Position Purpose: Describe the primary purpose of this position and how it contributes to the organization’s objectives. The Bureau of Labor Law Compliance, at the PA Department of Labor & Industry, monitors and enforces Pennsylvania’s laws that protect workers’ rights. This position executes these responsibilities by providing employees and employers with information about the state laws through public education programs, conducting inspections and investigations, resolving disputes, and initiating prosecution against employers for violations which cannot be corrected through the administrative process. |
Description of Duties: Describe in detail the duties and responsibilities assigned to this position. Descriptions should include the major end result of the task. Example: Types correspondence, reports, and other various documents from handwritten drafts for review and signature of the supervisor. Under the general supervision of the Labor Law Investigation Supervisor, conducts audits and investigations regarding enforcement of (thirteen) 13 state labor laws to ensure compliance. These include Construction Workplace Misclassification Act (Act 72), Prohibition of Excessive Overtime in Health Care Act (Act 102), Child Labor Act, Minimum Wage Act, Wage Payment Collection Law, Prevailing Wage Act, Medical Pay Law, Apprenticeship and Training Act, Equal Pay Law, Industrial Homework Law, Personnel File Inspection Act, and Seasonal Farm Labor Act, Act 75 and any Regulations promulgated under each. This position is responsible for the following: Receives and screens complaints. Conducts audits of payroll records, timecards and related materials. Facilitates conferences with claimants and employers, when appropriate. Files prosecutions when necessary. Prepares case narratives; both written and verbal testimony for cases that proceed to legal action. Educates contractors, organizations, employees, and public officials of the requirements of the laws and on recent legal decisions affecting the application of such laws. Requests documents and pertinent information from employees, employers, and invested parties to complete audits and investigations. Prepares detailed reports of investigations. Files weekly itinerary and case summaries with the Investigation Supervisor. Effectively communicating with employers, employees, and supervisors concerning current investigation status. Represents the Commonwealth in prosecutions before the District Justice and testifies as the Commonwealth's expert witness at administrative and court hearings. Collects physical evidence and eyewitness accounts to prepare for prosecution. Conducts timely detailed interviews (phone / in person) of claimants and business owners. Inspects businesses or projects to investigate for potential violations of minors in employment, including speaking to school district officials, project managers, company representatives, parents or guardians, and entertainment industry companies. Travels to business locations for investigation / audit tasks. Maintains timely and detailed work notes of case progress. Discusses difficult cases with supervisor. Performs other related duties at required. |
