Position Purpose:

This position is established in the Bureau of Design and Delivery, Contract Management Division, Contract Awards Section.
The Contract Awards Program administers the project delivery process from project advertisement, contract award, and contract execution, to project ‘notice to proceed’. This position establishes the Department’s Disadvantaged Business Enterprise (DBE-Federal), evaluates, and approves DBE commitments and Diverse Business Participation Good Faith Efforts.

Description of Duties:

Develops and manages the Department’s Federal DBE Program for statewide highway construction projects.

Develops and manages the statewide highway construction program pursuant to 23 CFR § 635 and 49 CFR § 26.

Develops and manages the state Diverse Business (DB) Program pursuant to Title 74 Pa. C.S.A. § 303; develops and manages procedures, forms, and systems for monitoring the statewide minority goal attainment programs and Good Faith Efforts.

Analyzes and approves the individual project DBE goals prior to project advertisement to ensure consistency with the Department’s approved annual statewide Federal requirements.

Monitors construction projects from advertisement to ‘notice to proceed’ for compliance to ensure that anticipated notice to proceed dates are met; reviews bid packages as needed to ensure they have been adequately prepared for letting; opens sealed bids as required; awards contracts as required.; executes contracts as required.

Ensures the timely submission of DBE commitments and DB Good Faith Efforts on highway construction projects within ECMS. Reviews subcontractor certification and prequalification for DBE commitments; recommends bid rejection when all requirements have not been satisfied.

Serves as chairperson of the DBE Interdisciplinary Review Team (IRT) to evaluate the Good Faith Efforts of prime contractors who fail to meet established DBE goals; drafts IRT recommendation for approval/disapproval of the Director, Bureau of Equal Opportunity or Director, Bureau of Recreation and Conservation, Department of Conservation and Natural Resources (DCNR), as appropriate; prepares and presents Good Faith Evaluation to the Good Faith Efforts Committee (chaired by the Deputy Secretary for Highway Administration or by the Deputy Secretary for Conservation and Technical Services, DCNR) in the event of disapproval.

Represents the Contract Management Division at DBE Goal Monitoring Meetings and makes recommendations to adjust the annual statewide construction program goal as necessary for targeted attainment.

Leads the review of DB Participation Good Faith Efforts of prime contractors and consultants; drafts recommendation for approval/disapproval for final approval/disapproval by the Director, Bureau of Equal Opportunity.

Defines ECMS requirements associated with statewide minority attainment programs to increase the efficiency of the project delivery process; determines prioritization of Contract Awards Program ECMS requirements.

Provides technical support to contractors on Engineering and Construction Management System (ECMS) procedures for DBE/DB participation on highway construction projects.

Provides technical support to DBE/DB contractors on the requirements for certification.

Establishes and maintains positive relationships with the Bureau of Equal Opportunity, the Office of Chief Counsel, the Engineering District Offices, the Federal Highway Administration (FHWA), local Governments, Prime Contractors, Minority Contractors, the Department of General Services, DCNR, the U.S. Department of Transportation, and the Associated Pennsylvania Constructors (APC).

Prepares reports for FHWA to ensure compliance with federal funding requirements; prepares additional reports and presentations as necessary to demonstrate program compliance; presents DBE Program information as appropriate.

Reviews modifications to the Code of Federal Regulations and Commonwealth legislative mandates related to DBE/DB programs to ensure that current policies, specifications, etc. meet all requirements; writes revisions to current policies and specifications as appropriate.

Analyzes and approves Public Works Employment Verification and Worker Protection and Investment Certification submissions as required on State and Federally funded projects as back up to the AO1.

Performs other related duties as required.
