Position Purpose:

This is professional work in the Storage Tank Section of the Environmental Cleanup & Brownfields Program. An employee in this job performs a variety of duties, within an assigned geographical area, to ensure compliance with the Commonwealth's rules and regulations governing underground storage tanks (UST), aboveground storage tanks (AST), and remediation.

Description of Duties:
Describe in detail the duties and responsibilities assigned to this position. Descriptions should include the major end result of the task. Example: Types correspondence, reports, and other various documents from handwritten drafts for review and signature of the supervisor.

Develops and recommends compliance strategies to deal with specific enforcement cases.
Researches case files and prepares case histories and documentation for use in the prosecution of cases by storage tank and legal staff.

Provides input, as needed, to supervisors and program managers for the prioritization of storage tank enforcement cases.

Conducts inspections, investigations, enforcement and survey activities at storage tank facilities. Also investigates and resolves complaints, and identifies responsible parties when appropriate.

Prepares documents such as, violation notices, Administrative Orders, Consent Orders and Agreements, Civil Penalties, Notices of Proposed Assessments and Consent Assessments that relate to compliance and enforcement scenarios.

Reviews violation letters administrative orders, consent orders & agreements; criminal complaints, documents used to prosecute cases, enforcement recommendations made by field personnel, and case volume to help program priorities.

Provides compliance assistance to facility owners and operators, local and state government agencies, and other DEP staff, as well as the general public, regarding all aspects of the storage tank program.

Calculates civil penalties for use in enforcement actions that include a civil penalty assessment.

Conducts enforcement meetings and conferences with the regulated community, including the negotiation of civil penalty settlements for storage tank violations.

Attends statewide compliance and enforcement meetings for the storage tanks program.
Coordinates compliance activities between the program and Office of Chief Counsel, including informal consultation with Department attorneys and briefings on cases referred for legal review.

Assists storage tank program Water Quality Specialists and Licensed Professional Geologists in resolving cases involving enforcement by reviewing Notices of Violation, documentation on compliance inspections, and other pertinent information on the facility.
Prepares Notices of Violation and Notices of Proposed Assessment for compliance and enforcement cases.

Assists in the preparation of news releases, weekly reports, Major Action Advisories, and other documents, as appropriate, related to Department enforcement activities.

Serves as an advisor to legal staff, and as an expert witness for the Department in litigation before the Environmental Hearing Board, as well as civil and criminal court.

Provides assistance and guidance to industry, consultants, and the regulated community relating to storage tank compliance and enforcement program issues.

Reviews and becomes familiar with federal and state legislation and regulations for UST and AST systems containing petroleum and hazardous substances.

Evaluates state legislation, guidance and regulation relating to storage tank compliance and enforcement issues for UST and AST systems containing petroleum and hazardous substances.

Reviews and evaluates policies, guidance, regulations and reports necessary to carry out an effective, comprehensive, statewide, UST and AST system closure assessment program.

Meets and converses with federal, state and local government officials; industry representatives; professional groups; consultants; the regulated community; Underground Storage Tank Indemnification Fund (USTIF) and the general public to explain the department’s legislation, regulations and policies as they relate to the storage tank compliance and enforcement program.

Attends meetings of committees, task forces and work groups to express the concerns of the storage tank program.

Coordinates enforcement activities with EPA and other DEP programs, when violations involve more than one program area.

Reviews and comments on proposed enforcement policies and strategies prepared by Central Office. Also briefs Central Office on enforcement activities involving controversial issues or cases, or ones that involve significant public concern.

Monitors and assesses storage tank compliance, enforcement and closure information maintained in eFACTS, and works with Central Office staff to attain a high degree of quality information.

Promotes the Department’s mission.

Inputs appropriate data in a prescribed format to meet data quality standards set forth by guidance, training, and policy across all of DEP’s electronic data systems; to include ensuring accuracy and completeness of entries, and where available, the use of system specific tools to ensure duplicative entries and data quality issues are minimized.

The immediate supervisor assigns specific assignments with time schedules and it is the compliance specialist's responsibility that they are completed. Work is reviewed through reports, conferences and staff meetings.
