Position Purpose:

This position is responsible for special education policy work any of the duties outlined in the description of duties below.

The administration, management and operation of the Compliance Monitoring and Planning Divisions will focus on the provision of advisory and consultative services to school districts and intermediate units in the planning, monitoring, improvement and evaluation of special education programs and services in the Commonwealth of Pennsylvania. Specifically, the divisions are charged with the following primary duties: (1) The management of a system for investigation of consumer complaints as required by federal regulations, (2) Conducting cyclical monitoring in local education agencies, (3) Review and approval of intermediate unit and school district special education plans to ensure that a full range of services are being provided for students with disabilities and (4) Management of other statewide functions and/or duties as designated.
The Special Education Adviser within the Compliance Monitoring and Planning Divisions will serve as a single point of contact with their assigned intermediate unit(s) and member districts. Advisers may be asked to focus on any one of the duties outlined below.

1. Investigates and follows-up on complaints filed against school districts as required by Federal Regulations and Court Orders.

2. Negotiates, approves, and verifies the implementation of corrective action plans resulting from any findings of non-compliance.

3. Serves as Chairperson of compliance monitoring visits to designated districts within assigned intermediate units by conducting activities set forth by the compliance monitoring system manual including pre-monitoring arrangements, on-site activities, preparation of preliminary reports, and review and approval of the final report.

4. Conducts target monitoring reviews as assigned by the Director of the Bureau of Special Education.

5. Serves as plan liaison for assigned school districts by completing the following tasks:

- Reviews and recommends approval or disapproval of school district and intermediate unit special education plans and plan revisions.
- Provides guidance and assistance in the interpretation of Federal and State Laws, Regulations, and Standards.

6. Assists in the development and revisions of statewide systems for cyclical monitoring, complaint management and plan review.

7. Reviews and recommends to the designated Division Chief approval or disapproval of waivers on caseload.

8. Monitors the implementation of court decisions and decrees.

9. Collects data as required during work stoppages at the local education agency and approved private schools.

10. Maintains current information on Federal Statutes, Regulations, Case Law, Commonwealth Laws, Regulations, Standards, and Policy that pertains to the education of students with disabilities and including the following if assigned by Bureau Director, Assistant Director, or Division Chief.
-assist in policy interpretation of IDEA and State regulations pertaining to students with disabilities
-assist in questions/answers pertaining to federal and state regulations
-assist in the development and submission of the IDEA-B grant application

11. Participates in public meetings organized for the improvement of programs and services for students with disabilities.

12. Completes written task assignments as requested by the Director, Assistant Director, or Division Chief.

13. Maintains necessary written documentation related to the regional assignment.

14. Demonstrates proficiency in the operation of equipment required in the performance of the duties of the position.

15. Works in collaboration with other divisions, bureaus, departments, and agencies as required to respond to concerns regarding special education services.

16. Participates in required training and presentation activities, as assigned, with local school districts, IUs, and regional technical assistance centers.

17. Maintains current knowledge of Alternate state assessment (PASA) of students with disabilities and including the following if assigned by Bureau Director, Assistant Director or Division Chief.
-review federal 1% waivers
-share assessment accommodations with parents and LEAs
-participation in PASA monitoring

18. Maintains current knowledge of the federally required State Performance Plan (SPP) and Annual Performance Reports (APR) and including the following if assigned by Bureau Director, Assistant Director, or Division Chief.
-collects status reports of assigned LEAs regarding compliance /improvement activities, fiscal responsibility and timely and accurate reporting as well as other concerns.
-assist in preparation and submission of the SPP/APR
-acts as a liaison between the Office for Special Education Programs (OSEP) and the Bureau of Special Education (BSE).

19. Travels as required, to participate in job responsibilities both in-state and out-of-state.

20. Performs other duties as may be assigned by the Secretary, Deputy Secretary for Elementary and Secondary Education, Bureau Director, Assistant Bureau Director, or Division Chief.
