer tax operations programs.

Ability to read and understand basic ledgers, journals, and financial statements, including those produced electronically.

Ability to interpret and apply the taxing and benefit payment provisions of the Pennsylvania unemployment compensation law.

Ability to follow a basic audit trail through the use of an employer's books and records, including basic computerized accounting systems.

Ability to analyze operations and policies and make recommendations for improvement.

Ability to plan, organize, and assign work to subordinates.

Ability to evaluate employee performance and prepare employee Performance Evaluation Reports.

Ability to read and interpret collective bargaining contracts applicable to the work performed by the unit.

Ability to establish and maintain effective working relationships with agency executives, program directors, associates, subordinates, and representatives of entities subject to Commonwealth examination and other governmental jurisdictions.

Ability to understand and follow complex oral and written instructions, laws, and regulations.

MINIMUM EXPERIENCE AND TRAINING: One year of experience as an Employment Security Audit and Investigation Supervisor;

Four years of experience in the administrative review and evaluation of Pennsylvania unemployment compensation, employer tax operations, and job service programs, including or supplemented by one year of investigative public contact experience in developing and presenting evidence, and including or supplemented by one year of supervisory experience;

Any equivalent combination of experience and training.
