Position Purpose:

This position functions as a Management Technician in the Waterways and Wetlands Program and performs various administrative, technical and liaison duties and support related to NPDES/Chapter 102 Construction Stormwater Permits; and Environmental Protection/Watershed Protection Grant Program (Growing Greener) The employee is responsible for database and record management, reviewing, coordinating, and tracking permit applications and projects, and providing other Program support.

Description of Duties:
• Fulfills the duties of the Application Manager to ensure all required application items have been submitted in accordance with DEP Waterways and Wetlands Standards Operating Procedures (SOPs) for evaluating that the items are technically adequate and are sufficient for conducting a technical review, for the following application types: PAG02 General NPDES Construction Stormwater Discharges, Individual NPDES Construction Stormwater Discharges, Erosion and Sediment Control General Permits, Erosion and Sediment Control Individual Permits, Water Obstruction and Encroachment Joint Permits, Chapter 105 Environmental Assessments, Chapter 106 Floodplain Management Permits, Chapter 105 General Permits 01, 02, 03, 04, 05, 06, 07, 08, and 11. This includes applying rules and regulations related to the review of these applications to determine completeness, developing a final recommendation and action to be taken, writing the Factsheet or Review and Recommendations, and developing completeness notices. The duties of the determination will involve conducting technical and decision-making tasks, including but not be limited to:
o Interprets and understands the general requirements of permits and associated Chapter 102, 105, and 106 Regulations.
o Interpret maps and plan drawings to identify property boundaries, roadways, utilities, structures, limits of disturbance, and water resources (streams, rivers, floodways, floodplains, ponds, lakes and wetlands) using legends or other computer applications.
o Calculates proposed areas of earth disturbance using plan drawings, topographic maps, and aerial imagery.
o Determines proposed changes in impervious areas from project pre-construction conditions to post-construction conditions by comparing project descriptions, application worksheets, and plan drawings.
o Determines differences in conditions of project pre-construction to post-construction runoff volume for the 2-year/24-hour storm event for proposed project areas by comparing project descriptions to application worksheets.
o Determines if project proposals conform to standard designs for permit eligibility.
o Decides whether alternative designs for projects proposing “managed release concept” meet criteria for eligibility by comparing data reported on application worksheets to design standards.
o Discretionarily determines significance of application completeness deficiencies and decides if errors are insignificant or significant.
o Generates deficiency and denial letters to applicants citing the appropriate statutory or regulatory requirement(s) that were not met.

• Fulfills the duties of the Application Manager by determining eligibility for coverage and acknowledging coverage, in accordance with DEP Waterways and Wetlands Standards Operating Procedures (SOPs), by evaluating technical adequacy, identifying deficiencies, making the final determination, and documenting the review and decision on the appropriate Factsheet or Review and Recommendations form for renewal, minor modification, and transfers applications for the above referenced general permit types. The duties of the eligibility determination will involve conducting technical and decision-making tasks, including but not be limited to:
o Interprets and understands the requirements of the general permits and associated Chapter 102, 105, and 106 Regulations.
o Determines eligibility for coverage under General Permits based on the criteria of the specific permit type, including drainage areas, structure size, extent of water resource impact, and the regulations.
o Reviews and determines technical adequacy of General Information Forms (GIF), Act 14 notifications, facility type, and discharge locations identified on topographic maps, and any other criteria identified in the SOP or required as part of the application.
o Calculates watershed drainage areas and determines flow paths using PA StreamStats or other computer applications.
o Interprets maps and plan drawings to measures distances, structure sizes, and area of aquatic resource impacts using scales or other computer applications.
o Determines accuracy and adequacy of application maps, drawings, and drawing details.
o Consults with Program engineers and biologist on potential environmental impacts and engineering modifications identified within the application.
o Ensures complete and acknowledged clearances required by other agencies (PHMC and PNDI) for permit approval are obtained by permit applicants.
o Determines receiving surface water and water body classifications, designations, and listed impairments using eMAP and official publications and updates.
o Ensures completion and coordination of Submerged Lands License Agreement (SLLA) applications for consistency with program specific guidelines and requirements.
o Determines Client violation history that may affect issuance of the permit (per CSL Section 609) using eFACTS and verifying compliance history with compliance staff and case review, and document findings of non-compliance in the appropriate Factsheet or Review and Recommendations form.
o Generates eligibility deficiency and denial letters to applicants citing the appropriate statutory or regulatory requirement(s) that were not met.
o Coordinates with the Permitting Section Chief and Program Manager on requests for extensions to the application deficiency correction period. and prepares and issues response letters.
o Generates, approves, and acknowledges final permit documents.

• Fulfills the duties of the Application Manager, in accordance with DEP Waterways and Wetlands Standards Operating Procedures (SOPs), to conduct application tracking, review tasks, correspondence, and responses for all the above referenced permit types, including but not limited to:
o Monitors the program resource account for electronic submissions of permit applications and documents, creates shared electronic file folders for new submissions and modified applications, and creates and maintains electronic file folders with updated or revised submissions.
o Utilize DEP’s data systems to complete assignments and duties, as required.
o Creates eFACTS Clients, Sites, and Facilities for new, renewal, and modified permit applications.
o Analyzes permit processes and procedures and makes recommendations for improvement and efficiency.
o Provides support to the program in permit appeal proceedings.
o Ensures accurate and complete documentation submittal for NPDES Permit Notice of Termination actions and completes NPDES permit terminations in eFACTS.
o Prepares and submits Pennsylvania Bulletin project descriptions for receipt of applications, draft permits, and permit decisions for the above reference permits.

