Position Purpose:
Describe the primary purpose of this position and how it contributes to the organization’s objectives. Example: Provides clerical and office support within the Division to ensure its operations are conducted efficiently and effectively. 

This is advanced level and more varied legal analytical work involving review and subsequent approval of applications based upon evaluation of field reports and related documentation in accordance with all statutory, regulatory and policy criteria. The emphasis is on complex transactional casework and changes in license status such as applications for new licenses, transfers of existing licenses, extensions of licensed premises and changes in corporate organizations and formulating subsequent recommendations for Board action.

Description of Duties:
Describe in detail the duties and responsibilities assigned to this position. Descriptions should include the major end result of the task. Example: Types correspondence, reports, and other various documents from handwritten drafts for review and signature of the supervisor.

Responsible for examination, analytical evaluation and subsequent approval of applications for different types of licenses and permits as mandated by the Liquor Code, subsequent amendments and by the adoption of Board regulations, precedents and policies, controlling the manufacture, purchase, transportation, storage, delivery, sale and consumption of liquor, alcohol, and malt or brewed beverages.

Examination of applications, supporting documents and fees for the various types of licenses and permits processed in the Bureau to determine their correct execution and eligibility of the individual applicant or entity and the premises to be licensed for the license or permit as set forth in the application. Examine and determine the acceptability of legal documents, such as agreements of sale, partnership agreements, leases, court orders, franchise agreements, IRS seizures, bankruptcy orders, and opinions, liens and writs.

Examination of the pertinent files for complaints, convictions, citations, suspension, appeals, hearings and any other irregularities or pending action which affect the eligibility of the applicant and/or premises as well as for any other pending applications.

Summarizes discrepancies in the form of a decision sheet and prepares correspondence regarding deficiencies and requests reinvestigation when necessary.

Approval of applications when all statutory and regulatory requirements are met and the application, supporting documentation and fees are in proper order.

Review investigative reports to determine adherence to statutory, regulatory and policy requirements.

Provides requested case status to applicants, licensees, attorneys, legislators, as well as to agency personnel including the Executive Staff.

Issues approval and authority to operate and arranges for delivery via mail, electronic mail, facsimile equipment, personnel messenger, and overnight mail delivery services.

Prepares resumes of complex cases for referral to upper level management personnel for review and advise as to approval at the administrative level or referral to the governing board or hearing examiner. Resumes must contain all pertinent information and facts in order that accurate decisions can be made.

Reviews cases that require Board action to ensure that all of the pertinent facts are properly presented and discussed in the case resume for proper presentation to the Board; reviews and analyzes verbatim testimony and resumes prepared by a Hearing Examiner; determines if testimony agrees with the facts outlined in the Hearing Examiner's report; and prepares summaries of hearings and provides the Bureau's recommendation for Board review and final decision. Resumes are completed within deadlines set by the Board.

Assists in the recording of the decisions rendered by the Board Members through a meeting with the Director of Licensing, after a Board Session has been held.

Reviews cases which have been appealed; determines the impact court decision will have on applicant/protestants appeals. Initiate proper actions based on established procedures and the court's decisions. Determines what applications, fees or appropriate action is required to satisfy the order set by the court.

Composes and initiates requests for investigation, letters, and other correspondence pertaining to licensing matters. Prepare responses to legislators, attorneys, applicants and protestants on pending Board cases.

Assists Supervisor in the preparation of procedures and the redesign of forms and letters.

Re-examination and approval of applications, supporting documents and fees when resubmitted after correction by the applicants or their attorneys. Examination of additional applications and supporting documents or fees required for completion of processing an application for certain licenses or permits.

Inputs data on the computer system, maintain updates and control issuance of licenses, including verifying tax clearance information.

Utilizing the Bureau of Licensing’s computer system to effectively monitor the status of and/or process licenses and pending applications.

Assists in the coordination and scheduling of Board hearings for Licensing matters.

Responsible for the initial review and total processing of New Economic Development License applications, all of which require Board hearings.

Maintains daily and weekly reports for all work accomplished, if required.

Performs related work comparable with the classification and assists others as required.
