If filled at the HRA3 level, this position will Represent Management at first step, second step Joint Area Committee, and third step State Committee for AGP grievances. And will serve as a panel member at Joint Area and State Committee meetings. If filled at the HRA2 level, this position will respond to discipline and contract interpretation grievances at the first step and be given training to be able to reach the level of representing Management at first step, second step Joint Area Committee, and third step State Committee for AGP grievances. Provides technical advice and services to ensure that management’s viewpoints are effectively represented in the collective bargaining process and that managers and supervisors understand and adhere to labor contracts and related aspects of the American Federation of State, County and Municipal Employees (AFSCME) Master Agreement, Civil Service Reform Act, and Personnel Rules through the following activities: Assists line management in anticipating, understanding, evaluating, and effectively dealing with collective bargaining demands. Participates in contract negotiations by preparing position papers prior to negotiations; presenting proposal recommendations and analyses to Department senior and executive management; assessing contract proposals for Department impact and offering counter proposals when appropriate. Researches, prepares, and delivers contract interpretation and contract briefing seminars to managers and supervisors. Anticipates and/or recognizes collective bargaining provisions that are not receiving proper interpretation. Develops internal methods for communicating accurate interpretation and develops methods for monitoring the application of the accurate interpretation. Investigates discipline and contract interpretation grievances, including those related to safety, within the Accelerated Grievance Procedure (AGP) through interviews and meetings. Responds to discipline and contract interpretation grievances at the first step. Represents Management at first step, second step Joint Area Committee, and third step State Committee for AGP grievances. Serves as a panel member at Joint Area and State Committee meetings. Conducts investigations of violations of the Governor’s Code of Conduct, State Ethics Act, or referrals from the Office of the Inspector General. Develops responses to the Office of Administration through the Section Supervisor on Pennsylvania Justice Network (JNET) reports. Advises managers of the Commonwealth’s policies relative to criminal convictions of employees as stated in the Governor’s Code of Conduct and assists them in the implementation of this policy. Assists Employment Counsel in research and preparation for Civil Service Commission and Pennsylvania Labor Board (PLRB) hearings. Coordinates Department representation at Civil Service Commission and PLRB hearings and assists with witness preparation in partnership with Employment Counsel. Organizes, schedules, and coordinates the administration of labor-management committees in response to Meet and Discuss obligations. Provides staff support to Management committee chair or acts as Management chair. Participates in the implementation of Department furlough actions by determining the order of furlough; preparing and coordinating furlough notifications to employees, unions, and appellate authorities; and meeting with affected employees. Represents Management interests and positions at discipline-related Unemployment Compensation (UC) referee hearings. Reviews and processes compensatory time requests in accordance with the AFSCME Master Agreement and AFSCME Master Memorandum via OnBase. ADVERSE ACTION ADMINISTRATION Provides technical advice and services which ensure that Management has the knowledge to apply corrective discipline concepts, effective performance evaluation or improvement concepts, and work stoppage prevention and control concepts. Advises managers and supervisors of the concepts of just cause and due process when guiding them through a pre-disciplinary conference (PDC) process. Coordinates representation at PDC meetings with the unions when required. Advises managers and supervisors of the concepts to apply in determining appropriate levels of discipline. Assists managers and supervisors with discipline notifications through review and edits. When necessary, coordinates the processing of discipline with payroll and time/attendance staff when loss of time, pay, or seniority result from a discipline action. Conducts review and analysis of discipline and issues determination of concurrence to managers or supervisors for all levels of discipline. Makes recommendations on the merits of discipline to the Section Supervisor prior to implementation of the discipline. PERFORMANCE MANAGEMENT Assists supervisors in the development of Performance Standards, Performance Improvement Plans, Interim Evaluation Reports, and Annual Performance Evaluation Reports. Assists in the review of Agency Annual Performance Evaluation Reports. Responds to requests for temporary hierarchy changes in the Agency EIS Performance Management System. FINANCIAL DISCLOSURE Assists in the review of agency financial disclosure statements required by the State Ethics Act and the Governor's Code of Conduct. CUSTOMER RELATIONS Develops and maintains effective working relationships with Department managers and supervisors, union representatives, and officials through scheduled meetings and telephone contact. Schedules and convenes regular meetings with managers and supervisors to review employee relations climate and to identify and communicate to management the trends, practices, or behaviors that could harm effective relationships through breaches of labor contracts or the law. Assists in the development of procedures and operational guidelines to enhance clients' understanding and adherence to established employee relations policies and procedures. Monitors and periodically reviews the effectiveness of Section practices and procedures and takes action to remedy or revise any practice or procedure that is not making a cost- effective contribution to the Section or to the HR Office. TEAMWORK Provides technical advice and professional services to Section associates, HR Office co-workers, and internal/external agency staff when assigned to team projects. Maintains professional relationship with external advocates and investigators. Honors information requests from Section associates, HR Office co-workers, or external employee relations staff. Participates in group planning, evaluation, and problem solving at the Section level. MANAGEMENT Plans, develops, and controls resources to accomplish objectives and assignments. Performs other related duties as assigned. Due to the remote location of offices supported by the HR Office, the position requires travel throughout the state, occasionally on an overnight basis. |

The analyst is responsible for soundness of fact analysis and recommendations. The incumbent is expected to exercise independence and judgment in the recommendation of actions to be taken. Typically, work is routed directly to the analyst upon receipt in the Section and is reviewed by the Section Supervisor through written status reports. Routine assignments are performed independently and reviewed upon completion, with periodic in-progress reviews to ensure completeness, technical accuracy and adherence to policies and procedures. Non-routine work is assigned with general instructions on the results to be obtained and acceptable timeframes for completion. Special projects and assignments are given to the analyst by the supervisor and will receive review if it is an unusually sensitive matter or could result in statewide impact. Grievance responses and disciplinary actions are subject to review by the supervisor, Division Chief, HR Manager, and the Office of Administration if necessary. |
