The Bureau of Labor Law Compliance, at the PA Department of Labor & Industry, monitors and enforces Pennsylvania’s laws that protect workers’ rights. This position executes these responsibilities by supervising labor law investigators in the enforcement of state labor laws, providing employees and employers with information about the state laws through public education programs, conducting inspections and investigations, resolving disputes, and initiating prosecution against employers for violations which cannot be corrected through the administrative process. |

Description of Duties: Describe in detail the duties and responsibilities assigned to this position. Descriptions should include the major end result of the task. Example: Types correspondence, reports, and other various documents from handwritten drafts for review and signature of the supervisor. Under the general supervision of the Director, oversees the duties of the Bureau of Labor Law Compliance Investigators including supervising investigators in the enforcement of 13 labor laws. These include the Prevailing Wage Act, Child Labor, Minimum Wage and Overtime, Wage Payment and Collection, Medical Pay, Equal Pay, Industrial Homework, Personnel File, Seasonal Farm Labor, Apprenticeship and Training, Prevailing Wage, Act 72 (Misclassification in the Construction Industry), Act 75 (E-Verify) and the Prohibition of Excessive Overtime in Health Care (Act 102) Plans, assigns, and directs the work of investigators within their assigned district through: 1) Receipt and screening of complaints by phone, in person and by correspondence. Composes referrals for investigation. 2) Reviews complaints and assigns cases for investigation. 3) Reviews investigators’ case log reports. 4) Reviews investigators’ computations and case files where spreadsheets have been created to show underpayments of the state labor laws. 5) Reviews investigators’ case files where there may have been violations. 6) Assists investigators by phone and in-person to resolve problems and interpret laws and regulations as they occur as well as occasional assistance in the field. 7) Conducts individual conferences with investigators, employers and employees, awarding authorities, and interested parties by phone and in-person. 8) Reviews, analyzes and recommends cases for appropriate action. 9) Holds staff meetings as needed. 10) Supervises the investigators who make direct observations and personal inspections of installations, buildings, construction operations, payroll records and personnel including interviews for the purpose of keeping informed and determining conditions, wages, and applicability to law. 11) Answers questions concerning the Acts and Regulations with various entities. These may involve classifications, wage rates, application of the Acts in specific instances and investigations. 12) Compiles reports on as-needed basis to ensure proper functioning of the Bureau. 13) Assists investigators in filing prosecutions or personally files prosecutions. 14) Writes correspondence as needed and reviews investigators standard letters. 15) Discusses problem cases with the Director and legal counsel when necessary. 16) Handles all problems beyond the notification to an employer that they owe back wages under all applicable Acts. 17) Prepares documents related to civil and criminal court filings and approves recommendations for prosecution. 18) Educates employers, organizations, and public officials of the requirements of the Prevailing Wage and other laws and recent legal decisions affecting the application of these laws. Interacts with these same parties in a manner to promote cooperation and understanding to facilitate compliance with the laws. 19) Assigns, at times, investigators to perform investigations outside of assigned areas or to make special investigations at the direction of Central Office. 20) Testifies in civil, criminal, and administrative hearings when necessary. 21) Maintains expense records associated with job travel. 22) Performs other duties as assigned. |
