Position Purpose:
Describe the primary purpose of this position and how it contributes to the organization’s objectives. Example: Provides clerical and office support within the Division to ensure its operations are conducted efficiently and effectively. 

Processes, tracks, and drafts all surface mine coal and industrial minerals enforcement actions to ensure compliance with the laws and regulations to protect the environment and public health and safety. This position is also primarily responsible for the maintenance of treatment trust funds and water treatment liability data.

Description of Duties:
Describe in detail the duties and responsibilities assigned to this position. Descriptions should include the major end result of the task. Example: Types correspondence, reports, and other various documents from handwritten drafts for review and signature of the supervisor.

Reviews, processes, and enters eFACTS data for all enforcement actions and related inspection reports. The review includes completeness, accuracy of the citation and or information provided. Errors or unusual citations are reported to the supervisor.

Processes, logs and tracks civil penalties, violation notices, docketed compliance orders, agreements, decrees, alternate enforcement, and bond forfeiture requests. Tracks all Notices of Violation, orders, adjudications, decrees, civil penalty assessments, payments, cease and desist orders, citations and judgements through eFACTS and Oracle reports.

Assigns sequential docket numbers to compliance orders, according to approved Bureau procedure and maintains a log of all enforcement orders.

Calculates proposed civil penalty assessments based on a review of violations and site conditions referred from the Surface Mine Conservation Inspector or Surface Mine Conservation Inspection Supervisor. Calculations are done in accordance with the guidelines in the regulations and TGD.

Negotiates civil penalty assessments and drafts consent assessments for collection of outstanding civil penalties in accordance with Departmental rules and regulations.

Ensures that proposed assessments are prepared and issued using standard wording and form in accordance with Departmental guidelines.

Prepares administrative orders for signature by the District Mining Manager.

Reviews reports, recommendations, or decisions of field personnel for possible inconsistencies with the laws or regulations governing the regulatory program.

Prepares Consent Assessments, Formal Assessments, and other documents as necessary.

Accepts, records, and processes all civil penalty checks. This includes receiving, reviewing, and evaluating civil penalty payments to ensure order or agreement conditions are being met, payments are for the correct amount, and entering data into eFACTS.

Prepares summaries of the pertinent aspects of cases to be used in making administrative decisions and bringing to the attention of the supervisor any discrepancies or inconsistencies.

Contacts field personnel, attorneys, licensees, or the general public to gather additional information or to clarify information relative to DEP compliance actions.

Prepares Failure to Comply letters, License Suspension letters, and Pattern of Violation letters.

Prepares 30-day Permit Suspension/Notice of Intent to Forfeit Notices, tracks the follow-up dates, and any responses received from the Operator or Surety Company. After the required time period has lapsed with no response, prepares the Recommendation for Forfeiture package within 15 days.

Reviews executed documents such as consent orders, consent agreements, decrees, civil penalty orders, cease and desist orders, and other legal documents for proper signatures of officials, and affixing the required stamps or seals, mails copies of properly executed documents to appropriate officials; notifies superiors and legal staff of documents needing proper signatures, seals, or stamps.

Answers telephone calls involving compliance activities. This includes providing information on the status of cases, explaining how to complete forms and routing non-routine calls to superiors or legal staff for answers.

Reviews case files to compile data on permit conditions, inspection frequency, violations previously cited, violations corrected, penalties assessed and paid, outstanding violations to be corrected or penalties to be paid, operator history of cooperation or non-cooperation, and similar information which is presented in a prescribed format for use by superiors and legal staff for decision making.

Schedules meetings, conferences, telephone conferences, administrative hearings, fact-finding conferences, consent order meetings, and other types of meetings to discuss compliance actions. This includes contacting participants to determine suitable meeting dates, times, and locations, notification of such, and preparing and mailing appropriate support documents.

Prepares and proofreads consent orders, consent agreements, civil penalty assessment documents, cease and desist orders, and documents for grammar, spelling, punctuation, content, format, proper use of legal terminology, and the proper and full legal citation of laws, rules, regulations, policies and procedures and monetary penalties when appropriate.

Compiles, develops, requests, and reviews reports related to compliance activities and complaint/inquiry information.

Tracks compliance deadlines and prepares a weekly report of upcoming and overdue compliance actions to the Compliance Manager.

Trust Fund and Water Treatment Liability:

Enters, updates, and maintains information in the database and files related to the Mine Drainage Inventory (MDI). Includes preparation of the semi-annual report on the sampling of MDI discharges using Oracle reports.

Maintains trust fund data base for active companies and track payments and disbursements from trust funds; schedules and conducts annual trust fund review meetings.

Manages treatment trust funds – reviews and recommends approval or disapproval of payments from trust funds to mine operators or treatment contractors and monitors and tracks investment earnings for trusts on abandoned mines where DEP is operating water treatment facilities.

Maintains and submits a bi-monthly inventory and status report of all pending and current Trust Funds and long-term treatment sites.

Performs economic analysis and cost modeling of existing and proposed mine drainage treatment systems in order to determine bonding or trust fund requirements needed for long-term continued treatment operations. Meets with mine operators to review cost calculations and assists in negotiations of long-term financial assurance bonds and trust funds.

Other:

Initiates and reviews violation checks for permit issuance and for conducting Application Violator System (AVS) checks for the same.

Requests information, mails information to inspectors, and enters data into eFACTS as part of the AVS process.

Assists the Inspector Supervisors in preparing instructions and training material to instruct Inspectors and others in the proper completion of inspection reports, citations, and other compliance documents. This includes participating in training sessions and explaining proper procedures for preparing the documentation needed in support of compliance actions.

Serves as the Litigation Coordinator. Tracks and monitors active litigation cases, distributes oral and written information to all pertinent parties as to due dates, schedules, obligations, case assignments, Board decisions, and pre-hearing memorandum and attends pre-litigation meetings.

Follows up on overdue Financial Guarantees and Conversion Assistance Financial Guarantees.

Promotes the Department’s mission.

Inputs appropriate data in a prescribed format to meet data quality standards set forth by guidance, training, and policy across all of DEP’s electronic data systems; to include ensuring accuracy and completeness of entries, and where available, the use of system specific tools to ensure duplicative entries and data quality issues are minimized.

Negotiates civil penalty assessments and Agreements and drafts Orders and Agreements for review and final action by Department attorneys and management.
