LABOR MEDIATION DIRECTOR

This is responsible administrative and professional work in directing the activities of the state mediation service.

The employee in this class is responsible for planning, directing, and coordinating all state mediation and conciliation activities in public and private labor-management relations. Work involves developing and implementing administrative procedures and policies, within the scope of existing laws and authority. Responsibilities include administering the day to day operations of the mediation staff and consulting with and advising regional directors on negotiations in difficult and long-standing disputes. Work also includes direct participation in mediation of highly sensitive disputes involving the threat of a breakdown of essential public services or a prolonged work stoppage in the private sector. Additionally, the incumbent is responsible for designing and implementing educational and training programs for the mediators sot they remain current on the latest and most effective techniques in dispute mediation and facilitation of labor management cooperative programs. Supervision is exercised over a professional and clerical staff. Work is performed under the administrative direction of the Deputy Secretary for Labor and Management Relations and is subject to review through evaluation of program results.

EXAMPLES OF WORK: Plans, organizes, and directs the state mediation service; formulates administrative policies and procedures; develops methods and rules for the guidance of mediators.

Evaluates performance of staff through review of reports, personal observation, or conferences and takes or recommends appropriate action.

Studies and analyzes dispute notices filed with the Bureau of Mediation for use in administrative planning.

Services and participates in mediation activities involving a high degree of responsibility or complexity.

Maintains daily liaison with the Pennsylvania Labor Relations Board in the administration of the Public Employee Relations Act.

Cooperates and develops working agreements with the federal Mediation and Conciliation Services and other public and private agencies in regard to adjustment of labor disputes and related activities.

Develops proposals for legislation concerning conciliation, mediation, and related activities and submits such proposals to the secretary of Labor and Industry.

Compiles and maintains lists of available arbitrators and arranges for boards of arbitration when needed.

Establishes and maintains the goodwill and confidence of labor, industry, governmental agencies, and the public.

Advises the Governor and the Secretary of Labor and Industry on the administration of the Public Utility Disputes Act.

Designs and implements educational and training programs for all mediators.

Serves as State contact with the Federal Mediation and Conciliation Service (FMCS) under the memorandum of understanding which established a partnership between Labor and Industry and FMCS in providing facilitation services.

Employees in this class may participate in the performance of their subordinates work consistent with operational or organizational requirements.

Performs related work as required.

REQUIRED KNOWLEDGES, SKILLS, AND ABILITIES: Knowledge of the principles and techniques of conciliation, mediation, and other methods used in facilitating the settlement of labor management controversies.

Knowledge of labor organization, manufacturing and business practices and procedures, industrial personnel and labor problems and collective bargaining practices.

Knowledge of applicable state and Federal labor laws.

Knowledge of the principles and techniques of labor-management cooperative programs and facilitation techniques to establish successful labor-management cooperative programs.

Ability to plan, coordinate, evaluate, and direct the work of professional and clerical subordinates in the administration of a government program.

Ability to gain the confidence and cooperation of the parties to a dispute.

Ability to participate and assist in governmental and industrial negotiations and controversies in a tactful and impartial manner.

Ability to express ideas clearly and concisely, orally and in writing.

MINIMUM EXPERIENCE AND TRAINING: Ten years of progressively responsible experience in the field of labor-management relations or mediation services with emphasis on the mediation of a wide variety of public or private disputes, including four years in an administrative or supervisory capacity; and a bachelor's degree with major course work in labor-management relations, industrial management, or personnel administration;
