DEFINITION: This is complex technical regulatory review and inspection work ensuring compliance with the Pennsylvania Liquor Code and related laws and regulations.

An employee in this job is responsible for independently conducting regulatory reviews and inspection work within the prescribed provisions and standards of the PA Liquor Code and Act 1987-14 for an assigned geographic area. Work involves inspecting establishments for conformance with the PA Liquor Code and local regulatory requirements; reviewing, researching, and verifying information regarding applicants and their business operations; tracing financial transactions, records, assets, and lease of sales agreements to determine the source of funds; reviewing and analyzing private and public records of licensees to ensure no adverse interests are involved; conducting criminal background checks on applicants; and informing applicants and their attorneys on PA Liquor Code requirements and the Board’s application process. Employees prepare reports of findings and determine whether applications for new liquor licenses, license renewals, or revised status of current licensees of the Board meet the minimum qualifications as identified by law. Work may also involve testifying at administrative hearings or court proceedings. Work at this level is differentiated from the LCB Licensing Analyst 1 by the performance of complex reviews such as new licenses, double transfers, person to person transfers, and place to place transfers. Employees in this job may perform lead work or train lower level Licensing Analysts. Work is assigned by an LCB Licensing Analyst Supervisor through written and oral instructions and reviewed through inspection reports and conferences.

EXAMPLES OF WORK: Conducts complex regulatory reviews and inspections to determine applicant compliance with the PA Liquor Code and Act 1987-14.

Prepares reports of facts and findings for submission to Central Office.

Reviews financial records and legal documents to determine the source of applicants’ assets and funding, legitimacy of operation, and any illegal activity.

Examines applicant's assets and liabilities to include property value, bank accounts, and other investments, as well as loans or debts to determine the source of funds.

Conducts on-site inspections and prepares detailed reports of licensed and proposed premises to determine if the regulations of the PLCB, and liquor code mandates are met.

Informs applicants and their attorneys of the Board’s application process and the Liquor Code’s requirements.

Reads blueprints and sketch drawings of applicants’ premises to verify room dimensions.

Prepares appropriate general complaint report for submission to the Bureau of Liquor Control Enforcement, Pennsylvania State Police if a code violation is expected.

Evaluates lease or sales agreements for restrictions on property ownership and authenticity of information.

Reviews the prior history of the proposed establishment to determine what impact it will have on the health and welfare of the neighborhood.

Determines the existence of any open complaints or pending liquor code violations or citations.

Trains and instructs lower level staff in the proper procedures and methods of licensing inspections.

Reviews records of liquor sales figures, purchase invoices, payroll records and State Sales Tax ledgers or returns.

Examines and verifies information contained in charters of non-profit clubs, as well as the membership rules, by-laws, fees and dues requirements, in addition to the financial records of the clubs.

Conducts character and background checks of applicants, managers, and corporate managers for evidence of criminal history.

Examines and verifies official records relating to federal bankruptcy proceedings of an applicant.

Conducts reviews and inspections as assigned by the Board.

Retrieves funds for the Board from licensees when checks are returned from the bank for insufficient funds.

Travels to places of public record and applicants’ premises to gather required information for inclusion in inspection reports.

Testifies in administrative hearings and court proceedings.

Performs other related duties.

REQUIRED KNOWLEDGES, SKILLS, AND ABILITIES: Knowledge of the PA Liquor Code, and other pertinent state and federal laws, rules and regulations.

Knowledge of building inspection and review techniques used in determining compliance with the PA Liquor Code.

Knowledge of financial inspection and review techniques used in determining compliance with the PA Liquor Code.

Knowledge of interviewing procedures and techniques.

Knowledge of measuring methods and devices used for measuring distances and heights in and around buildings.

Knowledge of the principles of tracing the origin of an asset.

Ability to read and interpret the PA Liquor Code and other pertinent state and federal laws, rules, and regulations.

Ability to determine violations and non-compliance with the PA Liquor Code.

Ability to communicate effectively orally.

Ability to communicate effectively in writing.

Ability to establish and maintain effective working relationships.

MINIMUM EXPERIENCE AND TRAINING: One year as an LCB Licensing Analyst 1.
