REGULATORY ENFORCEMENT INSPECTOR

DEFINITION: This is responsible field inspection work in conducting inspections to determine compliance with the laws, rules and regulations governing various professions, occupations, commissioners, and registrants regulated by and under the jurisdiction of the Secretary of the Commonwealth.

Employees in this class travel to various sites in a geographic area of the state to conduct inspections of businesses, health care practices and other entities through observation, interviews, fact gathering,  reviewing documents, collecting samples and conducting tests of substances. Inspectors also perform limited investigative support activities such as obtaining evidentiary records, executing service of legal documents, and posing as a consumer in support of undercover investigations. Work involves preparing reports of inspections to document compliance or deviation from established standards. Inspectors are required to issue citations for violations in accordance with the Act 48 Citation Program and other applicable Acts as required. An employee may be required to testify at formal and informal hearings and appear as a witness for the State in formal judicial proceedings. Typically, work in this class is performed independently in accordance with departmental standards and procedures and under the direction of a Regional Director who reviews all inspection reports.

EXAMPLES OF WORK: Conducts physical inspections of locations of businesses and professional practices for possession and proper display of licensure documents, current renewals, possession of required equipment, materials, devices, reference books, etc., and adherence to the laws, rules and regulations governing various professions, occupations, commissioners, and registrants regulated by the Secretary of the Commonwealth.

Travels to various sites in a geographic area of the state to conduct inspections by observation, interviews, and fact gathering, noting any deviation from established standards.

Assists Professional Conduct Investigators as directed by providing limited investigative support activities such as obtaining evidentiary records such as courthouse documents, executing service of legal documents, and posing as a consumer in support of undercover investigations.

Conducts new license, routine, follow-up, and other inspections as directed.

Prepares reports to communicate findings resulting from inspections.

Issues citations, in accordance with the Act 48 Citation Program, when violations are found in accordance with the appropriate Act(s).

Collects samples and/or conducts tests, utilizing test kits, of suspected prohibited substances and chemicals that may be used by occupational and professional licensees and others regulated by the licensing acts.

Testifies at formal and informal administrative hearings and appears as a witness for the State in formal judicial proceedings.

Reads, interprets and applies all current, revised or new applicable laws, rules, and regulations of the appropriate Boards, Commissions, Bureaus, and Departments.

Attends training sessions to maintain and expand required knowledge and skills.

Discusses projected tasks, travel and inspection schedules, problems and status of assignments with the supervisor as required.

Performs related duties as required and directed.

REQUIRED KNOWLEDGES, SKILLS, AND ABILITIES: Knowledge of inspection methods including techniques of observation, interviewing, fact gathering, and comparing findings to established standards.

Ability to travel to various sites in the state.

Ability to obtain evidentiary records, execute service of legal documents, and pose as a consumer in support of undercover investigations.

Ability to plan and conduct inspections through observation, interviewing, fact gathering, and comparing findings to established standards.

Ability to write clear, concise reports in accordance with established policy.

Ability to issue citations, in accordance with the Act 48 Citation Program, when violations are found in accordance with the appropriate Act(s).

Ability to collect samples and/or conduct tests, utilizing test kits, of suspected prohibited substances and chemicals potentially used by occupational and professional licensees and others regulated by the licensing acts.

Ability to testify at formal and informal hearings and appear as a witness for the State in formal judicial proceedings.

Ability to read, understand, and apply all the applicable inspection laws, rules, and regulations of the appropriate Boards, Commissions, Bureaus, and Departments.

Ability to communicate effectively and maintain cooperative relationships with the public and co-workers.

Ability to operate general office equipment.

MINIMUM EXPERIENCE AND TRAINING REQUIREMENTS: Three years of experience involving interpersonal public contact and inspecting for compliance with rules and regulations and reporting related facts.

An Associate's Degree and one year of experience involving interpersonal public contact and inspecting for compliance with rules and regulations and reporting related facts.

Any equivalent combination of experience and training which included one year of experience involving interpersonal public contact and inspecting for compliance with rules and regulations and reporting related facts.
