This position in the Bureau of Medical Marijuana (BMM) inspects, engages, and exercises compliance activities and oversight of Medical Marijuana Dispensaries, Grower Processors and Clinical Registrants to ensure facility and operational compliance, to support the Bureau’s mission of providing access to medical marijuana for patients and researchers through a safe and effective product development and delivery system. |
Description of Duties: Describe in detail the duties and responsibilities assigned to this position. Descriptions should include the major end result of the task. Example: Types correspondence, reports, and other various documents from handwritten drafts for review and signature of the supervisor. Conducts physical and administrative inspections of Medical Marijuana Organizations (MMOs) to review operational status, alteration completion, complaint status, and ongoing compliance, within the scope of BMM regulations and law. Conducts pre-inspection preparation review and research facility files prior to conducting inspections. Observes components of security systems to compare functionality against regulatory requirements. Inspect growing, harvesting, extracting, packaging, storing, transporting, handling, labeling and distribution processes. Uses observation, investigation, and documentation to review consistency with designated BMM regulations and guidelines. Inspects medical marijuana seeds, clones, plants, harvested material, processing materials, ancillary products, inert ingredients, general facility sanitation, operations, storage, evidence of mold, mildew, insects, or conditions that may otherwise lead to contamination of final product as outlined in regulations. Observes chemical and pesticide storage and use for compliance with BMM regulations and guidance, which may include joint inspections with Pennsylvania Department of Agriculture to ensure safe application and minimize contamination risks. Observes construction activities, potable/fertigation/waste-water systems, boilers, air scrubbers and exhaust systems, waste and composting production and hauling, to ensure BMM regulatory compliance. This may include communication and inspection with Pennsylvania Department of Environmental Protection and local code offices. Reviews in-process and finished medical products in comparison to provided DOH packaging and labeling approvals. Refers to supervisor any findings potentially related to other federal, state, and local jurisdictions. Reviews site plans, security overlays, equipment specifications, insurance documents, and Plans of Operations/Standard Operating Procedures as part of operational and periodic inspections of new facilities, facility expansions, and alteration inspections to ensure consistency with operational requirements as well as BMM regulations and guidelines. Review Applications for Alteration to ensure compliance with BMM regulatory requirements. Assess site, security, sanitation and construction plans, as well as temporary and permanent process changes related to proposed modifications for compliance with BMM regulations and guidance. Review Permit Renewal Applications. Audit required forms, insurance information, Standard Operating Procedures, Diversity Plans, Affiliations, Compliance History, Diversion and Incident Summaries, and Business synopsis for content, accuracy, or completion to ensure BMM regulatory and guidance compliance. Review Additional Location and Move Requests for compliance with zoning restrictions and facility compliance as required by BMM regulations and guidance. Review permittee use of the BMM Electronic Tracking System and corresponding available data, pertaining to seed to sale accountability for medical marijuana materials, waste, finished products, and sales. Review equipment calibration and maintenance records required for compliance with BMM regulations. Review MMO electronic track system usage related to medical professionals checking patient certifications to ensure compliance with BMM regulations. Observes security systems functionality and capabilities, visitor logs, affiliation list, and training certifications, and interview employees to verify employment, visitor, and patient access are compliant relating to facilities’ limited access areas, product handling and distribution as required by BMM regulations. Reviews sample collection plans and procedures through interview and observation to ensure Medical Marijuana samples are collected, analyzed, and accurately documented in Electronic Tracking System which are compliant with BMM regulations and requirements. Archive submitted documentation, forms, and images obtained as part of inspections, complaints, requests, adverse event reporting, and approvals, using toolset provided. Communicate with diverse cross section of workforce, from entry level cashiers to pharmacists, principals, legal representatives, and engineers, to evaluate data and come to a shared outcome with facilities, coworkers, and management. Work independently and with co-inspectors to interpret and report findings to Regional Supervisor. When needed, participate in interviews, investigations, or work in conjunction with internal or external state or federal government entities, law enforcement, legal entities, and legal proceedings. Draft Notice of Deficiencies in response to inspection findings and review plans of corrections. Correspond via phone and email with permittees using discretion to communicate regulatory requirements and office guidance as applicable. Forward new and emerging concerns to Regional Supervisor when requested information or guidance is confidential, unclear, or unavailable. Both independently and at times as a team, schedule and carry out assigned inspection activities. Schedule, conduct, and submit travel requests and reimbursement as per COPA Travel Policy. Public Health Emergency Response – This position may be given an assignment to support the public health emergency response mission of the Department of Health. Emergency assignments could at times be received with little or no advance notice and may continue for any period of time – ranging from a few hours to several weeks, depending upon the nature of the circumstance. The emergency assignments may at times be performed under adverse conditions and may require travel to another site other than the employee’s assigned headquarters for periods of time. Demonstrate awareness of the vulnerable populations the organization serves by identifying, providing, and advocating for resources, services, communication methods, and policies that would help those populations achieve health equity. |

Communications and decisions made in field are based on regulations and interpretation as defined and provided by management, and at times may include analysis and diagnosis of sensitive information and complex technical processes. Work is home headquartered but requires significant travel. Duties are scheduled and performed as assigned, and also as scheduled independently, based on knowledge of standards, procedures, and established work assignments and deadlines. Position provides technical and administrative guidance to Dispensaries, Grower Processors, Clinical Registrants, affiliated contractors and coordinates activities with other agencies or law enforcement as needed. |
