Position Purpose: Describe the primary purpose of this position and how it contributes to the organization’s objectives. Example: Provides clerical and office support within the Division to ensure its operations are conducted efficiently and effectively. This position functions as an Environmental Protection Compliance Specialist for the Waterways & Wetlands Program in the Southcentral Region. This position coordinates enforcement actions as necessary to maintain compliance with the laws, rules and regulations the Program administers, including: Chapter 102, Erosion and Sediment Control; Chapter 105, Water Obstruction and Encroachment; Chapter 91, Water Quality Protection; Chapter 92a, National Pollutant Discharge Elimination System (NPDES) Permitting, Monitoring and Compliance; the Dam Safety and Encroachment Management Act; The Clean Streams Law; and the Administrative Code of 1929. In addition to the Program’s traditional construction-related workload, this position also supports increased compliance activities in the agricultural sector—including supporting and, as necessary, providing increased field presence for additional inspections and complaint investigations of permitted (ie—Concentrated Animal Feed Operations, CAFOs) and non-permitted agricultural operations. |

Description of Duties: Describe in detail the duties and responsibilities assigned to this position. Descriptions should include the major end result of the task. Example: Types correspondence, reports, and other various documents from handwritten drafts for review and signature of the supervisor. This Compliance Specialist is generally responsible for coordinating the compliance and enforcement activities within the 15-county DEP Southcentral Region for programs under the jurisdiction of the Waterways & Wetlands Program. Program responsibilities are primarily non-point source and NPDES activities. These activities include but are not limited to non-point source discharges and activities, erosion and sedimentation control, groundwater contamination from agricultural sources, manure spills, agricultural use of farm process water, manure run-off, and silage discharges. This Compliance position will also conduct routine inspections, investigations, and related compliance work in the CAFO/agricultural non-point source activities and the Chapter 105-Waterways and Wetlands program. The associated duties and responsibilities are as follows: · Exhibits expertise in Chapter 102, Chapter 105, Chapter 91, Chapter 92a, PA Dam Safety and Encroachment Act, The Clean Streams Law, and the Administrative Code of 1929. · Assists Conservation Districts and DEP staff in achieving compliance by accompanying field staff during site inspections and meetings. · Assists in achieving voluntary compliance by making courtesy telephone calls to violators when requested by the Conservation Districts and/or DEP staff. · Exhibits expertise and sound discretion in executing field Compliance Orders requested by Conservation District and/or DEP staff. · Reviews Chapter 102, Chapter 105, Chapter 91, Chapter 92a, and agricultural water quality compliance referrals submitted by Conservation District and DEP staff for completeness and accuracy prior to sending Notices of Violation or scheduling compliance meetings. · Prepares and delivers Notices of Violation, prepares for and schedules compliance meetings, and completes Consent Assessments, Consent Orders and Agreements, and Administrative Orders in accordance with timeframes agreed upon by the Conservation Districts and DEP and within established procedures and timeframes. · Serves as facilitator during compliance meetings for Chapter 102, Chapter 105, Chapter 91,92a, and agricultural water quality violation cases referred to DEP for enforcement. Assists and trains Level III Conservation Districts in their compliance meetings. · Calculates civil penalties in accordance with Chapter 102, Chapter 105, agricultural, and water quality program matrices and negotiates settlements to resolve violations. · Maintains and reviews compliance records. Tracks compliance and penalty schedules and requests or conducts timely follow-up inspections to determine compliance with schedules. · Inputs necessary data regarding compliance cases in state and federal tracking systems as required in a timely manner within established timeframes. · Informs other programs or agencies of enforcement actions when violations involve other program issues. · Participates in training of Conservation District and DEP staff regarding Chapter 102, Chapter 105, Chapter 91, Chapter 92a, and agricultural water quality compliance issues. · Assists in the evaluation of Chapter 102 and Chapter 105 compliance efforts demonstrated by the Conservation Districts. · Testifies as an expert witness in enforcement cases before District Magistrates, the Environmental Hearing Board, Commonwealth Court or other formal court proceeding. · Prepares written reports in conformance with state and federal program guidelines. · Establishes and maintains a cooperative working relationship with the Office of Chief Counsel, County Conservation District staff, other Department personnel, and other local, state, and federal agencies in the coordination of the enforcement program. · Determines when a Major Action Advisory (MAA) is required and drafts MAAs for review by supervisor and regional counsel. Submits MAA to Regional Director as requested by supervisor. · Coordinates with and briefs Regional and Central Office personnel on MAAs and other activities involving press releases, controversial, significant public concerns or political issues. · Reviews and comments on proposed enforcement policies and strategies prepared by Central Office. Takes, investigates, and works to resolve Ch. 102, Ch. 105, agricultural, or other applicable environmental complaints submitted to the DEP. · Employee will input necessary data into Departmental tracking systems to accurately reflect work performed during specified time periods. · Promotes the Department's mission. · Inputs appropriate data in a prescribed format to meet data quality standards set forth by guidance, training, and policy across all of DEP’s electronic data systems; to include ensuring accuracy and completeness of entries, and where available, the use of system specific tools to ensure duplicative entries and data quality issues are minimized. · Exhibits proficiency in wetlands identification, i.e.: presence/absence determinations, or has the ability to become and maintain proficiency in wetlands identification. · Possess and maintain a valid Real ID or passport. Other Related Duties • Attend conservation district board meetings, including night meetings, as assigned to provide efficient communications and operation of delegated Department and State Conservation Commission programs, and to ensure the SCRO maintains consistency and provides services to the county conservation districts in accordance with the DEP/SCC MOU. • Assume responsibility for the Conservation, Restoration & Inspection Section during the absence of the Section Chief when so assigned. • Receive and process Clean Water Fund or Dams and Encroachments Fund payments with clerical assistance. • Prepare routine correspondence. * Operate a motor vehicle to travel to various field sites.
