Position Purpose: Describe the primary purpose of this position and how it contributes to the organization’s objectives. This position ensures the leadership team, management, and employees in DMVA comply with the rules and regulations of regulatory agencies, DMVA policies and procedures, and the Standards of Conduct. The position exists as a channel of communication to receive and direct compliance issues to appropriate resources for investigation and resolution. This position also manages the healthcare regulations portion of the DMVA compliance program. |

Description of Duties: Describe in detail the duties and responsibilities assigned to this position. Descriptions should include the major end result of the task. Example: Types correspondence, reports, and other various documents from handwritten drafts for review and signature of the supervisor. Acts as a part of an independent review team and evaluation body to ensure that compliance and ethics issues and concerns within the department are appropriately evaluated, investigated, and resolved. Completes compliance and ethics investigations in accordance with department procedures. Develops and implements appropriate resolutions. Writes policy recommendations, creates and implements training, and audits program office activities for compliance. Receives compliance issues and complaints from management and staff, from residents or resident family members, and other sources. Responds to the alleged violations of rules, regulations, policies, procedures, and Standards of Conduct by evaluating or recommending the initiation of investigation procedures. Develops and implements policies and procedures to meet compliance goals. Performs the investigation, monitoring, auditing, review, and analysis of general compliance and ethics matters to ensure adherence to regulatory and internal policies and guidelines. Determines policy needs and best methods for incorporation to maintain regulatory compliance based on investigation and audit findings, data and trend analysis, discussion with program offices, and regulatory changes. Collaborates with other staff and departments (Quality Assurance/Risk Management, Internal Audit, Employee Relations, Chief Counsel, National Guard Bureau, etc.) to direct compliance issues to appropriate existing channels for investigation and resolution as well as performs independent investigations. Monitors resolution progress to ensure timely and effective implementation. Supports veterans home QAPI efforts. Shares ideas for veterans’ home improvements related to QAPI, including adjusting policies and practices to standardize DMVA practices. Works with staff to develop correction plans to resolve and set precedent for emergent compliance vulnerabilities. Evaluates and communicates the need for Performance Improvement Projects. Works with Employee Relations staff to review and update Standards of Conduct to ensure up-to-date applicability to emerging situations. Collaborates with the Staff Development Specialists and HR staff to develop and deliver an effective compliance and ethics training program, including appropriate introductory training for new employees as well as ongoing training for all managers, supervisors, and employees both at all DMVA locations. Assists in the development of the agency Compliance and Ethics plan and trains agency staff on that plan. Assists with the development and delivery of effective compliance and ethics training at all DMVA locations. Promotes the prevention, detection, and resolution of instances of conduct that do not conform to federal or state law, as well as to internal policies, procedures, and program requirements. Provides input for the revision of policies and procedures for the general operation of the Program and its related activities to prevent illegal, unethical, or improper conduct. Participate in the corporate Compliance and Ethics committee by writing and establishing plans for policy and recommending approval to the board. Utilizes a data collection and management system for the compliance and ethics program. Analyzes data for trends, patterns, and compliance with policies and procedures. Assists in the development of the agency Compliance and Ethics plan and train agency staff on the plan. Remains cognizant of current and changing regulatory compliance requirements from federal and state agencies. Assists in maintaining an effective compliance communication program, including promoting (a) use of the Compliance Hotline; (b) heightened awareness of Standards of Conduct, and (c) understanding of new and existing compliance issues and related policies and procedures. Participates in the execution of Facility Performance Assessments (FPA) for DMVA locations. Acts as and/or assists the team leader for the FPA in identifying staff assignments and providing guidance on interpretation of rules and regulations. Obtains and maintains a valid certification as Certified in Healthcare Compliance (CHC) or Certified Compliance and Ethics Professional (CCEP) within 24 months of hire. Reviews proposed and revised legislature and provides comments for changes and compliance and ethics program impact. Attends periodic conferences with the Deputy for Administration, The Adjutant General, and senior management officials to provide updated information and discuss major changes to the regulatory environment or laws affecting long-term care as well as Compliance and Ethics in the commonwealth. Performs work in accordance with the DMVA general safety rules and safety rules for this position. Immediately reports all workplace injuries or incidents to the supervisor; and/or immediately corrects any safety hazards in the work area or reports same to the supervisor. Uses personal protective equipment when required such as gloves, masks, etc. Performs other related duties as required. **Must possess a valid federal or state-issued photo ID and pass a favorable NCIC screening for admittance to Fort Indiantown Gap.** |
