Position Purpose: Describe the primary purpose of this position and how it contributes to the organization’s objectives. Example: Provides clerical and office support within the Division to ensure its operations are conducted efficiently and effectively. This position is responsible for the assigned Intermediate Units (IUs) and any of the duties outlined in the description of duties. The administration, management and operation of the Compliance Monitoring and Planning Divisions will focus on the provision of advisory and consultative services to local education agencies and IUs in the planning, monitoring, improvement and evaluation of special education programs and services in the Commonwealth of Pennsylvania. Specifically, the divisions are charged with the following primary duties: (1) The management of a system for investigation of consumer complaints as required by federal regulations, (2) Conducting cyclical monitoring in local education agencies, (3) Review and approval of intermediate unit and school district special education plans to ensure that a full range of services are being provided for students with disabilities and (4) Management of other statewide functions and/or duties as designated. The Special Education Advisor within the Compliance Monitoring and Planning Divisions will serve as a single point of contact with their assigned IUs. Advisors may be asked to focus on any one of the duties outlined in the description of duties. |

Description of Duties: Describe in detail the duties and responsibilities assigned to this position. Descriptions should include the major end result of the task. Example: Types correspondence, reports, and other various documents from handwritten drafts for review and signature of the supervisor. 1. Serve as Chairperson of compliance monitoring visits to designated Local Education Agencies (LEAs) within assigned regions by conducting activities outlined in the compliance monitoring system manual. Negotiate, approve, and verify the implementation of corrective action plans resulting from any findings of non-compliance These include pre-monitoring arrangements, on-site activities, fiscal responsibility, preparation of preliminary reports, and review and approval of the final report. 2. Conduct fact finding, targeted and focus monitoring of LEAs which may include on-site activities, corrective actions and providing training and technical assistance. 3. Serve as liaison for assigned IUs by completing the following tasks: - Reviewing and recommending approval or disapproval of school district and intermediate unit special education plans and plan revisions. - Providing guidance and assistance in the interpretation of Federal and State Laws, Regulations, and Standards. - Conducting on-site facility reviews based on Chapter 14 state regulations. 4. Assist in the development and revision of statewide process and procedures for cyclical monitoring, complaint management, and plan review. 5. Follow up on restraints as reported by LEAs in the RISC system, conduct restraint reviews, order corrective action, training and provide technical assistance. 6. Investigate IDEA complaints filed against local education agencies and author Complaint Investigation Reports (CIRs). 7. Follow up on inquiries assigned in the PDE/BSE resource account management system. Follow up may include phone calls, virtual meetings, or on site visits. 8. Support statewide dispute resolution efforts through follow up with various corrective actions issued by the Office for Dispute Resolution and Complaint Investigation Reports 9. Collect data as required during work stoppages at local education agencies and approved private schools. 10. Maintain up-to-date information on federal statutes, regulations, case law; Commonwealth laws, regulations, standards, and policies related to the education of students with disabilities. This may include, if assigned by the Bureau Director, Assistant Director, or Division Chief: - Assisting in the interpretation of policy regarding the Individuals with Disabilities Education Act (IDEA) and state regulations related to students with disabilities. - Responding to questions about federal and state regulations. - Assisting in the development and submission of the IDEA-B grant application. 11. Participate in required training and presentation activities with LEAs, IUs, and regional technical assistance centers; and any other public meetings organized for the improvement of programs and services for students with disabilities. 12. Complete tasks assigned by the Director, Assistant Director, or Division Chief. 13. Ensure that all necessary written documentation related to the regional assignment is properly maintained. 14. Demonstrate proficiency in the operation of equipment required in the performance of the duties of the position. 15. Collaborate with various divisions, bureaus, departments, and agencies to address concerns about special education services. 16. Maintain up-to-date knowledge regarding the Alternate State Assessment (PASA) for students with disabilities, including the following responsibilities as assigned by the Bureau Director, Assistant Director, or Division Chief: - Conducting a review of federal 1% waivers - Communicating assessment accommodations to parents and local education agencies (LEAs) - Engaging in monitoring activities related to PASA. 17. Maintain up-to-date knowledge of the federally mandated State Performance Plan (SPP) and Annual Performance Reports (APR). Responsibilities may include tasks assigned by the Bureau Director, Assistant Director, or Division Chief: - Collecting status reports from assigned Local Education Agencies (LEAs) regarding compliance and improvement activities, and timely and accurate reporting, as well as addressing any other concerns. - Assisting in the preparation and submission of the SPP/APR. - Acting as a liaison between the Office for Special Education Programs (OSEP) and the Bureau of Special Education (BSE). 18. Travel as required, to fulfill job responsibilities, both within the state and out of state. 19. Perform additional duties as assigned by the Secretary, Deputy Secretary for Elementary and Secondary Education, Bureau Director, Assistant Bureau Director, or Division Chief. |
