Description of Duties: Describe in detail the duties and responsibilities assigned to this position. Descriptions should include the major end result of the task. Example: Types correspondence, reports, and other various documents from handwritten drafts for review and signature of the supervisor. Thoroughly responds to inquiries and carries out job duties applying an accurate understanding of the WC Act, its regulations, other pertinent statutory or regulatory authority, prescribed forms, the litigation process and summaries of any relevant case law. Educates the public through verbal and written communication about their responsibilities as employers under the WC Act. Independently conducts investigation of alleged uninsured employers in the Commonwealth, including employers who have not responded to Bureau requests for coverage information to determine whether they have an obligation to ensure their workers’ compensation liability. Timely inputs investigation information into the WCAIS system and updates information as appropriate. Investigates employers’ failure to insure workers’ compensation liability identifying each possible violation. Develops cases for Section 305 prosecution of the Workers' Compensation Act by researching various resources and gathering records and other evidence through contacts with various state agencies, independent agencies, attorneys, claimants, employees, insurance agents, insurance carriers and others in writing or by phone. Interviews injured workers to gather information on alleged violations of Section 305. Maintains complete and organized case files. Drafts written referral memos of cases summarizing investigative findings for review for filing of criminal charges. If warranted, signs private criminal complaints on behalf of the Commonwealth to institute criminal charges for filing before the appropriate magisterial authority throughout the state. Follows up with District Attorney's office to check case status and review case to encourage prosecution. Testifies as a witness for the Commonwealth in the prosecution of those noncompliant employers in formal judicial proceedings. Negotiates settlement and repayment agreements with employers, their attorneys, the legal department and members of management during Section 305 proceedings. Assess employers who fail to comply with Section 1610 of the WC Act, when appropriate. Conducts on-site evaluations of employers’ compliance with Section 305 of the WC Act. Informs employers of their obligations under Section 305 of the Workers' Compensation Act, and assists employers in the process of securing any applicable exemptions. Reviews Employers’ Report of Injury for potential minor injuries sustained in the course of employment. Drafts a referral memo and refers appropriate cases to Bureau of Labor Law Compliance for additional findings. Informs employer of additional compensation due to a minor if the Bureau of Labor Law Compliance determines a violation of the Child Labor Laws has occurred. Collects employers’ penalty payments owed minors. In the event an employer refuses to pay additional compensation, the investigator advises the minor he/she may file a Claim Petition seeking fifty percent additional compensation from the employer. Carries out workers’ compensation employee fraud reporting procedures. Conducts initial investigations of written reports received by the bureau where workers’ compensation fraud is alleged. Drafts correspondence to appropriate insurance carriers providing pertinent information. Independently reviews and processes employer applications and employee requests for exemption from the WC Act for religious and Executive Officer reasons. Contacts employees, employers and insurance agencies for additional information when necessary. Accurately maintains computer repository of all religious exemptions granted. Prepares any required statistical reports of job activities. Prioritizes workload to accomplish assigned job duties and advises manager whenever unable to timely carry out any assigned duties. Makes calls to and receives calls from employees, employers, insurance carriers, insurance agents, attorneys, doctors, legislators, or anyone involved in a workers’ compensation or occupational disease matter in Pennsylvania and provides information and/or assistance in solving problems relating thereto. In this capacity, the incumbent secures bureau files if necessary, attempts to resolve problems with the bureau between or among the parties to a dispute and/or provides advice on compliance with the rules and regulations of the department and provisions of the Workers’ Compensation and Occupational Disease Laws of Pennsylvania relating thereto. Problems involving legal interpretations are referred to the Bureau’s legal division. Coordinates contact insurance carriers, doctors, and other involved persons or organizations in response to inquiries so that solutions can be arranged, where possible, without the need for litigation. Encourages discussion between those involved so that informal communications can be used to answer questions that could otherwise lead to disputes. Travels as warranted to sites across the Commonwealth using state pool vehicles. Other duties as assigned. |
Decision Making: Describe the types of decisions made by the incumbent of this position and the types of decisions referred to others. Identify the problems or issues that can be resolved at the level of this position, versus those that must be referred to the supervisor. Example: In response to a customer inquiry, this work involves researching the status of an activity and preparing a formal response for the supervisor’s signature. Decides whether a violation of the Workers’ Compensation Act, its regulations, child labor laws or a workers’ compensation judge decision potentially occurred. If so, initiates an investigation. During the investigation, the incumbent determines what potential criminal charge or other remedy might be appropriate, decides what evidence is necessary to support the appropriate charge or remedy and develops the evidence necessary to prove it. When an investigation is complete, the incumbent drafts a referral memo summarizing the evidence and conclusions for the manager’s review. If the incumbent determines a potential violation did not occur or cannot be proven, the incumbent closes the file and notes the appropriate reason for doing so. Determine when to assess employers under Section 1610 of the WC Act. Determines priority of investigation caseload, considering statute of limitations. After review of requests for religious and Executive Officer exemption, decides whether the request should be granted based on criteria established by the Workers’ Compensation Act, case law precedent and existing Bureau policies. Seeks additional information to support the request, if needed, and grants or denies request based on submitted documentation. Determines whether statutory provisions of the Workers’ Compensation Act apply to a customer’s inquiry. |
