DIRECTOR OF LABOR LAW COMPLIANCE

DEFINITION: This is administrative work in directing enforcement and promoting compliance with the state labor laws and associated regulations in the Department of Labor and Industry.

The employee in this class is responsible for planning, coordinating, and directing a statewide program of enforcing and securing compliance with a variety of state laws governing child-labor, working conditions, minimum wages, prevailing wages, apprenticeship systems and agreements and associated training activities, and other standards governing the Pennsylvania labor force in the interest of the health and economic viability of all employees and employers of the Commonwealth. Work involves developing and implementing policies and procedures for statewide investigative and enforcement activities essential to securing compliance with the above laws. Work also involves coordinating agency functions with those of other governmental agencies at various levels, directing compilation of data and providing information to employers, employees, and the general public concerning these laws, and performing management functions essential to administration of the agency program. Work includes consulting with federal referral sources, labor and management representatives and awarding authorities, and making recommendations concerning proposals for new or revised state laws, regulations, and training programs. General direction is exercised over a central office and field staff of administrative, investigative, and clerical employees. Work is performed within the broad framework of existing laws, regulations, and policies, and is subject to general review by the Deputy Secretary for Safety and Standards through conferences and evaluation of reports.

EXAMPLES OF WORK: Develops and implements policies and procedures to administer a statewide program of investigation, enforcement, and public information to secure compliance with state laws governing child labor, minimum wages, prevailing wages, industrial homework, wage payment and collection, equal pay, medical payment, apprenticeship and training and other standards governing the labor force.

Directs the overall operations in central office and district offices throughout the state.

Supervises staff by assigning work, reviewing work performance, preparing and signing employ Performance Evaluation Reports, receiving grievances and complaints and resolving or recommending solutions, approving or disapproving leave requests, and insuring the development of staff.

Plans and directs research projects in compiling data on working conditions, wages, and other matters related to labor standards.

Promotes and aids in the development of the State Registered Apprenticeship and Training System through the voluntary cooperation of labor and management; reviews and registers all Apprenticeship agreements and upon satisfactory completion of both on-the-job training and related instructions issues Certificate of Completion to the new Journeypersons.

Coordinates activities and establishes and maintains working relationships with federal referral sources, labor, management, awarding authorities, and other private and public agencies and levels of government in areas of mutual concern.

Coordinates the enforcement of labor laws to maintain consistent, equitable and reasonable standards of investigation and prosecution.

Reviews, evaluates, and participates in drafting proposed new or revised laws and regulations; compiles and justifies annual budget requests and administers approved allocations; and devises and implements changes designed to improve organizational structures, methods, and procedures of the agency.

Plans and directs a program of public information, including production of a variety of publications, to promote understanding and support of standards related to labor laws and compliance with regulations governing these matters.

Prepares and delivers speeches throughout the Commonwealth; composes correspondence; and engages in similar activities in publicizing and interpreting state laws, regulations, and any other matters related to labor, wage and apprenticeship standards.

Employees in this class may participate in the performance of their subordinates work consistent with operational or organizational requirements.

Performs related work as required.

REQUIRED KNOWLEDGES, SKILLS, AND ABILITIES: Knowledge of the laws, regulations, policies, and inter-related activities of other agencies and levels of government concerned with labor, wage, and apprenticeship standards enforcement.

Knowledge of management principles and practices applicable in directing the state labor law program.

Knowledge of the principles and practices of public administration.

Skill in public speaking and in promoting and interpreting the agency program to interested groups and the general public.

Ability to learn to plan, direct, and evaluate the state labor laws programs.

Ability to direct and supervise a staff of administrative, investigative, and clerical employees.

Ability to plan, organize, and assign work to subordinates.

Ability to evaluate employee performance and prepare employee Performance Evaluation Reports.

Ability to read and learn to interpret and apply collective bargaining contracts applicable to the work performed by the unit.

Ability to consult, evaluate, draft, and otherwise participate in preparing and revising legislation and regulations to insure effective operation of the state labor laws program.

Ability to establish and maintain effective working relationships with supervisors, subordinates, associates, governmental and non-governmental officials, and the public.

Ability to speak and write clearly and concisely.

MINIMUM EXPERIENCE AND TRAINING: Six years of administrative experience, including two years of supervisory work in the field of labor law enforcement, and a bachelor's degree;
