Position Purpose:

The Environmental Protection Compliance Specialist for the Southeast Region is generally responsible for expediting the compliance and enforcement activities within Bucks, Montgomery, Chester, and Delaware Counties for all matters within the purview of the Pennsylvania Air Pollution Control Act.

Description of Duties:
Describe in detail the duties and responsibilities assigned to this position. Descriptions should include the major end result of the task. Example: Types correspondence, reports, and other various documents from handwritten drafts for review and signature of the supervisor.

• Maintain, generate and/or review compliance records:
eFACTS/AIMS databases which lists all inspections, NOVs, summary actions, civil penalty actions, orders, consent order and agreements, consent assessments and their disposition.

A system for tracking compliance due dates.

Compliance histories.

Periodic reports reflecting compliance with various policies.

• Individual Case Development:

Receive referrals for civil penalty from the Operations Chief.

Research files to establish a case history.

Evaluate evidence available, legal aspects of the case and any special circumstances.

Discuss violations with inspectors and supervisors to gain a firm understanding of the case.

Coordinate follow-up investigatory and monitoring activities.

If necessary, make on-site inspections.

Based on a thorough evaluation, determine an appropriate course of action for obtaining compliance and suggest corresponding penalties.


• Inter-Agency Coordination - DEP

Air Quality Central Office
Provide information regarding compliance activities, including a monthly enforcement report. Review and comment on proposed policies and guidelines. Discuss aspects of enforcement cases, as required.

Regional Office
Coordinate compliance activities with BWQM and BWM in cases where there is an interface.

Department Attorneys
Draft criminal actions, settlements and orders for legal counsel approval. Consult with attorneys on specific legal aspects of a case. Keep attorneys advised of developments in cases referred to them.

Schedule and chair enforcement conferences in cases of continuing violations and pollution incidents where penalties and compliance schedules will be negotiated. Arrange for key staff members to attend.

Prepare a summary of the conference outcome.

Consent Order and Agreements
Prepare in draft form the basic negotiated terms which generally include civil penalties and a compliance schedule and send to legal counsel through the Operations Chief for review.

Monitor compliance and if stipulated penalties are included, assess penalties for violations.

4) Consent Assessment of Civil Penalty

Prepare draft and send final copy of the CACP to the facility after negotiating the terms of settlement. The CACP generally includes factual findings and penalty assessments for violations. Those providing for penalties in excess of $10,000 are prepared in draft form and sent to counsel for review prior to sending out.

5) Administrative Order/Assessment of Civil Penalty

Prepare Compliance Order/Assessment of Civil Penalty actions in draft form for approval by legal counsel through the Operations Chief. These are appealable documents and therefore must be factually and legally accurate. In the event of an appeal to the Environmental Hearing Board, assist legal counsel in preparing evidence and interviewing witnesses. Monitor compliance with Compliance Orders/Assessments of Civil Penalties, EHB adjudications and initiate follow-up action as necessary.

6) Civil Penalty Actions

Prepare detailed case summary and a recommendation for proceeding with a civil penalty action and send to legal counsel through the Operations Chief accompanied by a draft enforcement document. Due to the likelihood of such a case going to hearing, it is critical that the information be very accurate and sufficient supporting documentation be available. In the event of a hearing, you may be required to testify.

Prepare a case summary and send to legal counsel through Operations Chief along with draft criminal complaint for review.

In the event a hearing is requested, organize the evidence, obtain and prepare witnesses and act as prosecutor for the Commonwealth in the District Justice's court. In this capacity, knowledge and familiarity with legal argument and courtroom proceedings is important, particularly since the defendant is generally represented by an attorney.

Prepare a detailed case summary and send to legal counsel through the Operations Chief along with a draft complaint for review. Testimony may be necessary in a Court of Common Pleas.

Draft criminal actions, settlements and orders for review and approval by attorney as delineated above.

Consult with attorneys on specific legal aspects of a case.

Keep attorneys advised of developments in cases referred to them.

Inputs, maintains, and updates data in prescribed formats to meet data quality standards established through guidance, training, policy, and procedure across all DEP electronic data systems. Responsibilities include ensuring the accuracy, completeness, consistency, and integrity of all entries, as well as utilizing available system tools and validation processes to minimize duplicate records and data quality issues.

Complies with all applicable laws, regulations, policies, procedures, guidance, and training requirements related to assigned duties and DEP electronic data systems.
In conjunction with the supervisor, participates in knowledge management and knowledge transfer efforts by identifying key aspects of assigned duties and proactively sharing knowledge with other employees to support continuity of operations and organizational effectiveness.

In coordination with other Compliance Specialists, develops, maintains, and annually updates a comprehensive desk manual documenting essential duties, standard operating procedures, workflows, system processes, key contacts, reference materials, and other critical operational information necessary to support continuity of operations and effective knowledge transfer. Employees are responsible for ensuring desk manuals remain accurate, current, and accessible in accordance with Department requirements.

Environmental Group Manager and Program Manager's concurrence is obtained prior to finalizing penalties and enforcement strategies. However, the majority of my work is carried out independently. Draft agreements are reviewed by the Environmental Group Manager, Program Manager and sometimes by legal counsel, before being sent to the company.
