Position Purpose:
Describe the primary purpose of this position and how it contributes to the organization’s objectives. Example: Provides clerical and office support within the Division to ensure its operations are conducted efficiently and effectively. 

Performs a full range of research, request, and retrieval of Department records in response to the District’s Tort Liability Claims, Subpoenas, and Right-to-Know Law requests.

Description of Duties:

Establishing an environment for delivery of effective and efficient maintenance programs support services for transportation activities; supporting a strategically planned design program emphasis; helping to develop and implement results oriented interdisciplinary teams to improve work methods, introduce improved technology, enhance service delivery and quality; ensuring prompt, courteous and accurate customer services; improving internal and external communications; and increasing the levels of safety for workers and travelers in the following way:

Researches and responds to formal (Interrogatories, Request for Production of Documents, Requests for Admissions) and informal discovery request (record inspections) associated with the Department’s tort litigation for Bucks, Chester, Delaware, Montgomery and Philadelphia Counties.

Researches and responds to information, policy and document requests from the Commonwealth’s tort claim evaluators of the Department of General Services, Bureau of Finance and Risk Management, Tort Claims Pre-Litigation Division for Bucks, Chester, Delaware, Montgomery and Philadelphia Counties.

Researches and responds to tort related information and document requests from the private sector for Bucks, Chester, Delaware, Montgomery and Philadelphia Counties.

Builds and maintains potential files by collecting and obtaining evidence and supporting documentation relative to serious accidents in the district.

Interviews witnesses, obtains signed or recorded statements, police reports, weather reports; inspects vehicle and property damages; and recommends expert witnesses.

Gathers photographic evidence of site conditions, location, or other conditions as required to establish documentation and to ascertain if any deficiencies existed, as pertains to existing department policies. Contacts county and district office personnel to gather additional information.

Coordinates tort related subpoenas served upon the Department of General Services, Bureau of Finance and Risk Management, Tort Claims Pre-Litigation Division for Bucks, Chester, Delaware, Montgomery and Philadelphia Counties.

Forwards tort notice of claims to the Department of General Services, Bureau of Finance and Risk Management, Tort Claims Pre-Litigation Division for Bucks, Chester, Delaware, Montgomery and Philadelphia Counties.

Appears and testifies at court proceedings.

Assists in trial preparation.

Maintains case files.

Functions as the District 6-0 Right-To-Know Law (RTKL) Coordinator.

Coordinates responses to RTK requests from Open Records Office in a manner to meet time frames established by RTK laws. Performs the day-to-day functions required to respond to requests. Requests may involve all counties and all units within District 6-0.

Makes requests for extensions to Open Records Office when it is determined that a response cannot be submitted within 2 business days.

Requests assistance from management when District staff or other sources are not providing information in a timely manner.

Perform other duties as assigned.

Succession Planning:
Take an active role in succession planning by completing a Career Development Plan in collaboration with the supervisor. In conjunction with the supervisor, participate in knowledge management/transfer by identifying key aspects of the job and sharing explicit and tacit program/technical knowledge with other employees.

Department Green Plan Policy:
Commit to following the Department’s Green Plan Policy (Pub 712) and the associated principles. Failure to comply with the Department’s Green Plan Policy shall be documented in the employee’s performance review.

Fair Labor Standards Act (FLSA):
Understand your responsibilities as a supervisor under the FLSA to ensure that employees are paid appropriately for hours they worked – i.e., all time spent furthering the business of the Department. Ensure that your employees are performing work only within their regularly assigned shift hours, unless overtime has been directed and approved in advance of completed work. There should be no confusion as to when work has officially started or ended. Ensure that all hours employees work are fully accounted for on payroll sheets.



Decision Making:
Describe the types of decisions made by the incumbent of this position and the types of decisions referred to others. Independently coordinates the District’s Tort and Right-to-Know Law programs.

Independently determines the data and records needed for claims and information requests.

Independently researches and processes claims and complaints.

Independently prepares statements, witnesses, etc. for depositions and hearings.

Independently provides training and technical guidance.

Refers particularly sensitive claims and information requests to a higher-level supervisor.
