Position Purpose:
Describe the primary purpose of this position and how it contributes to the organization’s objectives. Example: Provides clerical and office support within the Division to ensure its operations are conducted efficiently and effectively. 

Conduct advanced legal research, and review, for processing of court documents. Possess a firm knowledge of the Pennsylvania Crimes Code, Penal Code, Vehicle Code, Liquor Code, Drug and Cosmetic Acts and state legislation. Independently make recommendations or decisions based on the research accuracy of data provided and determine if it complies with applicable law.

Review, analyze, and process confidential legal documents such as Court Ordered Expungements, Orders for Limited Access, and Full/Conditional Pardons pertaining to Criminal History Record Information in the Commonwealth.

Receive and process incoming mail. Answer main phone line and respond to voicemails appropriately.

Description of Duties:
Describe in detail the duties and responsibilities assigned to this position. Descriptions should include the major end result of the task. Example: Types correspondence, reports, and other various documents from handwritten drafts for review and signature of the supervisor.

50% Receives, reviews, and process Court Ordered Expungements such as Full, Partial, ARD, House Bill 1543 (Summary Conviction), Commonwealth/Hunt (Over 70 years of age), Act 83 Summary Acquittal list, Philly ARD list, Philly YAP list, and Juvenile expungements. Ensure the court order complies with laws governing expungements set forth under Crimes Code 18 Pa. C.S.A. §9122, §9122.1, or §9123. Process Court Orders for Limited Access, sealing misdemeanor and felony offenses that meet certain criteria. Process Full/Conditional Pardons, as signed by the Governor. Each expungement order must be perused to make sure all the required information is included. FBI record must be viewed by accessing III via CLEAN to compare against the PA record and be expunged accordingly either electronically or by a generated mailed response.


15% Pull and verify criminal jackets for fingerprints and generate a RAP sheet. Compare arrest information on record to information the court has ordered. Research discrepancies discovered through JNET, generating court dockets, and summaries of the arrest for comparison and accuracy. As necessary communicates orally and via written correspondence with criminal and juvenile courts, attorneys, law enforcement agencies, probation officers, District Attorney’s office and the general public.

15% Prepares affidavits of expungement completion and other various documents for the public and law enforcement agencies to be sent to the county clerk of courts, attorney, petitioner, and/or arresting agency. Generate correspondences on ‘no records’ to sender when a search for a PA record or FBI record returns no results.

5% Process out of state parole orders/requests by obtaining case closure notices from the Board of Parole and Probation.

5% Correctly answers/directs phone calls and responds to voicemails.

5% As directed by the Supervisor, assist in training new employees to the Unit.

5% Perform any other related duties assigned by the Supervisor

Determine if information pertaining to an arrest is accurate as reflected in the Criminal History database and decide if court order conforms to the governing laws set forth under Crimes Code 18 Pa. C.S.A. §9122, §9122.1, or §9123.
Accurately analyze court documents and take correct action, work requiring a final legal determination should be brought to the supervisor, when all other resources have been exhausted.

Essential Functions

 1. Comprehend criminal history information and legal terminology
 2. Conduct legal research and apply law
 3. Access various computerized systems to in CCHRI, CLEAN, JNet, and MBIS Archive
 4. Expunge criminal arrest records at state and federal level ensuring accuracy
 5. Seal Criminal arrest records at state level
 6. Prepare affidavit notifications of expungement to send to the county Clerk of Courts, attorner, arresting agency, and / or petitioner
 7. Track production statistics weekly and maintain quota
 8. Communicate clearly and effectively, both verbally and in writing and county court staff, attorney's, arresting agencies and the public
 9. Handle incoming telephone inquiries and provide proper expungement information and procedures
 10. Coordinate with Federal CJ agencies
