Position Purpose: Describe the primary purpose of this position and how it contributes to the organization’s objectives. Example: Provides clerical and office support within the Division to ensure its operations are conducted efficiently and effectively. The employee in this position performs professional work in the implementation, management, development, and evaluation of the statewide Dam Safety regulatory program, mandated by the Dam Safety and Encroachments Act. The primary responsibilities of this position are the implementation, execution, and oversight of the program's compliance and enforcement policies and activities. This position is a highly responsible position, which initiates and performs varied assignments. Assignments include conducting and analyzing administrative operations and procedures, developing and recommending work standards and procedures, conducting research, providing comprehensive reports and recommendations and providing liaison duties with agency and non-agency staff. |
Description of Duties: Describe in detail the duties and responsibilities assigned to this position. Descriptions should include the major end result of the task. Example: Types correspondence, reports, and other various documents from handwritten drafts for review and signature of the supervisor. Manages statewide enforcement caseload, working with Central Office and Regional program staff and attorneys as needed to issue and resolve enforcement and statewide compliance initiatives. Assists and provides advice to Central Office and Regional program staff on the enforcement of unusual or difficult cases; reviews recommendations of program staff and recommends appropriate enforcement actions. Researches and prepares Notices of Violation, Administrative Orders, and more significant enforcement actions, in consultation with program managers and Department attorneys. Negotiates compliance settlements with dam owners and permittees, which may result in enforceable agreements being formalized. Testifies as an expert or material witness in enforcement cases before any of the courts of the Commonwealth. Prepares summary citations and prosecutes cases before District Magistrates. Reviews Central and Regional office issuance of compliance orders and violation notices to ensure that DEP's and the Dam Safety Program's policies and procedures are followed. Conducts or oversees statewide compliance initiatives or projects for administrative requirements of dam safety laws (e.g., submittal of Emergency Action Plans, Owner's Annual Inspection Reports, or bonds, and payment of annual (license) fees, if applicable). Approves users and associates them with their EAPs in the CEMPlanner online virtual planning tool (EAP online submittal and review process). Provides technical assistance to users of CEMPlanner. Assists PEMA staff in conducting workshops for the use of CEMPlanner. Assists the program's field personnel in conducting surveys, inspections, and investigations of dam facilities to determine if they are in compliance with Dam Safety laws. Reviews, investigates and prepares responses to complaints and inquiries from the public for the Dam Safety program. Develops, reviews, and comments on program guidance and policy regarding compliance monitoring and enforcement actions, including penalty assessment guidelines and procedures. Trains program personnel in Central and Regional offices on proper procedures and techniques for prosecuting cases, determining penalties, negotiating settlements, and the interpretation and application of rules, regulations, policies and procedures. Provides advice to program personnel on the interpretation and application of rules and regulations governing environmental protection and dam safety. Evaluates program results to ensure consistency in compliance monitoring and enforcement actions taken by Regional and Central office staff. Prepares and publishes reports regarding the program's compliance and enforcement activities. Compiles data and prepares and presents reports showing whether program goals and objectives are being achieved, and makes recommendations based on those data and reports. Outreach (to regulated community, public, other government) Provides information and advice to dam owners and permittees and their engineers and consultants, municipal officials, the general public, and other Commonwealth agencies regarding Departmental functions, programs, rules, regulations, policies and procedures. Prepares and delivers formal presentations about the Dam Safety Program to special interest groups, public meetings, etc. Develops public information documents, such as fact sheets, newsletters and brochures, to explain the Dam Safety Program's functions and activities. Prepares letters, reports, correspondence, and other documents to perform the above-listed duties. Performs other related duties as required by program management. Understand and promote the four pillars of the DEP Vision – Operational Excellence, Climate Leadership, Cultural Competence and Environmental Justice. Inputs appropriate data in a prescribed format to meet data quality standards set forth by guidance, training, and policy across all of DEP’s electronic data systems; to include ensuring accuracy and completeness of entries, and where available, the use of system specific tools to ensure duplicative entries and data quality issues are minimized. Example: In response to a customer inquiry, this work involves researching the status of an activity and preparing a formal response for the supervisor’s signature. Work is assigned by the supervisor or program manager in the form of goals and objectives. The progress of assigned work is reviewed as needed, to assure program objectives are being achieved. The water program specialist works independently in Central office, Regional offices and afield, utilizing good professional judgment in dealing with the regulated community and Central and Regional Office staff. Completed work is reviewed for completeness, good professional practices for dam safety, meeting program goals, and adherence to Department regulations and policies. The employee's duties also relate to administrative functions of the dam safety program and detailed work assignments are in support of dam safety program activities. The Chief of the Preparedness, Enforcement and Security Section provides supervision and guidance. |
