Position Purpose:
Describe the primary purpose of this position and how it contributes to the organization’s objectives. Example: Provides clerical and office support within the Division to ensure its operations are conducted efficiently and effectively. 

This position is responsible for the implementation, preparation and coordination of storage tank compliance actions, within the Northwest Region. It requires a technical understanding of the storage tank regulations and requirements. It also requires the ability to work cooperatively with regional staff, central office, and the regulated community.

Description of Duties:
Describe in detail the duties and responsibilities assigned to this position. Descriptions should include the major end result of the task. Example: Types correspondence, reports, and other various documents from handwritten drafts for review and signature of the supervisor.

Participation and development of regional and specific enforcement strategies with the Environmental Group Manager, Water Quality Specialists, Hydrogeologist, Water Quality Specialist Supervisor, and Regional Manager.

Prepares Notices of Violations, Consent Orders and Agreements, Orders and other legal documents used by the Department.

Conducts compliance meetings with storage tank owners regarding technical violations and responsible parties conducting cleanups of releases at storage tank facilities.

Must be knowledgeable in the use of the e-FACTS database to input and query information relevant to program.

Inputs appropriate data in a prescribed format to meet data quality standards set forth by guidance, training, and policy across all of DEP’s electronic data systems; to include ensuring accuracy and completeness of entries, and where available, the use of system specific tools to ensure duplicative entries and data quality issues are minimized.

Testifies as a witness before magistrates, Environmental Hearing Board, Common Pleas Court, and Commonwealth Court.

Participates in training for storage tank regulations, leak detection, Act 2 requirements, etc.

Coordinates, reviews and follows-up of third party inspections, corrective actions and make recommendations regarding enforcement actions.

Participates in the identification and oversight of abandoned storage tank initiative sites, and state lead storage tank site cleanups.

Coordinates and attends public meetings regarding storage tank issues or actions.

Reviews and comments on proposed enforcement policies and strategies.

Tracks enforcement document requirements to ensure compliance with milestones.

Calculates and negotiates civil penalty assessments.

Coordinates compliance activities between the Regional Storage Tank staff, Legal Staff, and Central Office.

Conducts enforcement conferences and administrative hearings; negotiating settlements of cases; and negotiate penalties.

Assists field personnel in resolving problems involving enforcement of cases.

Reviews case data with field personnel to determine appropriate enforcement action to be taken and against whom.

Trains field personnel on documentation techniques for enforcement cases.

Provides information to facility operators, municipal officials, consultants, and the public on Department programs, functions, rules, regulations, policies and procedures.

Assists and provide advice to field personnel on the enforcement of unusual or difficult cases, review enforcement recommendation of field personnel and recommend appropriate action.

Reviews Departmental Orders, Consent Orders/Agreements, and violation letters prepared by field personnel for content, completeness, technical accuracy, and legal terminology; correct errors and makes changes or recommendations.

Negotiates the settlement of enforcement cases in terms of corrective action required and time frames for their accomplishment.

Conducts other job or enforcement related functions.

Work is performed independently, with major projects assigned by the Storage Tanks Environmental Group Manger. Periodic meetings are held with the Storage Tanks Environmental Group Manager to receive direction and discuss progress in accomplishing assigned objectives. A certain degree of latitude is allowed regarding specific course of action to be taken to achieve objectives.
