Position Purpose:
Describe the primary purpose of this position and how it contributes to the organization’s objectives. Example: Provides clerical and office support within the Division to ensure its operations are conducted efficiently and effectively. 

Primary responsibility is the implementation of the Department’s compliance and enforcement policies and procedures pertaining to the Radiation Protection Act, The Radon Certification Act and the rules and regulations governing Radiation Protection.

Description of Duties:
Describe in detail the duties and responsibilities assigned to this position. Descriptions should include the major end result of the task. Example: Types correspondence, reports, and other various documents from handwritten drafts for review and signature of the supervisor.

Develops compliance strategies to deal with specific cases.

Researches case file/case history and prepares documentation for use in the prosecution of cases by Radiation Protection and/or legal staff. Contacts legal staff and discusses enforcement cases, seeks clarification on rules and regulations.

Prepares enforcement documents including, but not limited to: Notice of Violation, Administrative Orders, Field Orders, Consent Order and Agreement, Consent Assessment of Civil Penalty, Assessment of Civil Penalty, and documents associated with enforcement actions such as Major Action Advisories and settlement letters.

Prepares noncompliance letters indicating violations discovered, citing appropriate rules and regulations, indicating corrective action required and establishing time limits.

Calculates civil penalties for use in negotiated settlements and/or litigation to resolve violations of the Radiation Protection Act and the rules and regulations governing Radiation Protection.

Schedules and conducts settlement conferences with violators; provides background data on the case; explains Departmental Orders, Consent Assessment of Civil Penalties or Consent Orders/Agreements; answers questions and negotiates settlements of enforcement cases in terms of corrective action or devices required and time frames for their accomplishment.

Coordinates compliance activities between the program and the Southcentral Regional Office (SCRO) Chief Counsel, including formal consultation with Department attorneys and detailed briefing on cases referred for legal review.

Assists SCRO Radiation Protection staff in resolving problems involving enforcement by review of violation notices, documentation prepared for summary prosecutions, and enforcement with consideration of case priorities.

Assists SCRO Radiation Protection staff in the preparation of documents and prosecution of summary actions, violation notices, to properly use Field Orders, and the calculation of civil penalties for pollution incidents.

Assists in the development of news releases and/or provide information to Community Relations Coordinators and news media reporters, as appropriate or requested, to describe Department enforcement activities.

Coordinates and completes enforcement activities, with or for other programs, at the direction of the Radiation Protection Manager.

Reviews and comments on proposed enforcement policies and strategies prepared by Central Office.

Coordinates with and briefs Central Office personnel on enforcement activities involving controversial issues or significant public concern (i.e., actions against municipalities).

Researches case files and prepare case histories and documentation for use in the prosecution of cases by SCRO Radiation Protection staff and/or legal staff.

Provides input, as requested, to the Regional Director, Radiation Protection Program Manager, and Program Supervisors for prioritization of Radiation Protection enforcement cases.

Provides information in response to requests from the regulated community, municipal officials, consultants, and the public on Departmental programs, functions, rules and regulations, policies and procedures, the Radiation Protection Act and the Radon Certification Act.

Prepares non-traffic citation forms, files with District Magistrate, and prosecutes case on behalf of the Commonwealth, presenting data and examining and cross examining witnesses; recommends imposition of fines to District Magistrates as needed.

Testifies as an expert witness in enforcement cases before District Magistrates, the Environmental Hearing Board or the Courts.

Coordinates data input to the Nuclear Materials Event Database (NMED) with the Central Office NMED Coordinator.

Provides assistance with data management on regional compliance tracking databases, including Environment, Facility, Application Compliance Tracking System (eFACTS).

Assists the Program Manager and Program Supervisors in tracking, reporting that inspections are completed within the scheduled frequency goals and requirements. Assists in monitoring and updating the inspection schedule priority list.

Prepares letters, reports and correspondence. All reports of inspections, investigations, consultations, surveys, etc., are submitted to the employee’s supervisor for approval before being sent to the licensee or registrant.

Participates in and demonstrates competency in Department and United States Nuclear Regulatory Commission sponsored training courses covering a core curriculum of courses as part of the formal qualification process.

Maintains a current qualification journal and documents steps taken to formally qualify to inspect various types of Pennsylvania Radioactive Materials Licenses and/or registrations. This includes, but is not limited to on-the-job and out service formal training. Training may require travel to out of state locations for durations of a week or more.

Conducts surveys, inspections, and investigations of facilities to determine if they are operating within environmental protection rules and regulations.

Routinely uses, and is familiar with, the proper and optimum functionality of radiological survey equipment and associated ancillary apparatus.

Conducts inspections at solid waste facilities and other facilities not subject to a Pennsylvania Radioactive Materials License or Registration in response to radiological incidents, as assigned.

Attends training including, but not limited to retraining/ recurrent/ refresher training, facility tours, focus discussions and demonstrations on topics pertinent to the regulation of radioactive materials. Completes a minimum of 24-hours of training sessions within a 24-month period. Documentation of the training shall be recorded on employee's official training transcript and copies of certificates shall be maintained in the formal qualification journal.

Provides advice to field personnel on the interpretation and application of rules and regulations governing environmental protection.

EMERGENCY RESPONSE CHECKS AND MAINTENANCE:
Performs checks and arranges for maintenance of the Radiologic Rapid Response Vehicle 2 (R3V2) and/or the Emergency Response Team Kits as assigned by the supervisor, in accordance with established procedures. Staff assigned to the R3V2 attend formal training on the safe use and driving of the R3V2. Assigned staff safely operate and drive the R3V2 following formal training, as necessary. Staff assigned to the Emergency Response Team Kits will communicate inconsistencies in the kits to ensure that follow-up action is taken to correct the inconsistencies.

PRESENTATIONS:
Prepares presentations on topics assigned by supervision to encourage shared learning and retraining of staff. The presentations are provided to supervision for review and approval in advance of delivery.

EQUIPMENT CALIBRATION:
Assists in maintaining a database to track radiation protection equipment calibration dates. Assists in ensuring that purchase requests are submitted in a timely fashion and ensures that staff have access to properly calibrated survey equipment.

Improves compliance through compliance assistance efforts as needed.

Operates a motor vehicle to travel to various work sites.

Promotes the Department’s mission.

Inputs appropriate data in a prescribed format to meet data quality standards set forth by guidance, training, and policy across all of DEP’s electronic data systems; to include ensuring accuracy and completeness of entries, and where available, the use of system specific tools to ensure duplicative entries and data quality issues are minimized.
