Position Purpose:

This is quasi-judicial work in the adjudication of parole hearings and the conducting of parole interviews.

Description of Duties:
Describe in detail the duties and responsibilities assigned to this position. Descriptions should include the major end result of the task. Example: Types correspondence, reports, and other various documents from handwritten drafts for review and signature of the supervisor.

General:
Assists the Board by: (1) conducting parole interviews to determine if an inmate should be released on parole/reparole and voting accordingly, (2) conducting parole due process hearings required to determine if an arrested parolee should be detained and/or have their parole revoked and voting accordingly and (3) conducting interviews of victims as applicable. The duties of this position will be primarily focused on (i.e. over 75% of the duties) conducting parole due process hearings, completing corresponding hearing reports and taking training in this area. The percentage breakdown of duties may vary based on the emergency needs of the Board.

Specific:
Conducts parole interviews of offenders sentenced to two or more years of confinement in the Commonwealth of Pennsylvania. Conducts these interviews individually or with a PB Board Member (face-to-face or by videoconference). Understands and considers all risk assessments and other actuarial tools regarding the offender. Reviews past and current criminal history, and parole supervision history if any. Understands and considers effective re-integration strategies for each offender. Records the interview, making notes important to their decision, and provides their decision to parole or refuse. This will be a secondary responsibility for this position based on the emergency needs of the Board.

Conducts first level Parole Violation Hearings. Conducts a fair and impartial hearing, following established rules and procedures, makes a decision as to whether or not probable cause has been established and makes a determination as to whether the parolee should be released or held for a second level hearing. Completes the Preliminary/Detention Report, registers the decision in HIP and forwards the Report to the Board. These hearings are typically conducted in County or State Prisons by video conference.

Conducts second level hearings on both technical parole violations and violations for convictions either alone or in a panel consisting of a Hearing Examiner and a Board Member. Is tasked with providing a fair and impartial hearing, recording the hearing, entertaining and acting on legal motions/objections from defense attorney and parole agents, weighing evidence, and deciding whether or not a preponderance of the evidence has been established proving the violation. Completes the Hearing Report, registers the decision in HIP and forwards the report to the Board. These hearings are typically conducted in County or State Prisons by video conference. This position will have primary responsibility for conducting second level hearings for the Board and completing detailed hearing reports. The decisions from these hearings may be subject to administrative appeal and/or court challenges.

Conducts other miscellaneous hearings as needed by the Board addressing issues such as: rescission of parole, rescission of automatic reparole, timeliness of appeals, factual determinations on credit etc. Provides a fair and impartial hearing, recording the hearing, entertaining and acting on legal motions/objections from all parties, weighs evidence and decides whether the applicable burden of proof has been established. Completes the Hearing Report, registers the decision in HIP and forwards the report to the Board. These hearings are typically conducted in the County or State Prisons by video conference.

Hears testimony from crime victims concerning the initial impact and the continuing effects of the crime on them and their feelings regarding release of an inmate on parole and prepares a summary report which is included in the material reviewed at the time of the parole release decision making.

Performs work within a broad framework of laws, regulations and policies and is subject to general review by administrative superiors through conferences and evaluations of reports, recommendations and decisions.

Schedules and attends required training each fiscal year.

Performs other related duties as assigned.

Specialized Parole Hearing Officers operate under the general supervision of the Chief Parole Hearing Officer. Specialized Parole Hearing Officers assist Parole Board Members in making parole release and revocation decisions. Incumbents of this position hold hearings and interviews with offenders seeking release on parole and parole violators, evaluate supervision and case history, and submit a vote for release/revocation to the Board for concurrence or dissent.

Experience:

Specialized Parole Hearing Officers shall be a licensed attorney in accordance with the minimum education and training requirements for this position or otherwise be grandfathered in based on their current level of hearing experience as a parole hearing officer.

Essential Functions
