Position Purpose:
Describe the primary purpose of this position and how it contributes to the organization’s objectives. Example: Provides clerical and office support within the Division to ensure its operations are conducted efficiently and effectively. 

This position is established in the Bureau of Project Delivery (BOPD), Contract Management Section, with primary responsibility for electronic and hard-copy engineering agreements for District Offices. Position administers requests for consultant services, reviews and evaluates proposals, negotiates and prepares engineering agreements, and administers execution of approved agreements.

Description of Duties:
Describe in detail the duties and responsibilities assigned to this position. Descriptions should include the major end result of the task. Example: Types correspondence, reports, and other various documents from handwritten drafts for review and signature of the supervisor.

Performs a variety of complex engineering duties associated with the negotiation, preparation, and execution of engineering agreements.

Meets with consultants and District representatives to negotiate details of engineering agreements; negotiates revisions to existing agreements.

Analyzes price proposals submitted by consultants and reviews comments from District Offices and other Central Office review agencies.

Assists Department employees and external customers in the interpretation and application of Publication 93, "Policy and Procedures for the Administration of Consultant Agreements" and other related policy as they acquire the services of consultants.

Revises, updates, and interprets the Department's Publications 93 and 442, "Specifications for Consultant Agreements for Project Development Services".

Resolves problems associated with invoicing.

Answers questions from consultants and District personnel regarding interpretation and clarification of various aspects of the Engineering agreements.

Prepares both paper and electronic Engineering Agreements. These agreements include price proposals, technical proposals, legal provisions, estimated progress reports, Disadvantaged Business Enterprise (DBE) goals, purpose of the agreement, and schedule.

Obtains solutions to problems which prevent the execution of the engineering legal agreement.

Provides technical support to Engineering and Construction Management System (ECMS) users with the regard to the operation of the system, as well as assisting in trouble-shooting problems as they arise.

Provides guidance and support related to consultant agreements for both professional and rank and file Department employees.

Reviews and recommends approval for requests to advertise for third party agreements.

Evaluates requests for Supplemental Agreements.

Reviews and recommends approval for consultant selection procedures for local Municipalities involved in Third-Party Federal-Aid Agreement.

Reviews and recommends approval for consultants that were selected by local Municipalities to perform work under a Third-Party Federal-Aid Agreement.

Explains the Department's consultant selection procedures to consultants who inquire about performing work for the Department.

Prepares and updates the Department's procedures related to consultant agreements.

Visits Engineering Districts as necessary to discuss the consultant engineering agreement process and related problems.

Assists with the Bureau's evaluation of potential consultants' design errors.

Coordinates as necessary with the Federal Highway Administration, the Office of Chief Counsel, and/or the Office of the Comptroller regarding policy deviations.

Performs other related duties as required.

Succession Planning
Take an active role in succession planning by completing a Career Development Plan in collaboration with the supervisor. In conjunction with the supervisor, participate in knowledge management/transfer by identifying key aspects of the job and sharing explicit and tacit program/technical knowledge with other employees.

Actively engage in succession planning by assessing potential vacancies; identifying current and future critical needs and competencies; and assessing the interest, availability, and readiness of current staff and candidate pools. Work with employees to complete and maintain a Career Development Plan. Engage employees and recognize employees and their accomplishments. Establish a mechanism to identify, capture, and share explicit and tacit program/technical knowledge among staff.

Department Green Plan Policy
As part of PennDOT’s MS4 obligations including NPDES Permit compliance and stockpile good housekeeping, commit to following the Departments Green Plan Policy (Pub 712) and the associated principals. Failure to comply with Department Green Plan Policy shall be documented in employee’s performance review.

Fair Labor Standards Act (FLSA)
Unless directed by your supervisor or manager, comply with stated work hours for the 7.5/8.0 hour day.

Understand your responsibilities as a supervisor under the FLSA to ensure that employees are paid appropriately for hours they work or are allowed to work—i.e., all time spent furthering the business of the Department. Ensure that your employees are performing work only within their regularly-assigned shift hours, unless overtime has been directed and approved in advance of completed work. There should be no confusion as to when work has officially started or ended. Ensure that all hours employees work are fully accounted for on payroll sheets.

Decision Making:
Describe the types of decisions made by the incumbent of this position and the types of decisions referred to others. Identify the problems or issues that can be resolved at the level of this position, versus those that must be referred to the supervisor. Example: In response to a customer inquiry, this work involves researching the status of an activity and preparing a formal response for the supervisor’s signature.

It is necessary to interact both orally or in writing with the Department Executive Staff, Senior Management, other Department Managers, Section employees, District personnel, personnel from other State and Federal agencies, engineering consultants, and engineering organizations in order to carry out assigned duties and responsibilities.

It is necessary to carry out assigned duties with minimum written or oral instructions from the Chief, Consultant Agreement Section, and Bureau of Design.

It is necessary to be able to read and understand Federal and State policies in regard to Engineering Agreements and related functions. It is necessary to use a telephone to communicate with consultants, District personnel, etc.
