STATE MONITOR ADVOCATE, L&I

DEFINITION: This is highly responsible administrative work in administering the statewide Migrant and Seasonal Farm Worker (MSFW) program for the Commonwealth.

The employee in this job serves as the federally mandated State MSFW Monitor Advocate. Work involves coordinating the delivery of employment, advocacy, and other support services across agency and governmental lines for the migrant and seasonal farm worker community in accordance with the Workforce Investment Act; developing policies and procedures associated with the MSFW program; ensuring that the state MSFW program is in compliance with all applicable laws and regulations; and representing the Commonwealth at the national level for MSFW issues. Work is conducted collaboratively on various initiatives with agency employees, partnering agencies, external stakeholders, the US Department of Labor, and MSFW Monitor Advocates from other states to develop policies and procedures for provision of services, outreach, data collection, disclosure of data, and processing of violations. Work is assigned in the form of project objectives and expected outcomes and is reviewed by the Secretary or Deputy Secretary through written reports, conferences, and an evaluation of overall results.

EXAMPLES OF WORK: Conducts an ongoing review of the delivery of services and protections afforded by Job Services laws and regulations to MSFWs by the state agency and local offices.

Advises the state agency and local offices of problems, deficiencies, or improper practices in the delivery of services and protections, including progress made in achieving affirmative action goals and timetables, and means to improve such delivery.

Participates in onsite local office MSFW formal monitoring reviews.

Assures that all significant MSFW local offices not reviewed onsite by federal staff are reviewed at least once a year by state staff using appropriate federal guidelines.

Develops and recommends changes to the state agency’s outreach plan.

Reviews the daily logs prepared by outreach workers to ensure compliance with the outreach plan.

Meets with local office managers and staff to discuss the findings of the annual reviews and to offer recommendations for improvement and technical assistance.

Prepares reports and recommendations for review by the Secretary and other executive staff.

Reviews the local office managers’ informal resolution of complaints relating to MSFWs and ensures that the state agency transmits copies of the logs of MSFW complaints to federal regional offices on a quarterly basis.

Advocates for improved services to MSFWs.

Meets with organizations serving farmworkers, employers, and employer organizations to receive complaints, assist in referrals of alleged violations to enforcement agencies, receive input on improving coordination with Job Services or improving services provided to MSFWs.

Conducts frequent field visits to the working and living areas of MSFWs to discuss the availability employment-related programs with MSFWs, crew leaders, and employers.

Participates in regional public meetings held by the US Department of Labor, Regional Farm Labor Coordinated Enforcement Committee.

Reviews and assesses the adequacy of the annual affirmative action plan for MSFWs, and reports the findings to the Secretary.

Performs the full range of supervisory duties.

Participates in the performance of subordinates’ work consistent with operational or organizational requirements.

Performs related work as required.

REQUIRED KNOWLEDGES, SKILLS, AND ABILITIES: Knowledge of laws and regulations regarding the provision of employment services to MSFWs.

Knowledge of various organizations serving farmworkers, employing farmworkers, and representing employers who hire farmworkers.

Knowledge of research principles and practices.

Knowledge of the principles and practices of policy planning, evaluation, and development.

Ability to analyze and interpret statistical data presented in the form of graphs, tables, and charts.

Ability to communicate effectively orally.

Ability to communicate effectively in writing.

Ability to develop and maintain effective working relationships.

MINIMUM EXPERIENCE AND TRAINING: Three years of professional experience planning, developing, and implementing programs and services for migrant seasonal farm workers; and a bachelor's degree;

An equivalent combination of experience and training.
