Definition: This is supervisory or advanced journeyman level legal clerical work in reviewing and analyzing applications, reports, recommendations, rulings, or decisions of agency personnel for possible legal implications.
An employee in this class is responsible for supervising a section of lower level Legal Assistants engaged in reviewing and analyzing applications, reports, recommendations, rulings, or decisions of agency personnel for possible inconsistencies with the laws or regulations governing a specific regulatory program for reviewing the more complicated and complex cases. Work involves oral or written contact with field personnel, attorneys, licensees, or the general public to gather additional information, clarify important points concerning the case, or explain the accepted meaning of a particular part of the law. Work may involve supervising and training a group of subordinate Legal Assistants by explaining policy, procedures, and complicated or new sections of the law, and reviewing their work upon completion. Work may include preparing summaries of the pertinent aspects of very complex cases to be used in making administrative rulings. Supervision is received from an administrative superior through conferences and an evaluation of results.
Examples of Work: Reviews and analyzes applications, reports, recommendations, rulings, or decisions of agency personnel for possible inconsistencies with the laws or regulations governing a specific regulatory program.
Prepares summaries of the pertinent aspects of the more complex cases to be used in making administrative rulings.
Reviews files in order to list violations in order of importance, dates of occurrence, or similar information.
Contacts field personnel to gather additional information or clarify important points concerning a case.
Advises attorneys, court officials, real estate brokers, and other interested persons on general policies and practices of the assigned department in regard to claims, collections, or other legal consequences or recourses.
Changes the recommendations of field personnel that do not conform precisely with prescribed laws or regulations or where judgment or interpretation is in question.
Notifies supervisor of important discrepancies which may affect the final outcome of a case.
Reviews and compiles files of pertinent documents for use at board hearings.
Maintains a workable reference file on board and court precedents; assists in drafting decisions for referees or investigators during periods of heavy backlog.
Supervises and reviews the work of a group of subordinate Legal Assistants involved in the review and analysis of applications, reports, recommendations, rulings, or decisions of field personnel for possible inconsistencies with the laws or regulations governing a specific regulatory program.
Trains and advises subordinate Legal Assistants in the review and analysis of cases and in the laws and regulations governing a specific regulatory function.
Supervises the preparation of various reports and summaries prepared by subordinate Legal Assistants.
Performs related work as required.
Required Knowledges, Skills, and Abilities: Considerable knowledge of pertinent or precedent setting cases.
Considerable knowledge of business English.
Knowledge of modern office methods, procedures, and equipment.
Ability to review and analyze and to supervise the review and analysis of applications, reports, recommendations, rulings, or decisions of field personnel to determine possible inconsistencies with the laws or regulations governing a specific regulatory program.
Ability to apply pertinent laws, rules, and regulations.
Ability to comprehend and interpret legal documents and to perform legal research.
Ability to prepare and to supervise the preparation of case summaries including all pertinent information.
Ability to train and supervise subordinates.
Ability to express complex statutes, procedures, and ideas clearly and concisely, orally and in writing.
Ability to follow oral and written instructions.
Ability to establish and maintain effective working relationships with fellow employees and the general public.
Minimum Experience and Training: One year as a Legal Assistant II;
or
Five years of progressively responsible clerical, auditing, enforcement, or investigative experience, including two years of legal clerical experience, and graduation from high school; or any equivalent experience and training.
