LABOR AND CONTRACT COMPLIANCE AGENT
DEFINITION: This is technical investigative and administrative work in the enforcement of state and federal labor, safety, Disadvantaged and Women's Business Enterprise, and affirmative action laws and regulations governing contractors' and sub- contractors' performance on construction projects.
An employee in this class is responsible for performing independent assignments in the review and monitoring of Disadvantaged and Women's Business Enterprises' participation, payment of wages and related compensation, and the enforcement of job safety standards on construction projects in an Engineering District. Work usually entails attendance at pre-construction meetings to inform contractors of their state, Federal, and Departmental obligations and the monitoring of those obligations to assure compliance through the conduct of employee interviews, consultations with local unions, performance of on-site reviews, and the review and evaluation of information submitted by contractors and project inspectors. Duties also include face-to-face contacts with contractors on issues requiring interpretation and assisting in the investigation and resolution of complaints and corrections of deficiencies. During off-peak times for construction projects, this position conducts training for District construction personnel regarding changes in labor, safety, DBE/WBE, and EEO compliance laws. Employees function with considerable independence under the general direction of a higher-level Departmental employee with operational guidance being provided by the Bureaus of Equal Opportunity and Construction and Materials. Assignments are on-going and reviewed through reports and overall compliance results.
EXAMPLES OF WORK: Develops, organizes, and implements a labor and construction contractor compliance program within an Engineering District.
Attends pre-construction meetings to inform contractors of Federal, state, and departmental regulations concerning the payment of wages and related compensation.
Reviews wage rates and classifications submitted by contractors prior to construction to assure proper job classifications, wage rates and benefits for contractor employees are included in the contract proposal and are in accordance with appropriate labor regulations and prevailing local labor practice.
Maintains contact with local unions to determine rates currently in effect for trades positions.
Recommends wage rates or classifications where none exist.
Reviews contractors' payrolls and results of spot-check interviews in order to determine whether or not employees are being utilized properly and are being paid the prevailing wage.
Investigates and provides for resolutions to employee complaints on inappropriate compensation and prepares reports on wage compliance or non-compliance.
Monitors compliance of job safety standards on a regular basis.
Investigates reports of insufficient construction project safety measures and coordinates the resolution or correction of any deficiencies.
Develops a monitoring system to track Disadvantaged and Women's Business Enterprise participation and to verify contractor data throughout the life of a Federally funded construction contract in order to meet Federal requirements.
Reviews and monitors Training Programs for Trainees on Federal-Aid Construction Projects in conjunction with the Bureau of Equal Opportunity.
Provides information upon requests to Disadvantaged and Female contractors regarding necessary pre-qualification and bidding requirements.
Recommends action to be taken against prime contractors not in compliance with Equal Employment Opportunity, labor, DBE/WBE and uniform project safety requirements.
Performs related work as required.
REQUIRED KNOWLEDGES, SKILLS, AND ABILITIES: Knowledge of the state labor laws regulating wages, benefits, and working conditions and of the basic philosophy underlining this legislation.
Knowledge of the basic civil rights terminology, the purpose of Federal and state contract compliance laws and regulations, as well as the Federal financial assistance regulations.
Knowledge of the basic responsibilities of the labor, safety, and contract compliance officer relative to the compliance regulations.
Knowledge of Section 1926 of the Occupational Safety Health Act.
Knowledge of basic procedures governing regulation of the DBE/WBE program.
Ability to read, comprehend, interpret, and apply Federal and state laws, regulations and policies.
Ability to establish and maintain effective working relationships with contractors, project inspectors and employees.
Ability to conduct meetings and conferences with contractors or their representatives.
Ability to read, comprehend, and interpret basic statistics such as percentages, ratios, averages and related measures.
Ability to ascertain facts through personal interviews, observation, and examination of records.
MINIMUM EXPERIENCE AND TRAINING: Two years of experience as a Transportation Construction Inspector 2 performing project documentation or contract compliance related duties.

Two years of technical contract compliance or affirmative action work which involved the monitoring of a compliance program. An Associate's Degree in approved fields may be substituted for one year of experience.
