Position Purpose:
Describe the primary purpose of this position and how it contributes to the organization’s objectives. Example: Provides clerical and office support within the Division to ensure its operations are conducted efficiently and effectively. 

Serve as a Prosecuting Attorney assigned to a Regional Office. Provide all necessary legal support to the Pennsylvania Human Relations Commission as it carries out its non-discretionary investigative functions and its discretionary prosecutorial functions.

Description of Duties:

Provide legal representation to the Commission and perform legal work, research, and support necessary to assist in the Commission in fulfilling its statutory mandate to enforce the Pennsylvania Human Relations Act and the Pennsylvania Fair Educational Opportunity Act through investigation, prosecution, and education/training to the public, as follows:

Prepare and prosecute discrimination complaints and represent the Commission on appeals to the Commonwealth or Supreme Court; Represents in more important and difficult legal matters.

Provide legal support to staff on all aspects of discrimination cases; provide legal opinions on issues and cases as requested.

Prepare subpoenas and applications for subpoenas; respond to motions to dismiss; draft Rules to Show Cause.

Review proposed findings of probable cause, prepare and review conciliation agreements and consent orders.

Review complainants’ requests for preliminary hearings.

Perform all legal research to enforce the Pennsylvania Human Relations Act and the Pennsylvania Fair Education Opportunity Act and regulations.

Provide input into proposed regulations, guidelines, and internal procedures.

Respond to inquiries from citizens and present to private/public groups on issues of discrimination law.

Assist in training agency staff and other people in the area on discrimination law.

Continuously attend seminars to keep abreast of the latest developments in discrimination law.

Travel as required.

Perform other duties as assigned.

This position performs entry-level professional legal work, mainly engaging in legal research within limited scope and under close supervision. Work is assigned and reviewed by higher-level attorney.
