Position Purpose: Describe the primary purpose of this position and how it contributes to the organization’s objectives. Example: Provides clerical and office support within the Division to ensure its operations are conducted efficiently and effectively. The Office of Small Business Advocate’s mission is to ensure that small businesses throughout the Commonwealth of Pennsylvania have safe, reliable, affordable, and quality utility service. As the only office of its kind in the nation, the OSBA represents the interests of small business consumers with 250 employees or fewer, in regulated utility matters before the Pennsylvania Public Utility Commission (PUC), federal regulatory agencies, and state and federal courts. The OSBA also works closely with small businesses to assist with concerns they may experience with water, wastewater, gas, and electric and telecommunication services. The Deputy Small Business Advocate will play a vital role in supporting and advising the Small Business Advocate, ensuring the smooth execution and success of case litigation and mission-related initiatives. This position enhances the Office of Small Business Advocate’s leadership presence in the energy and utility sectors at local, state, and national levels. |
Description of Duties: Describe in detail the duties and responsibilities assigned to this position. Descriptions should include the major end result of the task. Example: Types correspondence, reports, and other various documents from handwritten drafts for review and signature of the supervisor. Supervises, directs, and coordinates the work of attorneys and legal staff to execute OSBA’s mission, vision, and position in legal matters. Represents the OSBA in litigation before the Public Utility Commission, appellate courts, and in administrative proceedings. Directs, coordinates, and assigns case assignments to expert witnesses including guidance on submission of all testimony, motions, and briefs. Identifies and recommends issues to be litigated in coordination with the Senior Attorney and Small Business Advocate. Develops and provides support in coordination with the Small Business Advocate of implementation of statewide small business programs, policies, and protections. Advises and assists Small Business Advocate with advancing policy priorities including drafting of legislation, rulemakings, and legislative comments. Reviews, analyzes, and remains current on Public Utility Commission, Federal Energy Regulatory Commission (FERC), Federal Communications Commission (FCC), and appellate court decisions on public utility and administrative law issues. Participates in working groups, investigations and other proceedings convened by stakeholders to provide feedback on policies and regulations. Collaborates with the Executive Director to prepare and present case analyses, legal case summaries, utility assessments and annual reports. Supports and provides direction with the implementation and management of internal organizational systems and software. Offers direct support and representation for the OSBA; assigning attorneys and legal staff to meetings, events, legislative hearings, committees, associations, town halls, and other gatherings, as directed by the Small Business Advocate. Travel is required. Collaborates with Executive Director in managing expert witness contracts. Attends, manages, and maintains all attorneys continuing legal education courses and reviews legal subscriptions. Manages legal caseload as needed. Assigns, identifies, and assigns attorneys for participation at events, townhalls, conferences, etc. Performs additional related tasks as assigned. |
