Position Purpose: Describe the primary purpose of this position and how it contributes to the organization’s objectives. Example: Provides clerical and office support within the Division to ensure its operations are conducted efficiently and effectively. This position performs a variety of duties, within the Northwest District Oil and Gas Operations coverage area, to ensure compliance with the rules, regulations and policies governing environmental and public health protection related to the oil and gas industry. Work involves performing compliance assistance activities, tracking and assessing compliance, and reviewing and preparing formal enforcement actions. This position also has the responsibility of monitoring and tracking district-wide water supply and gas migration activities, evaluating well transfer applications, and managing the Right-to-Know Law requests submitted to the Northwest District Oil and Gas Program. |

Description of Duties: Describe in detail the duties and responsibilities assigned to this position. Descriptions should include the major end result of the task. Example: Types correspondence, reports, and other various documents from handwritten drafts for review and signature of the supervisor. Conducts compliance assistance activities to educate the regulated community about Department rules, regulations and policies in an attempt to improve compliance rates. Tracks and assesses compliance with Oil and Gas rules and regulations and Program policies. More specifically, the Program’s compliance and enforcement strategy and guidelines for identifying, tracking, and resolving violations is utilized to protect public health and safety, and prevent significant non-compliance status. Develops and delivers training and provides technical assistance to field personnel, the regulated community and the public on the interpretation and application of rules, regulations, procedures, and policies governing environmental and public health protection, and on the Program's compliance and enforcement strategy. Research case files and case history and prepares documentation for use in the prosecution of cases by field personnel or legal staff. Contacts legal staff and discusses enforcement cases, seeks clarification on rules and regulations from legal staff. Reviews and prepares formal enforcement actions, such as Notices of Violation, Field Orders, Consent Assessments of Civil Penalty, Assessments of Civil Penalty, Administrative Orders, and Consent Order and Agreements, indicating violations discovered, corrective action required, control measures to be installed, timeframes for their accomplishment, and established penalties. Schedules and conducts enforcement conferences or administrative hearings, provides background data on the case, explains the specific enforcement document, and answers questions. Meets with violators and negotiates settlements of enforcement cases in terms of corrective action and timeframes for their accomplishment. Testifies as an expert or material witness in enforcement cases before District Magistrates, the Environmental Hearing Board, Common Pleas Court, and Commonwealth Court. Responds to Right-to-Know requests and file review requests. Applies technical program knowledge to identify relevant documents and determines if they are responsive to the pending Right-to-Know request. Provides documents to the file review coordinator and/or Office of Chief Counsel. Reviews and evaluates well transfer applications, and other transfer applications related to erosion and sedimentation control and water obstruction and encroachment permits. Tracks water supply and gas migration investigations within the Northwest District. Tracks discharge/spill related cases and follows up with appropriate enforcement action. Prepares letters, reports and correspondence and similar work, as required. Tracks compliance, penalties and schedules for specific enforcement documents with regard to the Department's databases and generates reports specific to these activities. Works with District Oil & Gas program staff to ensure compliance with program specific policies, procedures, and guidance. Conducts an evaluation of the compliance and enforcement program within an assigned area and prepares a report of recommendations based on the evaluation. Responsible for any special projects given by District Oil & Gas Program Manager. Duties include working independently to use all resources necessary to complete the project assigned. Complies with all applicable laws, regulations, policies, procedures, guidance, and training requirements related to assigned duties and DEP electronic data systems. In conjunction with the supervisor, participates in knowledge management and knowledge transfer efforts by identifying key aspects of assigned duties and proactively sharing knowledge with other employees to support continuity of operations and organizational effectiveness. Develops, maintains, and annually updates a comprehensive desk manual documenting essential duties, standard operating procedures, workflows, system processes, key contacts, reference materials, and other critical operational information necessary to support continuity of operations and effective knowledge transfer. Employees are responsible for ensuring desk manuals remain accurate, current, and accessible in accordance with Department requirements. |

Work is performed independently, with major projects assigned by the Environmental Group Manger. Work is assigned in the form of goals and objectives and the employee exercises considerable freedom in planning, scheduling and completing the work. Periodic meetings are held with the Environmental Group Manager to receive direction and discuss progress in accomplishing assigned objectives. Work is reviewed upon completion for completeness, technical accuracy and quality. |
