Position Purpose:
Describe the primary purpose of this position and how it contributes to the organization’s objectives. Example: Provides clerical and office support within the Division to ensure its operations are conducted efficiently and effectively. 

This position provides professional work in the review and analysis of Food Service Management Company (FSMC) contracts for the procurement of meals and/or services for Child Nutrition Program (CNP) sponsors, which include School Nutrition Programs (SNP), Child and Adult Care Food Program (CACFP), and Summer Food Service Program (SFSP). The Bureau of Food and Nutrition (BFN) has oversight for approximately 2,000 entities that are sponsors of the CNP. Approximate 450 sponsors have FSMC contracts. The individual in this position develops and/or maintains contract templates that sponsors must use throughout the procurement process. With supervision, the individual will perform professional work associated with the review, analysis, and approval of the FSMC contracts, as well as participate in the overall review of procurement processes, procedures, and contracts.

Description of Duties:

Reviews and analyzes Requests for Proposals (RFP) completed by school food authorities (SFA) using BFN templates when procuring the services of an FSMC.

Reviews and analyzes standardized contracts that CACFP and SFSP sponsors are entering into with FSMCs for vended meals.

Reviews and analyzes standardized agreements that CNP sponsors are entering into with other CNP sponsors for vended meals.

Develops and/or maintains contract templates, agreements, and attachment/worksheets. Updates contract templates, agreements, and attachments/worksheets.

Possesses an in-depth understanding of all contract language, applicable financial/accounting data, and scope of work to ensure all are compliant with federal and state regulations and allowable under USDA guidelines for each CNP.

Communicates with SFAs regarding any changes/additions to RFPs. Grants SFAs permission to solicit bids for food services. For complex RFPs, permission may be granted in coordination with or elevated to management.

Reviews and analyzes contracts that have been awarded to FSMCs prior to the contract being given final approval and fully executed. Ensures that each contract contains all necessary information and financial data, and is in compliance with all federal and state regulations.

Assesses work statements to ensure they fall within scope and allowability of contract under federal and state regulations.

Analyzes all standardized attachments/worksheets to the contract. Verifies all financial information contained on all attached documentation is accurate and is compliant and allowable under federal and state regulations. Consults with supervisor on more complex documents.

Communicates with SFAs regarding any changes/additions to contracts. Sends contracts back to SFAs for final signatures by SFA and FSMC.

Reviews and analyzes all final contract documents. Grants final approval for full execution of contract. Final approval in complex contracts made in coordination or elevated to supervisor.

Reviews, verifies, analyzes, and approves every Checklist Summary completed by each SFA and CACFP sponsor that has an approved BFN contract with an FSMC.

Reviews, verifies, analyzes, and approves FSMC Fact Sheets completed by each SFA and CACFP sponsor that has an approved BFN contract with a FSMC.

Conducts regulated procurement reviews for SFAs entering into an initial year contract with FSMCs. Provides technical assistance as appropriate.

Reviews, verifies, analyzes, and approves renewal year contracts between CNP sponsors and FSMCs.

Develops, maintains, tracks, and updates CNP sponsor contract information on Excel spreadsheets.

Develops, tracks, and sends out reminder letters to CNP sponsors contracting with FSMCs regarding contract submission deadlines.

Develops and provides training through webinars and in person trainings on the RFP/contracting process for CNPs, FSMCs, and Bureau staff.

Discusses interpretation of new or updated federal or state guidance and regulations with supervisor, and management team including the Bureau Director (when applicable) prior to updating processes, procedures, contract templates, training and resource materials, etc.

As time permits, conducts general procurement reviews according to the procedure used by Administrative Officers and management.

Provides ongoing technical assistance related to FSMC contracts, vended meals contracts, and agreements.


Other duties:
Assists management with procurement and fiscal activities associated with operation of CNP or other duties as assigned.
