Description of Duties: Describe in detail the duties and responsibilities assigned to this position. Descriptions should include the major end result of the task. Example: Types correspondence, reports, and other various documents from handwritten drafts for review and signature of the supervisor. Reviews subpoena and continuance requests for Board licensing hearings to determine legal sufficiency and compliance with applicable laws, regulations, and hearing procedures. Reviews Hearing Examiner Recommended Opinions for Licensing cases and communicates any deficiencies to the Hearing Examiner. Drafts Board Opinions for Licensing cases for review and consideration by Board decision-makers; ensures legal analysis and conclusions are supported by the applicable statutes, regulations, and evidentiary record. Prepares and/or assists in the preparation of the Original Record, when necessary, for appeals to Commonwealth Court. Drafts recommendations for the Board regarding Licensing nuisance bar and/or Board cases involving routine to moderately complex issues. Drafts conditional licensing agreement notification letters to applicants and/or licensees regarding matters held by the Board to communicate Board determinations and applicable conditions for resolution of licensing matters. Evaluates and makes recommendations regarding protests and/or petitions-to-intervene for Licensing Board cases and noise exemption cases. Advises Chief Counsel, Executive Deputy Chief Counsel, and Deputy Chief Counsel on legal issues arising from licensing and noise exemption hearings and/or cases. Reviews noise exemption petitions from municipalities and communicates with municipal officials to resolve issues or obtain additional information necessary for consideration of the petitions. Prepares and/or assists in the preparation of the exhibits for noise exemption hearings. Represents the Board at noise exemption hearings. Reviews Hearing Examiner Noise Exemption Reports for noise exemption cases. Drafts recommendations for the Board regarding noise exemption cases. Prepares and/or assists in the preparation of letters and the appropriate attachments for municipalities and licensees regarding the Board’s decision in noise exemption cases. Drafts Board Opinions for noise exemption cases for review and consideration by Board decision-makers; ensures legal analysis and conclusions are supported by the applicable statutes, regulations, and evidentiary record. Drafts Board Opinions in citation matters involving appeals from decisions made by the Office of Administrative Law Judge. Drafts responses to Licensing for management agreements. Advises and assists in advising the Board, Chief Counsel, Executive Deputy Chief Counsel, Deputy Chief Counsel, other Board employees, and other persons on the proper interpretation of laws and the subsequent appropriate courses of action. Drafts written responses to questions regarding the Liquor Code and/or the Board’s Regulations. Responds to assigned callers’ questions regarding the Liquor Code and/or the Board’s Regulations. Researches assigned legal issues and provides results to Chief Counsel, Executive Deputy Chief Counsel, and/or Deputy Chief Counsel. In cases where there is no legal precedent, prepares and assists in preparing new legal arguments and/or strategies. Gives advice and the benefit of any relevant experience to Chief Counsel, Executive Deputy Chief Counsel, and Deputy Chief Counsel when appropriate. Supports Chief Counsel, Executive Deputy Chief Counsel, and Deputy Chief Counsel by performing other tasks and/or related work as assigned. Performs other duties as assigned. |
Decision Making: Describe the types of decisions made by the incumbent of this position and the types of decisions referred to others. Identify the problems or issues that can be resolved at the level of this position, versus those that must be referred to the supervisor. Example: In response to a customer inquiry, this work involves researching the status of an activity and preparing a formal response for the supervisor’s signature. Cases and other projects are assigned by Chief Counsel, Executive Deputy Chief Counsel, and Deputy Chief Counsel and are subject to review by the supervisor. Upon receipt of the assignment, responsibility for completion lies solely with the incumbent. As familiarity with the work increases, the incumbent will be assigned work of increasing scope and complexity. Work is reviewed for accuracy, timeliness, effectiveness and adherence to performance standards. Legal research preliminary to the rendering of decisions affecting agency operations, the preparation of documents, or the preparation of cases for trial is done independently, but subject to general supervision by a higher-level attorney based on the difficulty of the legal problems encountered. |

Requirements Profile: Identify any specific experience or requirements, such as a licensure, registration, or certification, which may be necessary to perform the functions of the position.
