Position Purpose: Describe the primary purpose of this position and how it contributes to the organization’s objectives. This position is a Human Services Licensing Representative for the Bureau of Human Services Licensing. This position is responsible for conducting inspections for the purpose of enforcing state laws and regulations governing the licensing of personal care homes and assisted living residences to ensure the health, safety and well-being of personal care home and assisted living residence residents. |
Description of Duties: Describe in detail the duties and responsibilities assigned to this position. Descriptions should include the major end result of the task. Example: Types correspondence, reports, and other various documents from handwritten drafts for review and signature of the supervisor. Conducts initial, annual, interim, provisional follow-up and monitoring inspections of personal care homes and assisted living residences, predominately in an assigned geographic area, with a high degree of independence and discretion, as assigned and in accordance with applicable statutes, regulations, policies and procedures, to determine compliance with state laws and regulations related to the licensing of personal care homes and assisted living residences. Conducts complaint and incident inspections, with a high degree of independence and discretion, as assigned and in accordance with applicable statutes, regulations, policies and procedures, to investigate the factual circumstances related to the complaint or incident, in order to determine compliance with applicable state laws and regulations. Interviews personal care home and assisted living residence residents, staff persons, family members, human service agency staff, medical professionals, law enforcement officials and others, in the course of conducting licensing inspections, to gather information relevant to the compliance of personal care homes and assisted living residences with state laws and regulations. Reviews technical medical, legal and programmatic documents generated by personal care homes, assisted living residences, human service agencies, medical facilities and professionals, law enforcement agencies and others to gather information relevant to the compliance of personal care homes and assisted living residences with state laws and regulations. Plans and directs licensing inspections in collaboration with supervisory staff and other licensing representatives. Provides technical assistance and advice to personal care home and assisted living residence operators and staff related to compliance with state laws and regulations. Uses personal and laptop computers to prepare violation reports and other licensing documents in accordance with policies and procedures. Prepares licensing packets in accordance with policies and procedures. Maintains a full working knowledge of state laws, regulations, regulatory interpretations, policies and procedures, and management directives related to the licensing of personal care homes and assisted living residences. Monitors the implementation of plans of correction to determine time frames for the levying of administrative fines. Responds to inquiries related to personal care home and assisted living residence regulations and licensing. Recommends license and enforcement action based on inspection findings and professional judgment. Investigates alleged illegal operations, including assessing resident needs to determine each person’s need for assistance with activities of daily living or instrumental activities of daily living. Assists in the relocation of personal care home and assisted living residence residents from noncompliant homes to new living arrangements on emergency and planned bases. These duties include, but are not limited to: identifying alternative living options; working with residents, families, and service agencies to determine resident needs and choices; handling and managing the on-site packaging of resident belongings; managing and tracking resident cash-on-hand, medications and records; arranging for transportation; and tracking resident placements. Works cooperatively with state, local and private agencies to obtain information relevant to the compliance of personal care homes and assisted living residences with state laws and regulations. Testifies in administrative and Commonwealth Court hearings regarding inspection findings in collaboration with legal counsel and other department officials. Decides if punitive action is warranted. If decision is potentially punitive, the decision is recommended to management through the chain of command. |
