Position Purpose:

This position is assigned to the Administrative and Divergent Licensing Affairs Division (ADLAD) in the Bureau of Licensing. This division includes the Nuisance Bar Unit and Board Case Unit. The incumbent will report directly to the PLCB ADLAD Division Chief and is responsible for the performance of advanced, analytical work involving the review of a variety of licensing action request types, and subsequent recommendation for Board action in accordance with all statutory, regulatory, and policy criteria governing licensed establishments.

In general, and within the context of the ADLAD, the incumbent is responsible for collecting and coordinating information (violation history, petitions to intervene and input from law enforcement and citizens) and work with Bureau Supervisors, Division Chief, Director and PLCB attorneys to evaluate renewals and changes to licenses.

The duties and responsibilities specific to ADLAD Nuisance Bar Unit performed by this position include the following:

Providing education and assistance to entities that provide information regarding liquor Licensees. This education and assistance shall consist of license renewal periods, criteria necessary, an understanding of Conditional Licensing Agreements (CLA’s) and Offers in Compromise (OIC), and the importance of following up and holding licensees accountable for CLA’s and OIC’s.

Assists in the cyclical preparation of processing timetables for the licensing districts for the purpose of establishing and maintaining steady workflow processing and avoiding conflict with prior and future district responsibilities.

Assists in the timely and proper mailing of notification letters to the Office of Attorney General, all Commonwealth municipalities, members of the General Assembly, and the sixty-seven County District Attorney Offices.

Corresponds with the Pennsylvania State Police Troops, Bureau of Liquor Control Enforcement District Offices, and Municipal Police Dept. requesting information that will support non-renewing a liquor license as a result of activity in and around the premises being a detriment to the surrounding community, verification of any record for a licensed establishment or licensee involving a felony conviction or observed drug activity which resulted in the issuance of a citation or warning.

Examines pertinent files for complaints, citations, suspension, appeals, petitions to intervene, hearings and any other irregularities or pending action which affect the eligibility of the applicant and/or premises as well as for any other pending applications.

Reviews and evaluates documents received from the Attorney General's Office, the Lt. Governor’s Office, Police Departments, District Attorneys' Offices, and legislature, to determine if criteria is met to warrant further review of a licensee's operating history; requests appropriate field Licensing Analyst to initiate specific investigatory procedures in those situations where reported/proven drug activity has occurred, an apparent violation of the liquor code has occurred, or where there is a clear issue that existing circumstances pose a threat to the health and welfare, peace and morals of the surrounding community.

Requests, and reviews, a Data query listing of licensees who have citations meeting nuisance bar criteria months prior to the effective license termination date; and issues a Stop Order on assigned cases designating them for future evaluation.

Maintains information received from various sources on potential nuisance bar candidates statewide for evaluation at time of biennial renewal.

Analyzes prior operating history of assigned licensees meeting nuisance bar criteria; prepares an accurate, in-depth summary of analysis, including a recommendation of action; reviews any pending reports to determine the financial interest of the current licensee and the pending action, and provides this information to the Bureau Director and the Board's attorney in event of hearing.

Reviews nuisance bar investigatory reports from the field Licensing Analysts for assigned cases to ensure information is complete and adheres to required reporting guidelines; determines if reasonable cause exists to list as a nuisance bar case and provides a recommendation for an appropriate course of action, or prepares correspondence outlining reasons criteria are not met; forwards information to the Director, Bureau of Licensing for review and decision.

Receives Director, Bureau of Licensing's decision and prepares specific letter to all parties involved in the assigned nuisance bar action, ensuring that objection letters are mailed timely in accordance with the Liquor Code.

Responds to applicant hearing requests by determining if sufficient justification exists to expedite a hearing; forwards appropriate correspondence notifying all parties having an interest in the non-renewal; determines which documents must be certified for hearing in lieu of testimony; prepares a case packet for Deputy Chief Counsel of all pertinent documents and information; and notifies Chief Counsel's Office of all law enforcement officials requiring a subpoena.

Reviews assigned case information from Chief Counsel's Office, determines the impact the Court decision has on the licensee's appeal and/or operation, and initiates appropriate action based on established procedures and the Court's decision.

Monitors assigned refusal cases currently under appeal for renewal activity; forwards a refusal status memorandum to the Director, Bureau of Licensing upon subsequent filing of a renewal application; and prepares appropriate letters for refusal cases where other applications are pending.

Prepares Board sheets for other applications as necessary for refusal cases.

Process assigned applications for transfer resulting in an Offer-in-Compromise or Conditional Licensing Agreement and ensure conditions are met.

Responds to a variety of questions from LCB personnel, attorneys, licensees, law enforcement representatives, and other interested parties relative to assigned nuisance bar cases.

Maintains a variety of manual and automated records on assigned cases, updating case status, maintaining listings of sources for the non-renewal candidates, and listing subsequent Board and Court action to said candidates.

Maintains Excel spreadsheet on Conditional Licensing Agreements (CLAs). Maintains contact with the Board's Legal bureau regarding status of CLAs. Provides Division Chief with status of CLAs.

The duties and responsibilities specific to ADLAD Board Case Unit performed by this position include the following:

Prepares resumes of complex cases for referral to upper-level management personnel for review and advise as to approval at the administrative level or referral to the governing board or hearing examiner. Resumes must contain all pertinent information and facts in order that accurate decisions can be made.

Reviews cases that require Board action to ensure that all of the pertinent facts are properly presented and discussed in the case resume for proper presentation to the Board; reviews and analyzes testimony and resumes prepared by a Hearing Examiner; determines if testimony agrees with the facts outlined in the Hearing Examiner's report; and prepares summaries of hearings and provides the Bureau's recommendation for Board review and final decision. Resumes are completed within deadlines set by the Board.

Reviews cases which have been appealed; determines the impact court decision will have on applicant/protestants appeals. Initiates proper actions based on established procedures and the court's decisions. Determines what applications, fees or appropriate action is required to satisfy the order set by the court.

Assists in the recording of the decisions rendered by the Board Members after a Board Session has been held.

Additional responsibilities will include assisting in special project such as becoming familiar with the processes of other licensing divisions and education and provide assistance to entities and individual inside and outside of ADLAD in an effort to improve efficiency.
