Position Purpose:

This position hears and decides first level appeals and, when requested, serves as a hearing officer for second level appeals.

Description of Duties:
Describe in detail the duties and responsibilities assigned to this position. Descriptions should include the major end result of the task. Example: Types correspondence, reports, and other various documents from handwritten drafts for review and signature of the supervisor.

This position has the responsibility to schedule and conduct hearings and draft and issue decisions on appeals cases in a timely and impartial manner. This includes presiding over hearings and following rules of evidence, due process standards, and standard administrative practice to move the proceedings to conclusion. Such actions involve administering oaths; assisting parties without representation in developing the record; informing parties to appeals about policies, procedures, and rights; analyzing and evaluating testimony and other evidence; resolving conflicting testimony; assessing witness credibility; ruling on requests for subpoena issuance; and, scheduling and conducting pre-hearing conferences when appropriate. In addition this position trains, advises, and oversees activities by subordinate staff facilitating appeals processing within the office; resolves complaints and grievances; supervises clerical support staff; prepares performance reviews for such employees; and, approves or disapproves leave requests.

Issues clear and concise decisions reflecting the Referee’s evaluation of evidence. This includes making findings of fact legally sufficient to support ultimate decisions; explaining all legal issues present in the case; stating the statutes or regulations under which the cases are decided; and, providing reasoning for decisions which reflects the Referee’s application of the law to a particular set of facts.

Interprets policy and procedure from the UC Law and regulations, precedent decisions in case law, and other instructions. In addition, this position conducts legal research; maintains files of such reference materials; and, applies them in the conduct of hearings, determination of appeals, and drafting of decisions. Communicates with the Appeals Referee Program Manager, UCBR headquarters and other agency staff and drafts replies to a variety of communications.

While assigned to a specific Referee office, Referees regularly hold hearings in other counties separate from this office and may also assist other Referee offices on occasion. Travel is required to other hearing locations, to assist other Referee offices and to attend training or conference sessions as needed, either on a day trip basis or for an extended period.

Decision Making:

Work is assigned by means of performance objectives for the Referee’s responsibilities, which are jointly determined by the Referee and the Referee Program Manager. Considerable independence is required. Supplemental direction is provided by occasional consultation with the Referee Program Manager. The Referee Program Manager reviews work by observation and by comparison of performance with established laws, policies, and regulations.