• Implements PAyback Policy for the Program including but not limited to:
o Generates and reviews permit application status reports from Power BI for data accuracy and completeness, identifies and resolves errors and deficiencies between eFACTS tasks and application review status, advises the Program Manager of potential problems in completing application reviews within established timelines.
o Researches application submittal and review timelines to determine if applicants are eligible for permit application fee refunds.
o Makes final recommendation to approve or deny requests for refunds under the PAyback policy and prepares record of decision for the Program Manager approval.
o Trains and advises program staff on PAyback policies and practices.

• Fulfills duties to ensure compliance with the Records Management and Retention Policy to include, but not limited to:
o Reviews, organizes, and prepares paper and digital files and documents, creates start sheets for scanning, and archiving in OnBase.
o Coordinates receipt of paper and digital files and documents from delegated conservation districts, reviews files for accuracy with retention requirements, and uploads files to OnBase in accordance with program procedures.
o Trains and advises program and delegated conservation district staff on records management policies, systems, and retention schedules.
o Interact as necessary with DEP Regional and Central Office staff, Regional file room staff, and the Office of Chief Counsel to address and ensure compliance with regional files retention requirements.

• Serves as the Waterways and Wetlands Program Informal File Reviews (IFR) and Right to Know Law (RTKL) coordinator. These duties include, but are not limited to:
o Develops procedural guidance and analyzing data to identify and prioritize requests to ensure that response time are met.
o Develops Program procedures to improve file management and efficiency in responding to IFR and RTKL requests.
o Receives program requests for public records submitted as an IFR and under the RTKL, documents and tracks requests, coordinates with program staff, and compiles complete and timely responses.
o Searches and retrieves paper and electronic files, CTS, eFACTS, and other electronic databases for documents responsive to IFR and RTKL request.
o Determine if program documents require attorney review in accordance with RTKL, IFR, Confidentiality and Program Records Retention Policy.
o Coordinates with Records Management Center staff and Office of Chief Counsel to ensure complete and proper record production from the program.

• Assists the Program Manager with overall Program management, implementation, and process improvement to include, but not limited to:
o Assists with developing the Program’s operating budget for staff equipment, vehicles, office supplies, software, and other program expenditures, monitors the current budget and adjusts spending to keep it on track, drafts future budgets by identifying needs and estimating the associated costs, and maintain inventories.
o Coordinates and tracks program ordering of special software, staff equipment, and program supplies.
o Prepares and submits electronic purchase requests to the regional Business Office.
o Manages litigation holds for the program by coordinating the collection and preservation of Program documents for legal cases including preparing documents for legal review and discovery.
o Coordinates and schedules preapplication meetings through direct requests or the Permit Application Consultation Tool, and participates in preapplication meetings to identify any additional Waterways and Wetlands Program permits potentially required for the project and to provide an explanation of the Permit Review Process (PRP) and review timelines.
o Organize and participates in public hearings/meetings for assigned projects, including local paper notifications and the coordination/logistics for public hearing/meeting location(s). Develops and implements processes to increase Program efficiency.
o Communicates and supplies information on the laws, regulations, and requirements of the Water Program to consultants, local officials, and citizens.
o Communicates with the regulated community and public to answer questions and assist with permit applications, file reviews, and reports required under permit approvals.

• Inputs appropriate data in a prescribed format to meet data quality standards set forth by guidance, training, and policy across all of DEP’s electronic data systems; to include ensuring accuracy and completeness of entries, and where available, the use of system specific tools to ensure duplicative entries and data quality issues are minimized.

The position is principally an office position with limited field work. However, occasional meetings and site reviews may be necessary as part of carrying out the duties of the position. Additionally, meeting and training may occasionally require overnight travel.
The position involves considerable contact (telephone, letters, meeting, and emails) with municipal officials, applicants (property owners, business owners, etc.), developers, consulting engineers, and other regulatory agencies.

The employee reports to the Program Manager. The employee is allowed considerable independence to complete the required duties pursuant to the statutes, regulations, guidance, policies, and standard operating procedures. Performance is reviewed through oversight of work products, meetings, and discussions with the Program Manager. Types of decisions made by the incumbent include:

1. Evaluates permit applications and decides whether items are technically adequate and meet requirements and standards and makes recommendations for decisions on permit applications. Completed work is reviewed by the Program Manager, or designee, for technical accuracy, documentation, thoroughness, and consistency with statewide objectives.

2. Work assignments are given with general instruction with moderate supervision. The employee is responsible for independently selecting and interpreting applicable guidelines. The employee normally has the authority to make technical decisions within the assigned scope of responsibility, but program goals, priorities, and administrative policy matters emanate from a higher level.

3. Letters, reports, and other work products are routinely reviewed by the Program Manager, or designee, to ensure compliance with technical standards, Department policy, and adequacy of results.
