Position Purpose:

The Market Conduct Examiner trainee position requires the employee to be able to be trained on all sections of a market conduct exam.

Description of Duties:
Describe in detail the duties and responsibilities assigned to this position. Descriptions should include the major end result of the task. Example: Types correspondence, reports, and other various documents from handwritten drafts for review and signature of the supervisor.

1. Participates in market conduct examinations, which can take place on-site at insurance companies or in-house at the Insurance Department’s office or teleworking from home, in order to determine if companies are operating in compliance with Pennsylvania’s statutes and regulations.

2. Review insurance companies’ files and electronic records, such as policy forms, claims, consumer complaints, underwriting and rating practices, marketing and sales materials, producer licensing, operations and management, policyholder services information, etc., to determine compliance with Pennsylvania statutes and regulations during the course of a market conduct project.

3. Identify violations of statutes, regulations and adjudications and ensures that the examiners involved in the project secure and retain copies of documentation and evidence to support findings of violations.

4. Evaluates claims processing procedures to ensure claims are handled appropriately, analyzes data to identify trends in claim payments, identifies procedural problems, and develops recommendations for corrective action.

5. Ensures insurance producers hold appropriate and active licenses.

6. Reviews companies’ consumer complaint handling processes and complaint registers, obtain samples of consumer complaint cases, analyzes information to determine compliance with statutes and regulations, and develops recommendations for corrective action.

7. Prepare reports of findings or portions of reports of findings.

8. Identify and recommend corrective action necessary for insurance companies to remediate consumer harm as well as to address and correct findings of non-compliance.

9. Attend and testify at administrative hearings to support findings of projects as necessary.

10. Perform other duties and special projects as assigned or required.

Decision Making:

Determines if there are violations of statutes and regulations after reviewing sections of an exam. Refers to Examiner II on occasion for their input in these determinations. Refers initial summary reports to the Examiner II who is responsible for the resolution of each section of the exam. Determines what constitutes violations of statutes and regulations, what findings should simply be listed as concerns, and what the recommended corrective actions are so the company being examined can achieve compliance.
