DIRECTOR. BUREAU OF ENFORCEMENT AND INVESTIGATION
 
DEFINITION: This is professional managerial work directing the statewide program of investigations and inspections in the Department of State.
 
The employee in this job is responsible for planning and directing all phases of the operation of the Bureau of Enforcement and Investigation through a network of regional offices. Work involves ensuring compliance with the standards of conduct. laws. rules. and regulations of the various professions, occupations. businesses, commissions, activities, and entities regulated under the jurisdiction of the Secretary of the Commonwealth. Work involves establishing and administering policies and procedures: ensuring efficient flow of work assignments and documents to and from the Department's Legal Office, Bureau of Enforcement and Investigation central office, regional offices, and other bureaus and offices; participating in the development of or revisions to new and existing laws. rules, and regulations: participating directly in policy decisions relative to the expansion of enforcement and investigative functions within the Department; developing and making policy decisions regarding enforcement and investigation in program areas; implementing policy changes and recommending statutory and regulatory changes: and supervising the Bureau of Enforcement and Investigation regional directors and deputy director. Work also involves managing the Charging Unit triage function for Professional and Occupational Affairs discipline cases. Work includes travel to conduct extremely sensitive or complex investigations, representing the Bureau in meetings, hearings. and public forums. and working with investigators for the purpose of instruction or to assist with complex cases. Work is performed independently and is reviewed by the Deputy Secretary for Regulatory Programs through conferences and review of written reports.
 
EXAMPLES OF WORK: Plans, organizes. and directs the operation of the Bureau of Enforcement and Investigation.
 
Monitors progress of investigations and provides guidance and assistance, and reviews reports from Investigators and Regional Directors for completeness and required infonnation.
 
Monitors cases for progress and content and assures changes in the  investigative process  to facilitate prompt disposition and increased case quality.
 
Manages a systematic triage function for Professional and Occupational Affairs discipline cases and approves the recommended triage outcomes of the Charging Unit attorneys.
 
Develops or recommends changes to legislation. laws, rules. regulations, policies. and procedures relative to the Bureau of Enforcement and Investigation and effected program areas based upon information and data obtained from the operation of the Bureau. statutory and regulatory changes. operational requirements., and other influences.
 
Recommends and coordinates changes in the computer tracking system with the Bureau of Management lnformation Systems. Develops and presents Bureau budget proposals and projections for budgetary and slaffing requirements based upon operational requirements. 
 
Interprets rules, regulations, policies, procedures, programs, and objectives of the organization to Bureau staff. 
 
Compiles reports for the Deputy Secretary for Regulatory Programs and the Secretary of the Commonwealth on activities of the Bureau of Enforcement and Investigation and supplies other information, as requested. Assists Regional Directors in an instructional capacity and assists with complex or unusual cases. 
 
Establishes and maintains effective working relationships with the Department's Legal Office, bureaus, and support offices. 
 
Represents the Bureau in meetings. hearings, and public forums. Testifies at formal and informal board hearings and appears as a witness for the Commonwealth in formal judicial proceedings. 
 
Conducts special investigations at the request of the Secretary of the Commonwealth.
 
Travels to and from work sites, as necessary.
 
Employees in this job may participate in the performance of their subordinates work consistent with operational or organizational requirements. Performs the full range of supervisory duties.
 
Performs related duties as required.
 
REQUIRED KNOWLEDGES, SKILLS, AND ABILITIES: Knowledge of the methods and techniques of investigation. Knowledge of investigative interviewing practices and techniques. Knowledge of legal procedures involved in investigating, including rules of evidence. discovery, and subpoena. Knowledge of the general legal principles of entrapment and civil liberties.
 

Knowledge of the principles and procedures involved in testimony at formal and informal hearings.

Knowledge of the principles and practices of public administration. Knowledge of office management methods.

Knowledge of the principles and practices of employee supervision. Ability to analyze infonnation resulting from investigations.

Ability to analyze and interpret pertinent provisions of laws. rules. and administrative regulations.

Ability to evaluate the efficiency and effectiveness of administrative procedures and operations.

Ability to establish and maintain effective working relationships. Ability to communicate effectively orally.

Ability to communicate effectively in writing.

MINIMUM EXPERIENCE AND TRAINING: Two years of experience as a Regional Director, Bureau of Enforcement and Investigation;

Twelve years of investigative experience involving the development and presentation of evidence regarding violations or alleged violations of rules and regulations. including two years of experience directing an enforcement related function;

Eight years of investigative experience involving the development and presentation of evidence regarding violations or alleged violations of rules and regulations. including two years of experience directing an enforcement related function and a bachelor's degree:
