Position Purpose:
Describe the primary purpose of this position and how it contributes to the organization’s objectives. Example: Provides clerical and office support within the Division to ensure its operations are conducted efficiently and effectively. 

This position will be primarily responsible for the tracking, initiation and resolution of the Region’s compliance and enforcement actions relating to the NPDES permit program and the Clean Streams Law including the rules and regulations promulgated thereunder.

Description of Duties:
Describe in detail the duties and responsibilities assigned to this position. Descriptions should include the major end result of the task. Example: Types correspondence, reports, and other various documents from handwritten drafts for review and signature of the supervisor.

Work involves interacting and coordinating enforcement activities with the field staff, other sections, other programs, other agencies including EPA and the Office of Chief Counsel. Specific duties include:

1. Prepare Departmental Orders indicating violations discovered, corrective action required, control measures or devices to be installed, and time frames for their accomplishment.

2. Prepare Consent Orders/Agreements, Consent Assessment of Civil Penalties, etc. indicating violations discovered, corrective action required, control measures or devices to be installed, time frames for their accomplishment, and recommended penalties.

3. Prepare violation letters indicating violations discovered, citing appropriate rules and regulations, indicating corrective action required, and time limitations for their accomplishment.

4. Testify as an expert or material witness in enforcement cases before District Magistrates, the Environmental Hearing Board, or the courts.

5. Meet with violators and negotiate settlements of enforcement cases in terms of corrective action or devices required and time frames for their accomplishment.

6. Schedule and conduct enforcement conferences or administrative hearings, provide background data on the case, explain Departmental Orders, Consent Orders & Agreements, Consent Assessment of Civil Penalties and answer questions.

7. Prepare non-traffic citation forms, assist in filing forms with District Magistrate, and assist in preparing case on behalf of the Commonwealth.

8. Research case files and case history and prepare documentation for use in the prosecution of cases by field personnel or legal staff.

9. Contact legal staff and discuss enforcement cases, seek clarification on rules and regulations from legal staff.

10. Review Discharge Monitoring Reports and determine compliance with effluent requirements set forth in National Pollutant Discharge Elimination System Permits.

11. Review and verify Quarterly Non-Compliance Report for EPA on major dischargers. Maintain and update EPA’s NPDES Non-Compliance Report (NNCR) database. Interact with EPA as required.

12. Assist field personnel on the enforcement of unusual or difficult cases, review case files and case history with field personnel, discuss case with field personnel, review enforcement recommendation of field personnel, recommend appropriate action to field personnel.

13. Notify supervisor of major enforcement action to be taken and against which facilities action should be taken.

14. Conduct evaluation of enforcement program within assigned area, determine what is being done and what is not being done, determine what is being done right and what is being done wrong; prepare a report of findings and recommendations based on the evaluation.

15. Provide advice to field personnel and co-workers on difficult or unusual enforcement problems.

16. Provide advice to field personnel on the interpretation and application of water quality management rules and regulations.

17. Participate in surveys, inspections, and investigations of facilities to determine compliance with water quality rules and regulations.

18. Assist in training field personnel on proper procedures and techniques for prosecuting cases.

19. Assist in training field personnel on proper documentation of enforcement cases.

20. Train field personnel on proper procedures and techniques for determining penalties in the enforcement of cases.

21. Train field personnel on the interpretation and application of water quality rules, regulations, policies and procedures as they relate to enforcement.

22. Assist in training field personnel in the techniques of negotiating settlements of enforcement cases.

23. Provide information to other sections-programs-agencies, facility operators, municipal officials, consultants, and the public on Departmental programs, functions, rules, regulations, policies and procedures as they relate to compliance and enforcement.

24. Prepare letters, reports, and correspondence to exchange information with facility operators, municipal officials, consultants, the public, co-workers, field personnel, legal staff and the supervisor.

25. Consult with Departmental Attorneys on specific legal aspects of a case and keep them advised of developments in cases assigned to them.

26. Provide input on assigned compliance and enforcement activities as requested.

- Input all enforcement actions for assigned cases.

- Monitor compliance of regulated entities in regard to Orders issued, CO&A’s executed, penalty schedules, etc. Prepare monthly listing of overdue obligations for discussion with the Program Manager and Section Chief.

- Prepare monthly Enforcement Case Status Report and distribute to the Program Manager and Section Chief.

28. Establish priorities for the enforcement of cases within assigned area.

29. Attend various types of meetings as assigned or required.

30. Operates a motor vehicle to travel to various work sites.

31. Promote the four pillars of the DEP Vision - Operational Excellence, Climate Leadership, Cultural Competence and Environmental Justice.

32. Inputs appropriate data in a prescribed format to meet data quality standards set forth by guidance, training, and policy across all of DEP’s electronic data systems; to include ensuring accuracy and completeness of entries, and where available, the use of system specific tools to ensure duplicative entries and data quality issues are minimized.

33. Communicates efficiently and effectively, both orally and in writing, to supervisory and field staff.

Work is assigned in the form of broad program goals and objectives as contained in the Clean Water Program Plan. The employee exercises some freedom in determining specific goals, objectives, and program priorities. Specific work items are periodically assigned with deadlines given. Work specifically assigned is reviewed upon completion. Work generally assigned through the program plan is reviewed periodically through reports and conferences with immediate supervisor. Performance evaluation is a continuous process summarized in the annual performance evaluation report.
