Position Purpose:

This position is located in the Bonding Section of the Division of Contracts, Procurement and Bonding, Bureau of Office Services. It is responsible for the review and evaluation of bonding for the Oil & Gas Management Program and related documents for the Department of Environmental Protection.

Description of Duties:

This position is responsible for the review of bonding-related documents for the Oil & Gas Management Program involving the analysis, review, acceptance, evaluation and accounting for surety and collateral penal bonds. Oversight also involves the approval, tracking and release of collateral/surety bonds, negotiable bonds, checks, certificates of deposit, letters of credit, and corporate guarantees for the Bureau of Mining Programs, the Bureau of Waste Management, and the Bureau of Waterways Engineering. The Bonding program is also responsible for the review of bonds relating to the Anthracite Emergency Bond Loan Fund, Government Financed Construction Contracts, and the Financial Guarantee, Bond Credit, Land Reclamation Financial Guarantee Programs.

Collateral/Surety Bonds

Receives reviews and analyzes all collateral/surety bonds and bonding forms for completeness and accuracy and determines compliance with bonding requirements as outlined by the DEP Office of Chief Counsel, General Law Division, and each program’s rules and regulations. Verifies that the bond documents conform with the permitting and licensing modules in eFacts. Confers with operators and their legal counsel, engineering consultants, brokerage firms, banks/surety agents and insurance companies and DEP District/Regional Offices concerning any issues and/or discrepancies.

Obtains current market quotes on negotiable bond instruments and assesses and verifies the market quotes against the collateral bond obligations. Notifies operators if additional bonding is required. Upon an operator’s request, documentation is prepared for State Treasury to use the proceeds from matured negotiable bond to purchase other negotiable(s) selected by the operator.

Verifies that all surety bonds written by a single surety company for a specific permit doesn’t exceed the maximum single risk established by the Commonwealth of Pennsylvania Insurance Department.

Submits bonds to the General Law Division for review of legality and form. Confers with the General Law Division when problems arise or when the operator or a bank/insurance company proposes procedures not in accordance with bonding guidelines and each program’s rule and regulations. . Prepares letters and returns any bond rejected by the General Law Division incorporating a description of the bond deficiency.



Transmits collateral to the State Treasury. Resolves any problems encountered with the collateral. Verifies that the State Treasury has returned all released collateral bonds and that all deposits have been received.

Monitors phased payments of collateral to ensure timely payments. Creates and maintains collateral/surety information in eFacts. Creates bond inventory reports and conducts bond audits at the request of operators and/or their legal counsel, engineering consultants, brokerage firms, banks, surety agents/companies and DEP District/Regional Offices.

Bond Releases

Receives, reviews, assesses and verifies the liability for releasing all or part of a bond applicable to a permit or designated phase of permit in accordance with each program’s rules and regulations. Also, reviews, verifies, and assesses documents for the release of liability and obligation of permits for adjustments, replacements, transfers/change of ownerships and completion reports for the Anthracite Emergency Bond Loan Fund, Government Financed Construction Contracts, and the Financial Guarantee, Bond Credit, and Land Reclamation Financial Guarantee Programs.

Releases collateral to an operator or bank through the Treasury Department.

Creates and maintains bond release information in eFacts. Creates bond inventory reports and conducts bond liability and obligation audits at the request of operators and/or their legal counsel, engineering consultants, brokerage firms, banks, surety agents/companies and DEP district/regional offices.

Other

Issues letter of credit cancellation notices and monitors cases until a bond is replaced or a letter of credit is presented for conversion.

Assists and advises staff members in District/Regional Offices regarding departmental bond policy by interpreting pertinent rules and regulation and general bonding guidelines and coordinates the bond processing among all offices. Updates and maintains bond forms.

Assists other bonding staff, when required, in their review, analysis and processing of collateral/surety bonds.

Provides support on assignments from the Bonding Manager and assists other staff on backlogs or priority work assignments.

Maintains and updates records, provides reports to programs and notifies them of policies and procedures.

Promotes the Department's mission.

Inputs appropriate data in a prescribed format to meet data quality standards set forth by guidance, training, and policy across all of DEP’s electronic data systems; to include ensuring accuracy and completeness of entries, and where available, the use of system specific tools to ensure duplicative entries and data quality issues are minimized.

Bond review work involves in-depth knowledge of the bonding and permitting requirements and regulations for each program. Decisions regarding discrepancies and/or acceptability of bonds or collateral are made at this level. Assistance is received from the Bonding Manager with complicated problems or significant changes to bond language, policies and/or procedures. Procedural changes related to the bonding processes are initiated at this level.
