PENNSYLVANIA LABOR RELATIONS BOARD ATTORNEY EXAMINER 3

DEFINITION:

This is advanced professional legal work in the conduct of hearings and the preparation and issuance of decisions on cases filed with the Pennsylvania Labor Relations Board.

Employees in this class conduct hearings and issue decisions arising in unfair labor practice charges and in petitions for representation, decertification, and unit clarification pursuant to the Labor Relations Act, the Public Employee Relations Act, and Act 111 of 1968. Work includes the preparation and issuance of orders granting or denying relief. Work is differentiated from the next lower level by the complexity and difficulty of the issues presented which frequently lack clear precedent or cases on-point and by the contentious nature of the parties involved. Employees participate in the training and orientation of new professional staff, by reviewing work and providing consultation. Work is performed independently in accordance with the laws, policies, rules and regulations of the Pennsylvania Labor Relations Board and related case law with review by the Board on appeal from attorney examiner decisions and by the Chief Counsel for effectiveness in managing a complex and diversified caseload.

EXAMPLES OF WORK:

Conducts hearings frequently involving contentious parties on complex issues arising in unfair labor practice charges and in petitions for representation, decertification, and unit clarification, pursuant to the Pennsylvania Labor Relations Act, the Public Employee Relations Act, and Act 111 of 1968.

Prepares and issues orders after hearing containing findings of fact, discussion, conclusions of law and order granting or denying relief.

Researches pertinent Pennsylvania and federal statutes and cases to prepare for hearings and after hearings to resolve issues raised.

Reviews briefs and pleadings filed by parties.

Contacts parties and their representatives by telephone or in pre-hearing conferences to discuss and attempt to resolve cases.

Provides consultation and direction to junior examiners.

Performs related work as required.

REQUIRED KNOWLEDGES, SKILLS, AND ABILITIES:

Knowledge of the laws, rules, regulations, policies, and procedures under the jurisdiction of the Pennsylvania Labor Relations Board.

Knowledge of the application of legal principles to individual cases or problems.

Knowledge of judicial procedures and rules of evidence.

Knowledge of the principles and practices of legal research.

Knowledge of the principles and procedures involved in the conduct of hearings and issuance of authoritative decisions.

Ability to manage hearings involving contentious parties and complex issues, utilizing the rules of evidence and apply Board procedures to assure parties have a fair opportunity to present their case.

Ability to interpret and apply the laws, rules, and regulations under the jurisdiction of the Pennsylvania Labor Relations Board.

Ability to critically analyze testimony, evidence, and legal and administrative documents and issue fair and authoritative decisions.

Ability to perform legal research.

Ability to express ideas clearly and concisely both orally and in writing.

Ability to establish and maintain effective working relationships with associates, parties who appear before the Board and the public.

Ability to provide meaningful consultation to lower level attorney examiners regarding their work.

MINIMUM EXPERIENCE AND TRAINING:

One year of experience as a Pennsylvania Labor Relations Board Attorney Examiner 2;

                                                                                                                                      or

Three years of professional legal work, including one year of experience in the practice of labor law or adjudicating labor disputes; and graduation from an approved school of law;

                                                                                                                                     or

Any equivalent combination of experience and training.

NECESSARY SPECIAL REQUIREMENT:

Possession of a certificate of admission to the Bar of the Supreme Court of Pennsylvania.
