Position Purpose:
Describe the primary purpose of this position and how it contributes to the organization’s objectives. Example: Provides clerical and office support within the Division to ensure its operations are conducted efficiently and effectively. 

This is a professional position within the Safe Drinking Water (SDW) Program. An employee in this position performs a variety of duties, within an assigned Environmental Protection Region, to ensure compliance with SDW rules, regulations and polices governing environmental and public health protection. Work involves performing compliance assistance activities, tracking and assessing compliance and reviewing and preparing formal enforcement actions. Work also involves conducting Filter Plant Performance Evaluations (FPPEs), processing subsidiary water allocation permits, assisting with inspection backlogs, managing regional sampling reagents, fixatives, calibration standards, manages emergency response sampling kit supplies, providing training and technical assistance to field personnel, the regulated community and the public on SDW rules, regulations and policies.

Description of Duties:

1. Tracks and assesses compliance with SDW rules, regulations and policies as per the Program’s compliance and enforcement strategy and guidelines for identifying, tracking, and resolving violations in order to protect public health and prevent public
water systems from reaching significant non-compliance status.

2. Develops and delivers focused trainings related to priority SDW regulations in order to improve compliance and reduce the occurrence of public health based violations. Provides technical assistance to Department field personnel, the regulated
community, and the public regarding accurate and consistent interpretation and application of SDW rules, regulations and procedures, and on the SDW Program’s compliance and enforcement strategy.

3. Conducts Filter Plant Performance Evaluations (FPPEs), processes subsidiary water allocation permits, conducts inspections to assist with backlogs, manages regional sampling reagents, fixatives, calibration standards, and assures emergency response
sampling kits are adequately stocked with valid reagents and glassware.

4. Conducts an evaluation of the compliance and enforcement program within an assigned area. Prepares a report of recommendations based on the evaluation. Provides advice to field personnel and the regulated community on the interpretation
and application of rules, regulations and policies governing environmental and public health protection.

5. Performs compliance assistance activities, such as writing articles for a SDW newsletter, to educate the regulated community about SDW rules, regulations and policies and improve compliance rates.

6. Reviews and prepares formal enforcement actions, such as Notices of Violation, Orders, and Consent Assessments of Civil Penalty, Assessments of Civil Penalty, Administrative Orders, and Consent Orders/Agreements, indicating violations discovered,
corrective action required, control measures to be installed, time frames for their accomplishment, and established penalties.

7. Testifies as an expert or material witness in enforcement cases before District Magistrates, the Environmental Hearing Board, or the courts. Meets with violators and negotiates settlements of enforcement cases in terms of corrective action and time frames
for their accomplishment.

8. Schedules and conducts enforcement conferences or administrative hearings. Provides background data on the case, explains the specific enforcement document, and answers questions.

9. Prepares citation forms and files with District Magistrate. Prosecutes case on behalf of the Commonwealth, presenting data and examining and cross-examining witnesses; recommends imposition of fines to District Magistrates.

10. Researches case files and case history. Prepares documentation for use in the prosecution of cases by field personnel or legal staff. Contacts legal staff and discusses enforcement cases and seeks clarification on rules and regulations.

11. Prepares letters, reports and correspondence.

12. Performs similar work as required.

13. Tracks compliance, penalties and schedules for specific enforcement documents with regard to the Department’s databases and generates reports specific to these activities.

14. Operates a motor vehicle to travel to various work sites.

16. Inputs appropriate data in a prescribed format to meet data quality standards set forth by guidance, training, and policy across all of DEP’s electronic data systems; to include ensuring accuracy and completeness of entries, and where available, the
use of system specific tools to ensure duplicative entries and data quality issues are minimized.

At the direction of the Planning & Conservation Section Chief, the EPCS helps to determine the training needs of staff, public water suppliers, laboratories or others in the industry. The EPCS obtains where possible, develops where necessary and then delivers that training. The EPCS is expected to manage the logistics of developing and delivering training as well as questions about the subject matter; however, they forward requests for resources to the Chief. When conducting compliance activities or program evaluations after receiving direction from the Chief, the EPCS is expected to initiate and complete those activities in
accordance with the directions.
