Position Purpose:
Describe the primary purpose of this position and how it contributes to the organization’s objectives. Example: Provides clerical and office support within the Division to ensure its operations are conducted efficiently and effectively. 

This position is responsible for directing the compliance program to ensure that Pennsylvania’s employers have the required workers’ compensation insurance to protect workers injured in the course and scope of employment.

Description of Duties:
Describe in detail the duties and responsibilities assigned to this position. Descriptions should include the major end result of the task. Example: Types correspondence, reports, and other various documents from handwritten drafts for review and signature of the supervisor.

Plans, organizes, and directs the activities relating to the BWC Compliance program’s verification of compliance with the insurance requirements of the PA Workers’ Compensation Act.

Develops, implements, and maintains policies and procedures relating to compliance investigation activities, criminal prosecutions, 1610 assessments and stop work orders.

Develops, implements, and maintains policies and procedures relating to the exemption applications, identification of employers who fail to insure their workers’ compensation liabilities for referral to the Office of Chief Counsel for criminal prosecution, and relating to workers’ compensation fraud or child labor law violations relating to minor work injuries.

Coordinates the collection of funds, expended by the Uninsured Employers’ Guaranty Fund to pay injured workers’ claims, from employers who failed to have the requisite insurance with the UEGF Manager.

Develops, implements, and maintains policies and procedures relating to outreach efforts to educate Pennsylvania employers on their responsibilities under the Act, including providing instruction to insurance and adjusting company representatives, employers, labor unions, attorneys, and others regarding compliance provisions of the Workers' Compensation Act. This information is provided through presentations at speaking engagements and the development and distribution of written instructional material.

Plans, organizes, and directs the work of investigative, collections, outreach, and clerical personnel. Assigns work as needed, clarifies policies and procedures.

Manages Compliance processes in WCAIS, identifies enhancements and defects in WCAIS processes and oversees implementation of corrective measures via proper methodology.

Recommends and oversees the implementation of compliance operating procedures and policy changes to the Director.

Develops, implements, and maintains policies and procedures relating to collaboration with other L&I bureaus, PA state agencies and the Pennsylvania Ratings Bureau to promote investigative efforts and identification of non-compliant employers.

Drafts changes to the compliance regulations and to proposed legislation relating to compliance when requested by the Bureau Director. Such changes reflect analysis of other state’s regulations, policies and law, comments from those involved in compliance and workers’ compensation.

Performs research by reviewing the Workers’ Compensation Act, its regulations, other pertinent statutory or regulatory authority, analyzes the facts in accordance with applicable laws and regulations and summaries of relevant case law, makes determinations concerning statutory and regulation changes to improve the PA WC system.

Reviews, approves, drafts, or directs the drafting of communications as warranted including compliance forms, WCAIS web pages, external communications, WCAIS notifications, and News and Notes communications. Forwards such documents to proper authorities for review, approval, and production.

Prepares compliance reports, including statistical reports for executive leadership, and in response to legislative inquiries.

Resolves problems, complaints and eliminates program barriers with staff, executive staff, employers, and all Bureau stakeholders.

Speaks at conferences, meetings, and educational seminars on workers’ compensation and on compliance requirements and procedures.

Oversees the development and delivery of training materials and seminars for internal and external stakeholders relating to the compliance processes.

Develops, implements, and maintains policies and procedures relating to preservation of section’s records in coordination with the agency coordinator.

Testifies as a witness for the Commonwealth and before administrative bodies, quasi-judicial boards and the courts as warranted.

Performs the full range of supervisory duties.

Travels as warranted to sites across the Commonwealth using state pool vehicle.

Performs other related duties as required.

Decision Making:
Describe the types of decisions made by the incumbent of this position and the types of decisions referred to others. Example: In response to a customer inquiry, this work involves researching the status of an activity and preparing a formal response for the supervisor’s signature.

Work is performed with considerable independence and is reviewed by the AO3 and the Bureau Director for program effectiveness and conformance with established statutes, regulations, and policies. This position directs a program which holds employers accountable for fulfilling their insurance obligations under the PA Workers’ Compensation Act. The incumbent makes decisions relating to WCAIS, investigation operations, outreach operations and collections operations. Determines when enforcement activity is appropriate and begins activities. The incumbent reviews proposed legislation and prepares comments for the bureau director when requested. This position develops, maintains, updates, and implements compliance policies and procedures.
