ATTORNEY EXAMINER, PLCB

DEFINITION:

This is professional legal work conducting formal hearings for the Pennsylvania Liquor Control Board (PLCB) and providing decisions relative to liquor licensing and employee benefit issues in accordance with the applicable provisions of the Pennsylvania Liquor Code and other rules, regulations, and policies and procedures. Employees work within established precedents, procedures, and regulations and receive general supervision from the Office of Chief Counsel who reviews the work through appeal procedures, conferences, and reports.

EXAMPLES OF WORK:

Conducts administrative fact finding hearings for the Pennsylvania Liquor Control Board on licensing matters, supersedeas (Act 1987-14), including but not limited to new licenses, license transfers, transfers of control by licensees, license renewals, and divestitures.

Conducts Liquor Control Board hearings on Heart and Lung Benefit Act appeals.

Administers oaths; hears testimony from all parties; and examines evidence presented.

Determines relevancy and admissibility of testimony of witnesses and other evidence.

Exercises controls necessary for an orderly hearing process.

Consults with the Office of Chief Counsel to answer legal questions relative to the hearing process.

Prepares hearing summaries including proposed findings of fact and conclusions of law, and records rationale for decisions.

Researches existing policies, procedures, rules and regulations, administrative decisions, legal precedent, and prior court decisions pertaining to matters heard.

Conducts administrative fact finding hearings for other Commonwealth agencies on various issues at the direction of the Chief Counsel; and prepares summaries of hearings and rationale for decisions.

Performs related work as required.

REQUIRED KNOWLEDGES, SKILLS, AND ABILITIES:

Knowledge of the applicable laws, precedents, and rules utilized by the Liquor Control Board relative to liquor licensing and Heart and Lung appeals.

Knowledge of judicial procedures, legal documentation, and rules of evidence.

Ability to understand and interpret constitutional provisions, statutes, administrative regulations, and precedents.

Ability to analyze facts, evidence, and precedents, and arrive at a logical interpretation.

Ability to set forth findings of facts and decisions clearly and concisely in oral and written form.

Ability to establish and maintain effective working relationships with associates, other governmental regulatory agencies, and interested parties and groups.

MINIMUM EXPERIENCE AND TRAINING REQUIREMENTS:

Three years of experience in legal work, including at least one year in trial work; and such training as may have been gained through graduation from an approved school of law;

NECESSARY SPECIAL REQUIREMENT:

Possession of a certificate of admission to the Bar of the Supreme Court of Pennsylvania.
