Position Purpose:
Describe the primary purpose of this position and how it contributes to the organization’s objectives. Example: Provides clerical and office support within the Division to ensure its operations are conducted efficiently and effectively. 

This position administers the Citation Program for the Prosecution Division in the Professional Compliance Office (PCO), located in the Bureau Professional and Occupational Affairs' (BPOA). The citations are issued by the Bureau's inspectors, investigators and prosecutorial staff for various minor infractions. This position ensures the issued citations are in compliance with the Citation Program parameters.

Description of Duties:
Describe in detail the duties and responsibilities assigned to this position. Descriptions should include the major end result of the task. Example: Types correspondence, reports, and other various documents from handwritten drafts for review and signature of the supervisor.

• Analyzes each Citation, which is a departmental enforcement action and determines whether appropriate legal and regulatory requirements have been met.
• Identifies errors and discrepancies in Citations; determines and applies appropriate corrective action; consults with the Senior Prosecutors, Citation Liaison and/or supervisor as appropriate.
• Prepares and processes notification documents and tracks incoming payments of Citation fines; tracks Citation cases until final payment and/or case resolution.
• Directs the opening of new files for licensees in violation of Board Order for unpaid fines within timeframe.
• Takes appropriate action when hearings are requested.
• Assigns Citation hearing cases to prosecuting attorneys and provides files to prosecutors.
• Coordinates Citation Hearing Schedule with Prothonotary's Office.
• Is available to prosecutors during Citation Hearings as requested to assist prosecutors and resolve discrepancies.
• Withdraws Citations at direction of Prosecuting Attorneys; identifies legal errors and independently prepares "Notice to Withdrawal Citation" and prosecution evaluation.
• Prepares correspondence related to enforcement actions; notifies respondents of withdrawn Citations by letter.
• Prepares statistics regarding withdrawn Citations for internal use/training purposes.
• Reviews Orders, Default Judgment Orders and Judgment on the Pleadings issued by Hearing Examiners for discrepancies; notifies the Chief Hearing Examiner of discrepancies in Orders. Notifies Citation Liaison and supervisor of any new or unusual denials/dismissals.
• Closes Citation files on computer and enters discipline in the Bureau’s case management system.
• Prepares correspondence as directed.
• Responds to telephone and in-person inquiries from respondents, investigators and inspectors regarding Citation Program , citations and payments.
• Responds to inquiries on the Professional Compliance Office Hotline as needed.
• Inputs data and maintains active Citation files; processes closed files.
• Maintains the up-to-date Citation processing manual.
• Analyzes the citation process and suggests areas for improvement in processes and efficiency
• Serves as backup to the Legal Assistant 1 for MCARE matters.
• Performs other duties as assigned.

Essential Functions

 1. Reviews and analyzes incoming Citations for accuracy and consistency.
 2. Notifies proper authorities of in-house and field-issued Citation discrepancies, in writing.
 3. Notifies Prothonotary's Office of receipt of Citations, requests for hearings, closure of files.
 4. Processes incoming payments of Citation fines and monitors unpaid Citation fines and issues collection letters.
 5. Tracks Citation-related cases on LicensePA.
 6. Prepares statistics concerning withdrawn Citations.
 7. Attends all citation hearings to clear up discrepancies and assist Prosecutors.
 8. Prepares correspondence related to Citations and meets with respondents who visit with Citation-related inquiries or payments.
 9. Answers telephone inquiries regarding Citations and assists on Professional Compliance Office Hotline on a backup basis.
 10. Maintains up-to-date Act 48 procedures manual.
