This position is primarily responsible for the Department’s compliance of Chapter 102, Earth Disturbance; Chapter 105, Water Obstruction and Encroachment; Chapter 91, Water Quality protection; Dam Safety and Encroachment Management Act and the Clean Streams Law. |

Description of Duties: Describe in detail the duties and responsibilities assigned to this position. Descriptions should include the major end result of the task. Example: Types correspondence, reports, and other various documents from handwritten drafts for review and signature of the supervisor. These responsibilities would be carried out pursuant to the Department’s policies, procedures, techniques, rules, and regulations pertaining to, but not limited to, the Clean Streams Law, Dam Safety and Encroachment Act, and Federal Clean Water Act including: · Exhibits expertise in Chapter 102, Chapter 105, Chapter 91, Chapter 92, PA Dam Safety and Encroachment Act and the PA Clean Streams Law. · Assists Conservation Districts and DEP staff in achieving compliance by accompanying field staff during site inspections and meetings. · Assists in achieving voluntary compliance by making courtesy telephone calls to violators when requested by the Conservation Districts and/or DEP staff. · Exhibits expertise and sound discretion in executing field Compliance Orders requested by Conservation District and/or DEP staff. · Reviews Chapter 102, Chapter 105, Chapter 91, and agricultural water quality compliance referrals submitted by Conservation District and DEP staff for completeness and accuracy prior to sending Notices of Violation or scheduling compliance meetings. · Prepares and delivers Notices of Violation, prepares for and schedules compliance meetings, and completes Consent Assessments and Consent Orders and Agreements in accordance with timeframes agreed upon by the Conservation Districts and DEP and within estabilished procedures and timeframes. · Serves as facilitator during compliance meetings for Chapter 102, Chapter 105, Chapter 91, and agricultural water quality violation cases referred to DEP for enforcement. Assists and trains Level III Conservation Districts in their compliance meetings. · Calculates civil penalties in accordance with Chapter 102, Chapter 105 and water quality program matrices and negotiates settlements to resolve violations. · Maintains and reviews compliance records. Tracks compliance and penalty schedules and requests timely follow-up inspections to determine compliance with schedules. · Inputs necessary data regarding compliance cases in eFACTS as required in a timely manner within established timeframes. · Informs other programs or agencies of enforcement actions when violations involve other program issues. · Participates in training of Conservation District and DEP staff regarding Chapter 102, Chapter 105, Chapter 91, and agricultural water quality compliance issues. · Assists in the evaluation of Chapter 102 and Chapter 105 compliance efforts demonstrated by the Conservation Districts. · Testifies as an expert witness in enforcement cases before District Magistrates, the Environmental Hearing Board, Commonwealth Court or other formal court proceeding. · Prepares written reports in conformance with state and federal program guidelines. · Establishes and maintains a cooperative working relationship with the Office of Chief Counsel, County Conservation District staff, other Department personnel, and other local, state, and federal agencies in the coordination of the enforcement program. · Determines when a Major Action Advisory (MAA) is required and drafts MAAs for review by supervisor and regional counsel. Submits MAA to Regional Director as requested by supervisor. · Coordinates with and briefs Regional and Central Office personnel on MAAs and other activities involving press releases, controversial, significant public concerns or political issues. · Reviews and comments on proposed enforcement policies and strategies prepared by Central Office. · Employee will input necessary data into Departmental tracking systems to accurately reflect work performed during specified time periods. 1. Advances DEP’s strategic priorities through collaboration, commitment to data-driven decision-making, delivery of high-quality customer service, and active participation in modernization and continuous improvement initiatives. 3. Inputs, maintains, and updates data in prescribed formats to meet data quality standards established through guidance, training, policy, and procedure across all DEP electronic data systems. Responsibilities include ensuring the accuracy, completeness, consistency, and integrity of all entries, as well as utilizing available system tools and validation processes to minimize duplicate records and data quality issues. This includes eFACTS, PUP, ePermitting and other applicable systems. 4. Complies with all applicable laws, regulations, policies, procedures, guidance, and training requirements related to assigned duties and DEP electronic data systems. 5. In conjunction with the supervisor, participates in knowledge management and knowledge transfer efforts by identifying key aspects of assigned duties and proactively sharing knowledge with other employees to support continuity of operations and organizational effectiveness. 6. Develops, maintains, and annually updates a comprehensive desk manual documenting essential duties, standard operating procedures, workflows, system processes, key contacts, reference materials, and other critical operational information necessary to support continuity of operations and effective knowledge transfer. Employees are responsible for ensuring desk manuals remain accurate, current, and accessible in accordance with Department requirements. Decision Making: Describe the types of decisions made by the incumbent of this position and the types of decisions referred to others. Example: In response to a customer inquiry, this work involves researching the status of an activity and preparing a formal response for the supervisor’s signature. Supervision is provided by the Conservation, Restoration & Inspection Section Chief who along with the Program Manager provides assistance and/or guidance on difficult individual problems. Work is assigned by areas of broad expertise with little or no instructions. The employee is responsible for establishing completion schedules, priorities, and final resolutions within established program guidelines. Work is reviewed upon completion by the Section Chief for completeness, technical accuracy and quality. Written evaluations of work performace occur annually, or more frequently as necessary. |
